AN ORDINANCE AMENDING THE CODE OF THE BOROUGH OF HADDONFIELD, COUNTY OF CAMDEN, STATE OF NEW JERSEY, CHAPTERS 232 ENTITLED VEHICLES AND TRAFFIC

BE IT ORDAINED BY the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:

SECTION I:

Chapter 232, entitled Vehicles and Traffic, is hereby amended as follows:

1.) Article IV – Parking, Section 232-29, entitled Overnight Parking shall be amended as follows:

§232-29(D)(2) Application Process.

(e) Approved permits may be obtained from the Police Department during normal business hours after appropriate fees are paid.

[1] For those with no off-street area for parking, as defined in paragraph C - $25 per vehicle issued a permit for the first two permits per household. For permits issued after July 1, the fee is $15 per permit for the first two (2) permits. Additional permits may be obtained annually for $100 per vehicle; for permits issued on or after April 1, the fee shall be equal to $10 per month and must be purchased for the remainder of the calendar year.

[2] All others where off-street area for parking is too small, as defined in paragraph c - $100 per vehicle issued an annual permit. For permits issued on or after April 1, the fee shall be equal to $10 per month and must be purchased for the remainder of the calendar year.

SECTION III:

All ordinances or parts of ordinances inconsistent with this amending ordinance be and they are hereby repealed to the extent of such inconsistencies only.

SECTION IV:

If any section or provision of this ordinance shall be held unconstitutional or invalid by any court, the remaining sections and provisions shall, notwithstanding such holding, remain and be in full force and effect.

SECTION V:

This ordinance shall be in effect upon passage and publication according to law.

Authorization to Release Performance Bond –2008 Road Program: Reconstruction of Colonial Avenue and Lake Street – Marandino Concrete Co., Inc. (Tabled from December 22, 2009 Agenda)

WHEREAS, the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey previously approved a Performance Bond for the 2008 Road Program: Reconstruction of Colonial Avenue and Lake Street Project in accordance with the bid accepted for such work and awarded on September 9, 2008; and
WHEREAS, the engineer has conducted an inspection for this project and based upon their investigation it is recommend to release the Performance Bond.
WHEREAS, prior to the recommended release of the Performance Bond, the Borough Engineer’s recommend the activation of the Maintenance Bond in the amount of $349,925.33 to be held for a period of two (2) years.
WHEREAS, the effective date of activation of the Maintenance Bond is November 17, 2009; and
WHEREAS, the Borough of Haddonfield is in receipt of the recommended maintenance bond.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey that the Performance Bond be released in the amount of $348,282.00.

Authorization to Approve Transfers in Appropriation Reserve

WHEREAS, N.J.S.A. 40A:4-59 provides that all unexpended balances carried forward after the close of the year are available, until lapsed at the close of the year are available, until lapsed at the close of the succeeding year, to meet specific claims, commitments or contracts incurred during the preceding fiscal year, and allow transfers to be made from unexpended balance which are expected to be insufficient during the first three months of the succeeding year;

NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, the transfers in the amount of $22,400.00 be made between the 2009 Budget Appropriation Reserves as follows:

Authorization to Pay School Taxes – 8th Installment

RESOLVED, by the Board of Commissioners of the Borough of Haddonfield,
County of Camden, State of New Jersey, that THREE MILLION EIGHTY-FOUR THOUSAND TWO HUNDRED FORTY-SIX DOLLARS AND NO CENTS ($3,084,246.00) be wired from the Current Account, payable to the account of the School District of Haddonfield to pay the eighth installment of the 2009-2010 School Year Tax.

Authorization to Participate in Camden County Cooperative Pricing System – Bid A-51 for Office Supplies

WHEREAS, the Borough of Haddonfield is a participant in a cooperative pricing project through Camden County System Identifier No. 57-CCCPCS, for Office Supplies; and
WHEREAS, on Resolution #3, dated December 17, 2009, the Board of Chosen Freeholders awarded of a contract between Camden County Cooperative members and Office Basics for the purchase of Office Supplies for a two (2) year period; and
WHEREAS, the contract will go into effect on February 1, 2010 and will expire on January 31, 2012; and
WHEREAS, there is an option to extend said contract for two additional one-year contracts; and
WHEREAS, the Borough of Haddonfield, as a member of the Camden County Cooperative Purchasing group desires to be included in this bid; and
WHEREAS, funding for this purpose shall not exceed the maximum budgeted line items for office supplies in the Borough’s 2010 budget.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey as follows:
1. That a contract is hereby extended to Office Basics,, 22 Creek Circle, Boothwyn, PA 19061 for a term of two (2) years commencing February 1, 2010 through January 31, 2012, with the option of two additional one-year extensions; and
2. That funding for this purpose for the Borough of Haddonfield shall not exceed the maximum line items for office supplies in the Borough of Haddonfield’s 2010 budget and shall be encumbered prior to incurring the obligation pursuant to N.J.A.C. 5:34-5.3(b)(2).

Authorization to Sign Interlocal Services Agreement – Public Archives and Records Infrastructure Support (PARIS) Grant

WHEREAS, the State of New Jersey has launched its pioneering Public Archives and Records Infrastructure Support (PARIS) grant program to meet the strategic records management, preservation, and storage needs of county and municipal governments; and
WHEREAS, a top priority of the PARIS grants program is to achieve efficiencies of cost and operation through shared services and to create a service structure for municipalities that do not have the resources to create one for themselves; and
WHEREAS, in the 2010-11 grant cycle, priority funding will be given to county projects to perform municipal inventories and other records management projects for all of their municipalities; and
WHEREAS, the Borough of Haddonfield desires to collaborate with the County of Camden in the performance of the implementation of Records Inventory Management – Shared Services project; and
WHEREAS, the Borough of Haddonfield is acknowledging that their eligible funding of $40,000 will be leveraged with the County of Camden; and
WHEREAS, the Borough of Haddonfield is acknowledging that the County of Camden would be the lead agency and the applicant for such a proposal.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that the appropriate Borough officials be authorized to sign an Interlocal Services Agreement with Camden County for participation in the PARIS grant for the purposes set forth above.

WHEREAS, the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, under Resolution 2009-12-22-270, authorized the release of the Performance Bond in conjunction with the NJDOT FY2009 – Reconstruction of Redman Avenue Project in accordance with the bid accepted for such work and awarded on June 23, 2009; and
WHEREAS, it was determined that the Maintenance Bond originally supplied in the amount of $27,579.93 prior to the release of the Performance Bond was for an incorrect amount; and
WHEREAS, the contractor has subsequently supplied a corrected Maintenance Bond in the amount of $275,799.29 to be held for a period of two (2) years; and
WHEREAS, the Borough of Haddonfield is in receipt of the recommended maintenance bond.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey that the Performance Bond be released in the amount of $293,764.47.

Authorization to Release Performance Bond – For Purchase of a Pierce Velocity Pumper – Pierce Manufacturing

WHEREAS, the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey previously approved the purchase of a Pierce Velocity Pumper from Pierce Manufacturing on December 26, 2006 under Resolution 2006-12-26-259; and

WHEREAS, a performance bond was required to be submitted to the Borough of Haddonfield in the amount of $467,060.00; and

WHEREAS, the truck was received and is in proper working condition, as such Haddon Fire Co. No. 1’s Fire Chief has recommended the release of the Performance Bond; and

NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey that the Performance Bond be released in the amount of $467,060.00.

Authorization to Release Performance Bond – For Purchase of a Fairbanks-Morse Model Sewage Pump – Deltronics Corporation

WHEREAS, the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey previously approved the purchase of a Fairbanks-Morse Model Sewage Pump from Deltronics Corporation on June 12, 2007 under Resolution 2006-06-12-129; and

WHEREAS, a performance bond was required to be submitted to the Borough of Haddonfield in the amount of $29,228.00; and

WHEREAS, the pump was received as is in proper working condition, as such the Borough of Haddonfield’s Director of Utilities has recommended the release of the Performance Bond; and

NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey that the Performance Bond be released in the amount of $29,228.00.

Authorization to Release Performance Bond – Centennial Court Field House Addition and Renovations – System Construction Consultants, Inc.

WHEREAS, the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey previously approved an addition and renovations to the Centennial Court Field House by System Construction Consultants, Inc. on October 10, 2006 under Resolution 2006-10-10-213; and

WHEREAS, a performance bond was required to be submitted to the Borough of Haddonfield in the amount of $184,868.00 for this project; and

WHEREAS, the building was built in 2007 per the specifications, as such the project architect, Thomas B. Wagner, has recommended the release of said Performance Bond.

NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey that the Performance Bond be released in the amount of $184,868.00.

Authorization to Hold “Love Is In The Air” Event

WHEREAS, the Board of Commissioners of the Borough of Haddonfield deems it in the best interest of its citizens to encourage organized events and festivals for the benefit of the community; and
WHEREAS, the Partnership for Haddonfield (PfH) Marketing Committee wishes to sponsor an event entitled Love Is In The Air on Saturday, February 6, 2010 to Sunday, February 7, 2010 and Saturday, February 13, 2010 to Sunday, February 14, 2010.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:

1. During the Love Is In The Air event on Saturday, February 6, 2010 through Sunday, February 7, 2010 and on Saturday, February 13, 2010 through Sunday, February 14, 2010 strolling and stationary outdoor entertainment is hereby permitted along public sidewalks and places within the business district as designated by the PfH Marketing Committee from 12:30 p.m. to 3:30 p.m.

2. Provide real estate style “More Stores” signs listing activities as designated by the committee from Saturday, February 6, 2009 through Sunday, February 7, 2010 and Saturday, February 13, 2010 through Sunday, February 14, 2010 between 10:00 p.m. to 5:00 p.m. on Saturdays and between the hours of 12:00 p.m. to 4:00 p.m. on Sundays.
