AN ORDINANCE AMENDING THE CODE OF THE BOROUGH OF HADDONFIELD, COUNTY OF CAMDEN, STATE OF NEW JERSEY, CHAPTERS 47 ENTITLED POLICE DEPARTMENT TO INCREASE THE NUMBER OF APPOINTMENTS ALLOWED FOR CORPORALS

BE IT ORDAINED BY the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:

SECTION I:

Chapter 47, entitled Police Department, is hereby amended as follows:

1.) Article I – Establishment, Section 47-4, entitled Uniformed Police Force Members shall be amended as follows:

§47-4 Uniformed police force members.

A. There is herby created in and for the Borough of Haddonfield a Police Department which shall consist of no more than one Chief of Police, no more than one Captain, no more than two Lieutenants, no more than five Sergeants, no more than [four] five Corporals, and no more than 12 police officers to be appointed to these positions by the Appropriate Authority.

SECTION II:

All ordinances or parts of ordinances inconsistent with this amending ordinance be and they are hereby repealed to the extent of such inconsistencies only.

SECTION I11:

If any section or provision of this ordinance shall be held unconstitutional or invalid by any court, the remaining sections and provisions shall, notwithstanding such holding, remain and be in full force and effect.

SECTION IV:

This ordinance shall be in effect upon passage and publication according to law.

Authorization to Apply for Recycling Tonnage Grant

WHEREAS, the Mandatory Source Separation and Recycling Act, P.L. 1987, c. 102, has established a recycling fund from which tonnage grants may be made to municipalities in order to encourage local source separation and recycling programs; and
WHEREAS, it is the intent and the spirit of the Mandatory Source Separation and Recycling Act to use the tonnage grants to develop new municipal recycling programs and to continue and to expand existing programs; and
WHEREAS, the New Jersey Department of Environmental Protection is responsible to promulgate recycling regulations to implement the Mandatory Source Separation and Recycling Act; and
WHEREAS, the recycling regulations impose on municipalities certain requirements as a condition for applying for tonnage grants, including but not limited to, making and keeping accurate, verifiable records of materials collected and claimed by the municipality; and
WHEREAS, a resolution authorizing this municipality to apply for such tonnage grants will memorialize the commitment of this municipality to recycling and to indicate the assent of the Borough of Haddonfield to the efforts undertaken by the municipality and the requirements contained in the Recycling Act and recycling regulations; and
WHEREAS, such a resolution should designate the individual authorized to ensure the application is properly completed and timely filed.
NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, hereby endorses the submission of the recycling tonnage grant application to the New Jersey Department of Environmental Protection and designates Dave Watson, Public Works Superintendent to ensure that said application is filed properly.

Authorization to Apply for Year 32 CDBG –Accessibility Improvements to MKH

WHEREAS, the Borough of Haddonfield is entitled to Community Development Block
Grant funding; and

WHEREAS, the Board of Commissioners have chosen to submit an application for Program Year 31 (2010-2011); and

WHEREAS, the grant allocation for Year 31 (2010-2011) for the Borough of Haddonfield is $29,660.00; and

WHEREAS, the governing body has agreed to apply for funding for the following activity:
Accessibility Improvements to Mabel Kay Senior Center

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that the Mayor is hereby authorized to sign the Project Description Form for Program Year 32 (2010-2011).

RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, in the County of Camden and State of New Jersey, as follows:
WHEREAS, Donald M. Carmody has made application for membership in Haddon Fire Company No. 1 and has been accepted by the Company.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, that the application of Donald M. Carmody for membership in Haddon Fire Company No. 1 is accepted.

Authorization to Advertise for Sealed Bids – Asphalt Street Patching and Miscellaneous Concrete Replacement

RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that the Borough Clerk is hereby authorized to advertise for the Receipt of Sealed Bids for “ASPHALT STREET PATCHING AND MISCELLANEOUS CONCRETE REPLACEMENT” for the Borough of Haddonfield to be received on or before Thursday, March 4, 2010 at 10:00 a.m. in Room 102 of the Haddonfield Borough Hall.

Authorization to Display Merchandise – Various

WHEREAS, § 151-3 of the Code permits outside decorative displays of merchandise at retail properties within commercial zones based on specific guidelines and with the annual approval of the Board of Commissioners; and
WHEREAS, the below listed businesses have submitted the required applications and fees requesting such approval and have been reviewed by the Zoning Office with regard to compliance with the provisions of the Ordinance or have obtained a variance from the Planning Board;
NOW THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey as follows:

1. That the following business will be authorized to have an outdoor decorative display of merchandise during 2010 pursuant to § 151-3 of the Code and their application:

Jersey Java and Tea Company – 140 N. Haddon Avenue
Hoagie Works – 13 S. Haddon Avenue
Beaute Ange Boutique – 3 Kings Court

2. That such approvals are conditioned on the receipt by the Borough of a certificate verifying they have an insurance liability policy with amounts of coverage of at least $1,000,000 acknowledging that the display is part of the coverage and naming the Borough of Haddonfield as an additional named insured.

3. That the above businesses comply with all other Federal, State and Local laws.

4. The above business hold harmless and indemnify the Borough of Haddonfield from any and all damages and/or claims, including attorney fees and court costs, which may arise out of its use of the public sidewalks in front of their premises.

5. No easement, license or right is hereby granted by this resolution other than the municipal consent, for the time period, as identified herein.

6. The Borough of Haddonfield reserves the right to terminate its consent as its sole discretion at any time during this period.

Authorization for Outdoor Eating Facility Permit – Hoagie Works

WHEREAS, the Code of the Borough of Haddonfield, Chapter 151 permits outside eating facilities adjacent to existing restaurants and businesses selling prepared food in order to encourage the viability of restaurants and food-service establishments and to enhance the vitality of the Borough of Haddonfield; and
WHEREAS, the below listed business has submitted the required application and fees requesting such approval which has been reviewed by the Zoning Office with regard to compliance with the provisions of the Code;
NOW THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey as follows:

1. That the following businesses have been authorized to have an outdoor eating facility from the date of this Resolution to December 31, 2010 pursuant to The Code of the Borough of Haddonfield, Chapter 151 and their application:

Hoagie Works – 13 S. Haddon Avenue

2. That the Borough of Haddonfield has received a certificate verifying they have an insurance liability policy with amounts of coverage of at least $1,000,000 acknowledging that outside seating is part of the coverage and naming the Borough of Haddonfield as an additional named insured.

PROCLAMATION

WHEREAS, each February Haddonfield, along with communities throughout our country, are in the midst of a month long observance of Black History Month; and

WHEREAS, Americans are aware of the election of this country’s first African American President, Barak Obama, Jackie Robinson’s contributions to baseball and General Colin Powell’s military leadership in Desert Storm, few probably could pinpoint college founder Mary McLeod Bethune’s contribution to education or identify astronomer Benjamin Banneker; and

WHEREAS, ignorance of such facts is what led Carter G. Woodson, son of former slaves, to create the first Negro History Week in February 1926, a culmination of the separate efforts of Mary Church Terrell of the National Council of Colored Women and the African American Collegiate fraternity Omega Phi Psi, which became Black History Month in 1976; and

WHEREAS, February was selected because Frederick Douglass, a staunch human rights advocate, and Abraham Lincoln, another defender of equality among mankind, were born that month; and

WHEREAS, the Association for the Study of Afro-American Life and History (ASNLH) chose this year’s theme to be “The Quest for Black Citizenship in the Americas”, which is a chance to examine the evolution of our county and how African Americans helped draw us ever closer to becoming a more perfect union.

WHEREAS, Haddonfield takes pride in its role as a community that participated in the route of the Underground Railroad during the Civil War years to help save African slaves from lives of treatment as merchandise rather than as human beings; and

WHEREAS, the Borough of Haddonfield, under leadership of Haddonfield’s Human Relations Commission, made a priority of providing opportunities to join in focal educational experiences with programs such as: “Frederick Douglass Presents”; “A Community Conversation About the Impact of Dr. King On Our Lives”; a Martin Luther King Day performance by the Choir from the Camden High School of the Performing Arts; a discussion on “The Legacy of Rosa Parks”; and more recently presented “Haddonfield’s Diversity: Honoring Individuals Who Make a Difference” to recognize those whose lives quietly embody the values and visions of Dr. King.

NOW, THEREFORE, BE IT RESOLVED that we, the Board of Commissioners of the Borough of Haddonfield, proclaim the month of February 2010 as

BLACK HISTORY MONTH

in the Borough of Haddonfield and urge residents to take advantage of many programs available in the Delaware Valley and pay tribute to inspirational African Americans from the past with appreciation and welcome those who will continue into the future with untold contributions to this country and the world.
