AN ORDINANCE OF THE BOROUGH OF HADDONFIELD, COUNTY OF CAMDEN, STATE OF NEW JERSEY, AUTHORIZING THE REMEDIATION, AS THE CASE MAY BE, OF THE BOROUGH PUBLIC WORKS YARD AND RELATED ITEMS AS GENERAL IMPROVEMENTS FOR THE BOROUGH OF HADDONFIELD; APPROPRIATING $50,000.00 FROM GENERAL CAPITAL SURPLUS.
BE IT ORDAINED, by the Borough Commissioners, of the Borough of Haddonfield, County of Burlington, State of New Jersey, (not less than two thirds, of the full membership thereof affirmatively concurring), as follows:
SECTION I
The following improvements, together with all appurtenances, work and materials necessary or incidental thereto, are hereby authorized as general improvements to be made by the Borough of Haddonfield ("Borough")
1.1 (a) Remediation of Public Works Yard
1.1 (b) Estimated Cost of the Remediation and related items is $50,000.00.
1.1 (c) The Estimated Useful Life of the Improvement is fifteen (15) years, as
provided in Section 40A:2-22 et seq of the Local Bond Law
SECTION II
(a) The estimated cost to be paid by the Borough for the improvements authorized and approved in Section 1 hereof ("Improvements") is $50,000.00.
(b) The remediation and related items are not current expenses and are improvements which the Borough may lawfully make as general improvements.
(c) For the financing of the aggregate costs of said improvements and the financing thereof, there is hereby appropriated the sum of $50,000.00 from General Capital Surplus.
SECTION III
All ordinances or parts of ordinances inconsistent with this ordinance be and they are hereby repealed to the extent of such inconsistencies only.
SECTION IV
If any section or provision of this ordinance shall be held unconstitutional or invalid by any court, the remaining sections and provisions shall, notwithstanding such holding, remain and be in full force and effect.
SECTION V
This ordinance shall be in effect upon passage and publication according to law.
FIRST READING

AN ORDINANCE AMENDING THE CODE OF THE BOROUGH OF HADDONFIELD, COUNTY OF CAMDEN, STATE OF NEW JERSEY, CHAPTER 226, ENTITLED UTILITIES, WATER AND SEWER, TO FIX AND ESTABLISH THE RATES FOR THESE SERVICES FURNISHED BY THE BOROUGH OF HADDONFIELD
WHEREAS, these increases will take effect with the second billing cycle in 2010.
THEREFORE, be it ordained by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:
SECTION I:
Chapter 226, Sections 16(A), 17(A) and 18 of the Code of the Borough of Haddonfield hereby be amended to read as follows:
§226-16. Water rates.
A. The rates to be charged by the Borough of Haddonfield for water produced by the Borough shall be $4.70 [$4.60] per thousand gallons to be charged to customer for water which is furnished to a property as calculated from the meter reading or estimate used for billing beginning with the second quarter mailing.
§226-17. Sewer service rates.
A. The rate to be charged by the Borough of Haddonfield for sewer service shall be $2.25 [$2.20] per thousand gallons of water furnished to a property as calculated from the meter reading or estimate used for billing beginning with the second quarter mailing.
§226-18. Service fee for separate billings.
A service fee of $10 [$5] per quarter shall be charged to each user of water or sewer service for which a separate billing account is required. The fee will be included in the quarterly bill and shall be considered a part thereof.
SECTION II:
All ordinances or parts of ordinances inconsistent with this amending ordinance be and they are hereby repealed to the extent of such inconsistencies only.

Authorization to Enforce Water Use Restrictions
WHEREAS, the Code of the Borough of Haddonfield, Chapter 226, Article X authorizes the Borough Commissioners to declare a temporary water emergency and establish restrictions, and provides penalties for violations of such restrictions; and
WHEREAS, Pursuant to that Chapter, whenever the Board of Commissioners determines that it is necessary to restrict the use of potable water provided by the Borough water utilities due to circumstances that could endanger the health and safety of the public, can declare a temporary water emergency and authorize restrictions considered necessary to protect the health and safety of the public.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:
That the Commissioner of Public Works is hereby authorized to determine the dates between June 14, 2010 and September 6, 2010 that the following mandatory restrictions shall be enforced, based on the conditions of water use and availability, subject to any future resolutions by the Board of Commissioners:
Level I: Prohibition of outdoor use of potable water from the Haddonfield water system between the hours of 6:00 a.m. and 6:00 p.m.
Level II: If conditions affecting the health and safety of the public is further jeopardized by water use, an additional prohibition of outdoor watering during the 6:00 p.m. to 6:00 a.m. period on alternate days, such that properties with odd numbered addresses are allowed to water only on odd numbered calendar dates and properties with even numbered addresses are allowed to water only on even numbered dates.

Authorization to Advertise for Sealed Bids – 2010 Tanner Street Utility Reconstruction Project
WHEREAS, the Borough Engineer has provided the Board of Commissioners with a recommendation to approve plans for the repair of the Haddonfield Public Library Roof.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that the recommended plans are approved.
BE IT FURTHER RESOLVED that the Borough Clerk is hereby authorized to re-advertise for the Receipt of Sealed Bids for “2010 TANNER STREET UTILITY RECONSTRUCTION PROJECT” for the Borough of Haddonfield to be received on or before Thursday, June 17, 2010 at 10:00 a.m. in Room 102 of the Haddonfield Borough Hall.

Authorization to Sign the 2009 Business Stimulus Fund Grand Grant Agreement from the Department of Environmental Protection Division of Parks and Forestry
WHEREAS, the Board of Commissioners of the Borough of Haddonfield desires to further the public interest by obtaining from the State of New Jersey in the amount of approximately $6,900 to fund the following project:
Borough of Haddonfield, 2009 CSIP Assessment/Inventory Grant
and
NOW, THEREFORE BE IT RESOLVED by the Board of Commissioner of the Borough of Haddonfield, County of Camden, State of New Jersey, that the Borough Administrator, Sharon McCullough, or the successor to this office is authorized as follows:
1. To make application for such a grant,
2. If awarded, to execute a grant agreement with the State for a grant in the amount not less than $6,900; and
3. To execute any amendments thereto which to increase the Grantee’s obligations.

Authorization to Submit Grant Application – Department of Environmental Protection – Green Acres Enabling Resolution
WHEREAS, the New Jersey Department of Environmental Protection, Green Acres Program (“State”), provides loans and/or grants to municipal and county governments and grants to nonprofit organizations for assistance in the acquisition and development of lands for outdoor recreation and conservation purposes; and
WHEREAS, the Board of Commissioners of the Borough of Haddonfield desires to further the public interest by obtaining funding in the amount of $500,000 from the Sate to fund the following project(s): “Request for Green Acres Funding” at a cost of $778,750;
NOW, THEREFORE, the Board of Commissioners resolves that the Borough Administrator or the successor to this office is hereby authorized to:
a. make application for such a loan and/or grant,
b. provide additional application information and furnish such documents as may be required, and
c. act as the authorized correspondent of the above names applicant; and
WHEREAS, the State shall determine if the application is complete and in conformance with the scope and intent of the Green Acres Program, and notify the applicant of the amount of the funding award; and
WHEREAS, the applicant is willing to use the State’s funds in accordance with such rules, regulations and applicable statutes, and is willing to enter into an agreement with the State for the above named project;
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that:
1. The Borough Administrator to the Borough of Haddonfield is hereby authorized to execute an agreement and any amendment thereto with the State known as “Request for Green Acres Funding;
2. If awarded that the applicant will acquire the matching share funds for the project, if a match is required, in the amount of $500,000;
3. In the event the State’s funds are less than the total project costs specified above, the applicant has the balance of funding necessary to complete the project;
4. The applicant agrees to comply with all applicable federal, state, and local laws, rules and regulations in its performance of the project; and
5. This resolution shall take effect immediately.
