AN ORDINANCE AMENDING THE CODE OF THE BOROUGH OF HADDONFIELD, COUNTY OF CAMDEN, STATE OF NEW JERSEY, CHAPTER 226, ENTITLED UTILITIES, WATER AND SEWER, TO FIX AND ESTABLISH THE RATES FOR THESE SERVICES FURNISHED BY THE BOROUGH OF HADDONFIELD
WHEREAS, these increases will take effect with the second billing cycle in 2010.
THEREFORE, be it ordained by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:
SECTION I:
Chapter 226, Sections 16(A), 17(A) and 18 of the Code of the Borough of Haddonfield hereby be amended to read as follows:
§226-16. Water rates.
A. The rates to be charged by the Borough of Haddonfield for water produced by the Borough shall be $4.70 [$4.60] per thousand gallons to be charged to customer for water which is furnished to a property as calculated from the meter reading or estimate used for billing beginning with the second quarter mailing.
§226-17. Sewer service rates.
A. The rate to be charged by the Borough of Haddonfield for sewer service shall be $2.25 [$2.20] per thousand gallons of water furnished to a property as calculated from the meter reading or estimate used for billing beginning with the second quarter mailing.
§226-18. Service fee for separate billings.
A service fee of $10 [$5] per quarter shall be charged to each user of water or sewer service for which a separate billing account is required. The fee will be included in the quarterly bill and shall be considered a part thereof.
SECTION II:
All ordinances or parts of ordinances inconsistent with this amending ordinance be and they are hereby repealed to the extent of such inconsistencies only.
SECTION III:
If any section or provision of this ordinance shall be held unconstitutional or invalid by any court, the remaining sections and provisions shall, notwithstanding such holding, remain and be in full force and effect.
SECTION IV:
This ordinance shall be in effect upon passage and publication according to law.

AN ORDINANCE AMENDING THE CODE OF THE BOROUGH OF HADDONFIELD, COUNTY OF CAMDEN, STATE OF NEW JERSEY, CHAPTER 29 ENTITLED FIRE DEPARTMENT
BE IT ORDAINED BY the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:
SECTION I:
The code of the Borough of Haddonfield, County of Camden, State of New Jersey, Chapter 29 entitled “Fire Department” is hereby amended as follows:
§29-1. Haddon Fire Company No. 1
This Chapter ratifies the creation of the Fire Department of the Borough of Haddonfield which is to be referred to as Haddon Fire Company No. 1, which has and shall provide to the citizens of the Haddonfield Borough an efficient and timely emergency response to fire and other hazardous situations with the purpose of preservation of life, property and the environment. Haddon Fire Company No. 1 is herein referred to as the “Fire Department.”
§29-2. Mission Statement
The mission of Haddon Fire Company No. 1 is to:
A. Provide an efficient and timely response to fire(s) and other hazardous situations.
B. Provide public education and awareness about fire safety and related hazards.
C. Provide emergency and non-emergency support services to our community and other public safety agencies.
D. Provide their members with continuous training and education.
E. Provide a safe and healthy environment for their members.
Haddon Fire Company No. 1 takes great pride in its history and anticipates a progressive future while constantly striving to improve the quality of services provided.
§29-3. Appropriate Authority
The Director of Public Safety of the Borough of Haddonfield is designated as the Appropriate Authority of the Fire Department, and shall be responsible for the overall performance of the Fire Department.
§29-4. Fire Chief
There shall be one (1) Fire Chief in the Fire Department. The Fire Chief shall be the highest ranking fire fighter uniformed officer in the Fire Department and shall be directly responsible to and report to the Appropriate Authority. The Fire Chief is responsible for the day-to-day operations of the Fire Department, and shall exercise general authority and control over all Fire Department personnel, apparatus, equipment and the Fire Station located at 15 N. Haddon Avenue, Haddonfield, New Jersey. The Fire Chief shall be in command of all fires and other related emergencies. In the absence of the Fire Chief at a fire or emergency the next highest Fire Department uniformed fire fighter in accordance with the Fire Department’s “Chain of Command” shall be in command at such fire or emergency.
§29-5. Appointment of Acting Fire Chief
In the event the Fire Chief is unable to perform his/her duties and obligations for any reason, then in such event the Director of Public Safety as Appropriate Authority may designate an Acting Fire Chief. The Acting Fire Chief must be appointed from that group of individuals who hold the next ranked uniform officer title. The Acting Fire Chief may serve in such title during that period of time that the Fire Chief is unable to perform his/her duties and obligations, or until a new permanent Fire Chief is appointed.
§29-6. Other Uniform Officers
The Fire Department in it discretion may create one or more of the following fire fighter uniformed officers, as the need requires, and the chain of command and authority is as follows in descending order.
A. Assistant Fire Chief
B. Captains
C. Lieutenants
§29-7. Qualifications
No person shall hereafter become a member of the Haddon Fire Company No. 1 or any unit thereof unless he is above the age of 18; a citizen of the United States, nor unless deemed physically fit to perform the duties of a fire fighter as evidenced by a certificate to that effect completed by a licensed physician of the State of New Jersey, after physical examination made to determine such fitness. The further requirements for membership and for office in the Fire Department shall be those set forth in the amended Charter, Constitution, Bylaws, Rules and Regulations of the Company. Final acceptance shall be by resolution of the Board of Commissioners following receipt of a recommendation by the Fire Chief which includes certification that the applicant meets all membership requirements.
§29-8. Badges, Uniforms and Equipment.
After being entered on the roll of the Company, in the manner prescribed by its amended Charter, Constitution and Bylaws, each member shall be given a badge, uniforms and equipment by the Company, which shall only be worn and used when serving as a representative of the Company. The badge and all issues equipment shall be delivered and surrendered to the Chief Officer of the Fire Company, at any time, upon the demand of the Chief Officer or whenever the member shall be under charges or convicted of charges involving moral turpitude or neglect of duty, or whenever the member ceases from any cause to be an active fire fighter.
§29-9. Expectations regarding performance of duty.
Active Fire Fighters shall comply with the minimum participation requirements established by the Fire Department for fire call responses, training and Fire Department activities, in order to maintain active Fire Fighter status. Such activities shall be composed of actual attendance at fire calls, community events, training, and Company meetings. A record of such attendance shall be kept by the Chief of the Fire Company and reported annually to the Board of Commissioners.
§29-10. Employees of the Fire Department.
Upon recommendation of the Director of Public Safety, the Commissioners of the Borough of Haddonfield may employ and assign to the Fire Department employees as the need requires. Such employees include but are not limited to Medical Technicians, administrative assistants, station attendants, clerks, secretaries, dispatchers, etc.
§29-11. Discipline of Volunteer Members.
A Volunteer Member of the Fire Department may be subjected to discipline for negligence, wrongdoing, and for conduct unbecoming such volunteer member. Disciplinary actions against a volunteer member shall be brought and conducted in accordance with the Constitution, By-laws, rules, and regulations of the Fire Department consistent with Federal, State and Local Laws.
§29-12. Mutual Aid and Reciprocity With Other Communities.
The Borough of Haddonfield has agreed to the Mutual Aid Operation Plan established by Haddon Fire Company No. 1 consistent with the recommendations of the Camden County Fire Chiefs and Officers Association, which may be amended from time to time as needed. The Fire Department may terminate or modify their participation in such Mutual Aid Operation Plan at anytime as needed.
§29-13. Fire Chief’s Annual Report.
The Fire Chief shall submit to the governing body of the Borough of Haddonfield an annual report. The annual report shall be in summary form and contain the services rendered, services received, comments, recommendations and such other information regarding Fire Department operations as the Fire Chief deems appropriate. The Fire Chief shall submit such report as soon as practicable after close of operations of the preceding year.
§29-14. Financial Reports
The Fire Chief shall annually submit to the governing body of the Borough of Haddonfield financial documents indentifying the annual receipt and expenditures of funds, balance sheets, etc. as soon as practicable after such documents has been compiled for the Fire Department.
§29-15. Federal, State and Local Laws.
This Chapter shall be implemented and construed consistent with all Federal, State and Local Laws, and any provision herein inconsistent with such Laws shall be deemed void and of no legal effect.
SECTION II:
This Ordinance repeals §29-1, §29-2 and §29-3 of Chapter 29, Entitled “Fire Department,” of the Code of the Borough of Haddonfield, in that those sections have been repeated in this Ordinance. Any other Ordinance provision inconsistent with this Ordinance is hereby repealed.
SECTION III:
In the event a Court of Competent Jurisdiction declares any provision of this Ordinance unconstitutional or otherwise void, the remainder of this Ordinance shall remain in effect.
SECTION IV:
This ordinance shall be in effect upon passage and publication according to law.

AN ORDINANCE AMENDING THE CODE OF THE BOROUGH OF HADDONFIELD, COUNTY OF CAMDEN, STATE OF NEW JERSEY, CHAPTER 63, ENTITLED AFFORDABLE HOUSING, AND CHAPTER 135, ENTITLED LAND DEVELOPMENT, TO ESTABLISH A PATCO OVERLAY ZONE AND AN ENFORCEMENT SECTION
WHEREAS, per the approval by the Coalition on Affordable housing (COAH) of the Borough of Haddonfield’s Third Round Plan; and
THEREFORE, be it ordained by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:
SECTION I:
1. Chapter 63, Section 1 of the Code of the Borough of Haddonfield hereby be amended to include the following new definition:
PATCO SITE – Area located at or near the train station inclusive of Block 118, Lot 4; Block 36, Lots 1.01 and 1402; Block 134, Lot 9.
2. Chapter 63, Section 3 of the Code of the Borough of Haddonfield hereby be amended to include the following new items:
§63-3. Number of Affordable Units Required.
D. As part of any redevelopment of the PATCO Site, a minimum of 50% of the square footage to be constructed at the site shall be for residential use. Such required residential development shall provide a 25% affordable housing set-aside of the total number of residential units on the site. Parking garage square footage shall not be included in the total square footage.
3. Chapter 63 of the Code of the Borough of Haddonfield hereby be amended to include the following new Article:
ARTICLE VI, Enforcement of Affordable housing Regulations
§63-32. Enforcement of Affordable Housing Regulations
A. Upon the occurrence of a breach of any of the regulations governing the affordable unit by an Owner, Developer or Tenant the municipality shall have all remedies provided at law or equity, including but not limited to foreclosure, tenant eviction, municipal fines, a requirement for household recertification, acceleration of all sums due under a mortgage, recoupment of any funds from a sale in the violation of the regulations, injunctive relief to prevent further violation of the regulations, entry on the premises, and specific performance.
B. After providing written notice of a violation to an Owner, Developer or Tenant of a low- or moderate-income unit and advising the Owner, Developer or Tenant of the penalties for such violations, the municipality may take the following action against the Owner, Developer or Tenant for any violation that remains uncured for a period of 60 days after service of the written notice:
(1) The municipality may file a court action pursuant to N.J.S.A. 2A:58-11 alleging a violation, or violations, of the regulations governing the affordable housing unit. If the Owner, Developer or Tenant is found by the court to have violated any provision of the regulations governing affordable housing units the Owner, Developer or Tenant shall be subject to one or more of the following penalties, at the discretion of the court:
(a) A fine of not more than $500.00 or imprisonment for a period not to exceed 90 days, or both. Each and every day that the violation continues or exists shall be considered a separate and specific violation of these provisions and not as a continuing offense;
(b) In the case of an Owner who has rented his or her low- or moderate-income unit in violation of the regulations governing affordable housing units, payment into the Borough of Haddonfield Affordable Housing Trust Fund of the gross amount of rent illegally collected;
(c) In the case of an Owner who has rented his or her low- or moderate-income unit in violation of the regulations governing affordable housing units, payment of an innocent tenant's reasonable relocation costs, as determined by the court.
(2) The municipality may file a court action in the Superior Court seeking a judgment, which would result in the termination of the Owner's equity or other interest in the unit, in the nature of a mortgage foreclosure. Any judgment shall be enforceable as if the same were a judgment of default of the First Purchase Money Mortgage and shall constitute a lien against the low- and moderate-income unit.
C. Such judgment shall be enforceable, at the option of the municipality, by means of an execution sale by the Sheriff, at which time the low- and moderate-income unit of the violating Owner shall be sold at a sale price which is not less than the amount necessary to fully satisfy and pay off any First Purchase Money Mortgage and prior liens and the costs of the enforcement proceedings incurred by the municipality, including attorney's fees. The violating Owner shall have the right to possession terminated as well as the title conveyed pursuant to the Sheriff's sale.
D. The proceeds of the Sheriff's sale shall first be applied to satisfy the First Purchase Money Mortgage lien and any prior liens upon the low- and moderate-income unit. The excess, if any, shall be applied to reimburse the municipality for any and all costs and expenses incurred in connection with either the court action resulting in the judgment of violation or the Sheriff's sale. In the event that the proceeds from the Sheriff's sale are insufficient to reimburse the municipality in full as aforesaid, the violating Owner shall be personally responsible for and to the extent of such deficiency, in addition to any and all costs incurred by the municipality in connection with collecting such deficiency. In the event that a surplus remains after satisfying all of the above, such surplus, if any, shall be placed in escrow by the municipality for the Owner and shall be held in such escrow for a maximum period of two years or until such earlier time as the Owner shall make a claim with the municipality for such. Failure of the Owner to claim such balance within the two-year period shall automatically result in a forfeiture of such balance to the municipality. Any interest accrued or earned on such balance while being held in escrow shall belong to and shall be paid to the municipality, whether such balance shall be paid to the Owner or forfeited to the municipality.
E. Foreclosure by the municipality due to violation of the regulations governing affordable housing units shall not extinguish the restrictions of the regulations governing affordable housing units as the same apply to the low- and moderate-income unit. Title shall be conveyed to the purchaser at the Sheriff's sale, subject to the restrictions and provisions of the regulations governing the affordable housing unit. The Owner determined to be in violation of the provisions of this plan and from whom title and possession were taken by means of the Sheriff's sale shall not be entitled to any right of redemption.
F. If there are no bidders at the Sheriff's sale, or if insufficient amounts are bid to satisfy the First Purchase Money Mortgage and any prior liens, the municipality may acquire title to the low- and moderate-income unit by satisfying the First Purchase Money Mortgage and any prior liens and crediting the violating owner with an amount equal to the difference between the First Purchase Money Mortgage and any prior liens and costs of the enforcement proceedings, including legal fees and the maximum resale price for which the low- and moderate-income unit could have been sold under the terms of the regulations governing affordable housing units. This excess shall be treated in the same manner as the excess which would have been realized from an actual sale as previously described.
G. Failure of the low- and moderate-income unit to be either sold at the Sheriff's sale or acquired by the municipality shall obligate the Owner to accept an offer to purchase from any qualified purchaser which may be referred to the Owner by the municipality, with such offer to purchase being equal to the maximum resale price of the low- and moderate-income unit as permitted by the regulations governing affordable housing units.
H. The Owner shall remain fully obligated, responsible and liable for complying with the terms and restrictions of governing affordable housing units until such time as title is conveyed from the Owner.
4. Chapter 135, Section 33 of the Code of the Borough of Haddonfield hereby be amended to include the following new items:
§135-33(A) Permitted principal uses:
(4) On PATCO Site as defined in Chapter 63, Section 3 a minimum of 50% of total floor area shall be residential.
§135-38(D)(3)(b)[1][a] Function.

Authorization to Award Banking Services – Susquehanna Bank
WHEREAS, the Board of Commissioners of the Borough of Haddonfield caused a notice to be published in The Retrospect inviting the submission to the Borough Clerk at the Borough Hall on Thursday, April 22, 2010 at 3:00 p.m. of proposals for Banking Services for the Borough’s banking and investment needs for a period of three years; and
WHEREAS, the proposals that were received are available for review in the Administration office; and
WHEREAS, after careful analysis of all the proposals received it was determined to award the banking services to Susquehanna Bank.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey that:
1. Susquehanna Bank will provide banking and investment services to the Borough of Haddonfield for a period of three years; and
2. The proper officer or officers of the Borough of Haddonfield be, and they are authorized directed for and in the name of said Borough to sign appropriate documentation with Susquehanna Bank for the necessary accounts to be opened in the name of the Borough of Haddonfield.
3. The Cash Management Plan is to be amended to reflect the appropriate changes.

Authorization to Grant Permission to Rotary to Hold Summer Concerts
WHEREAS, the Board of Commissioners of the Borough of Haddonfield deems it in the best interest of its citizens to encourage organized events and festivals for the benefit of the community; and
WHEREAS, the Rotary Club of Haddonfield has been appointed to promote a Summer Concert Series on Fridays in July between the hours of 6:00 p.m. and 9:00 p.m. on Kings Highway at Kings Court in the commercial district of the Borough of Haddonfield.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:
1. Permission is hereby granted to the Rotary Club of Haddonfield to utilize Kings Court and Kings Highway in front of Kings Court in the Borough of Haddonfield on June 25, July 2, 9, 16, 23 and 30, 2010 for the “Rotary Club Summer Concert Series.”
2. The closing of Kings Highway from Haddon Avenue to Tanner Street is authorized from 6:00 p.m. through 9:00 p.m. on the above dates.
3. No entity, store or vendor is permitted to sell or display their wares outside in the commercial district during this time except those with specific permits to do so.

Authorization to Hold Fireworks Display
WHEREAS, an application has been made by the Haddonfield Celebrations Association for a permit to allow the vendor under contract to provide a public display of fireworks as part of the Borough’s Annual Independence Day Celebration; and
WHEREAS, per State Statute, the Borough’s Chiefs of the Police and Fire Departments must approve said application and the required surety must be provided by the fireworks operator.
NOW, THEREFORE BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that upon the approval of the Borough’s Chiefs of the Police and Fire Departments, a permit shall be granted to said Haddonfield Celebrations Association for the public display of fireworks by the said Association in the High School Stadium, in the said Borough on Sunday, July 4, 2010 (rain date Monday, July 5, 2010) between the hours of 9:00 p.m. and 11:00 p.m., Eastern Daylight Savings Time, subject to and in accordance with the statutes of the State of New Jersey.
BE IT FURTHER RESOLVED that a copy of said application and permit be forwarded by the Clerk of said Borough to the Camden County Fire Marshall Office in Blackwood, New Jersey, as foresaid.

Authorization to Hold Haddonfield Crafts and Fine Arts Festival
WHEREAS, the Board of Commissioners of the Borough of Haddonfield deems it in the best interest of its citizens to encourage organized events and festivals for the benefit of the community; and
WHEREAS, the Partnership for Haddonfield (PfH) wishes to sponsor a “Haddonfield Craft and Fine Arts Festival” on Saturday, July 10, 2010 from 11:00 a.m. to 8:00 p.m., and Sunday, July 11, 2010 from 12:00 noon to 5:00 p.m.; and
WHEREAS, PfH has provided the Borough of Haddonfield with the appropriate insurance liability coverage of at least $1,000,000.00 naming the Borough of Haddonfield as an additional insured;
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:
1. The closing of Kings Highway from Haddon Avenue to PATCO and portions of Tanner Street, Mechanic Street and Chestnut Street is hereby authorized from 6:00 a.m. on July 10, 2010 through 8:00 p.m. on July 11, 2010 for the “Haddonfield Craft and Fine Arts Festival.”
2. Permission is hereby granted to vendors designated by the PfH Events Committee to utilize specific locations on Kings Highway, Tanner Street, Kings Court, Mechanic Street and Chestnut Street, as well as, sidewalks and other public property as designated by the PfH Events Committee, within the commercial district in the Borough of Haddonfield to display goods, wares and food, etc. for sale as part of the “Haddonfield Craft and Fine Arts Festival.”
3. The various food purveyors in the commercial district are hereby given permission to display and sell food on the sidewalks in front of their stores or shops and food purveyors in Haddonfield whose shops or stores are not on Kings Highway in the Commercial District may sell food as determined by the PfH Events Committee, at locations designated by the Committee.
4. Food vendors without building locations within Haddonfield must receive approval by the PfH Marketing Committee to display and sell goods, wares and food.
5. Food vendors without building locations in Haddonfield who choose to set-up on the evening of Friday, July 9, 2010 must provide continuous security at their expense from the time of the drop off of their equipment until 6:00 a.m. on Saturday, July 10, 2010 when Kings Highway closes to vehicle traffic.
6. All food purveyors referenced above must either obtain a Temporary Event Permit from Camden County or an Outdoor Eating Facility Permit from the Borough as appropriate. All restaurants who cook outside, as well as any entity using an open flame must have a permit from the Department of Public Safety County Fire Marshall’s Office.
7. Only those Haddonfield merchants with a Merchandise Display Permit from the Borough of Haddonfield may have any merchandise on any Borough sidewalks.
8. Stationary outdoor entertainment is hereby permitted along public sidewalks and places within the business district as designated by the PfH Committee on Saturday, July 10, 2010 from 11:00 a.m. to 8:00 p.m. and Sunday, July 11, 2010 from 12:00 p.m. to 5:00 p.m.
9. As assortment of signage is hereby permitted along public sidewalks and places within the business district at locations determined by the PfH Committee.
10. Crafters, Food Purveyors, Umbrellas, tables and chairs are hereby permitted in Kings Court at locations designated by the PfH Committee.
11. Port o’ Potties are authorized to be on Lantern Lane Lot and Mechanic Street Lot.

WHEREAS, the Partnership for Haddonfield (PfH) will conduct its annual Sidewalk Sale Days on August 5, 6, 7, 2010 within the commercial district of the Borough of Haddonfield;
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that permission is granted only for the following items:
1. Permission is not granted to various food purveyors in the Commercial District to display and sell food on the sidewalks in front of their stores or shops and for food purveyors in Haddonfield whose shops or stores are not on Kings Highway in the Commercial District to sell food as determined by the PfH events Committee.

WHEREAS, the Borough of Haddonfield wishes to support a model of government which benefits our residents now and far into the future by exploring and adopting sustainable, economically-sound, local government practices; and
WHEREAS, by endorsing a sustainable path the Borough of Haddonfield is pledging to education itself and community members further about sustainable activities and to develop initiatives supporting sustainable local government practices; and
WHEREAS, as elected representatives of the Borough of Haddonfield, the Board of Commissioners have a significant responsibility to provide leadership which will seek community-based sustainable solutions to strengthen our community.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey that to focus attention and effort within the municipality on matters of sustainability, the Board of Commissioners wishes to pursue local initiatives and actions that will lead to Sustainable Jersey Municipal Certification.
BE IT FURTHER RESOLVED, by the Board of Commissioners of the Borough of Haddonfield that the Borough Administrator to serve as the Borough of Haddonfield’s agent for the Sustainable Jersey municipal Certification process and authorize her to complete the Municipal Registration on the behalf of the Borough of Haddonfield.

Authorization to Accept and Advertise Audit Report
WHEREAS, N.J.S.A. 40A:5-4 requires the governing body of every local unit to have made an annual audit of its books, accounts and financial transactions; and
WHEREAS, the Annual Report of Audit for the year 2009 has been filed by a Registered Municipal Accountant with the Haddonfield Borough Clerk as per the requirements of N.J.S.A. 40A:5-6, and a copy has been received by each member of the governing body; and
WHEREAS, R.S. 52:27BB-34 authorizes the Local Finance Board of the State of New Jersey to prescribe reports pertaining to the local fiscal affairs; and
WHEREAS, the Local Finance Board has promulgated N.J.A.C. 5:30-6.5, a regulation requiring that the governing body of each municipality shall by resolution, certify to the Local Finance Board of the State of New Jersey that all members of the governing body have reviewed, as a minimum, the sections of the annual audit entitled “Findings and Questioned Costs” or “Findings and Recommendations”; and
WHEREAS, the members of the governing body have personally reviewed as a minimum the Annual Report of Audit, and specifically the sections of the Annual Audit entitled “Findings and Questioned Costs” or “Findings and Recommendations” as evidenced by the group affidavit form of the governing body; and
WHEREAS, such resolution of certification shall be adopted by the governing body no later than forty-five days after the receipt of the annual audit, as per the regulations of the Local Finance Board; and
WHEREAS, all members of the governing body have received and have familiarized themselves with, at least, the minimum requirements of the Local Finance Board of the State of New Jersey, as stated aforesaid and have subscribed to the affidavit, as provided by the Local Finance Board; and
WHEREAS, failure to comply with the promulgations of the Local Finance Board of the State of New Jersey may subject the members of the governing body to the penalty provisions of R.S. 52:27BB-52 – to wit:
R.S. 52:27BB-52 – “A local officer or member of a local governing body who, after a date fixed for compliance, fails or refuses to obey an order of the director (Director of Local Government Services), under the provisions of this Article, shall be guilty of a misdemeanor and, upon conviction, may be fined no more than one thousand dollars ($1,000.00) or imprisoned for not more than one year, or both, in addition shall forfeit his office.”
NOW, THEREFORE BE IT RESOLVED, that the governing body of the Borough of Haddonfield, County of Camden, State of New Jersey, hereby states that it has complied with the promulgation of the Local Finance Board of the State of New Jersey dated July 30, 1968 and does hereby submit a certified copy of this resolution and the required affidavit to said Board to show evidence of said compliance.

Authorization to Accept Filing of Audit Corrective Action Plan
WHEREAS, on June 8, 2010 the Board of Commissioners of the Borough of Haddonfield accepted the 2009 Audit Report; and
WHEREAS, a Corrective Action Plan was not required; and
WHEREAS, the Chief Financial Officer has submitted a Corrective Action Plan stating that there are no actions required is on file.
NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, does acknowledge the receipt of the Corrective Action Plan.
BE IT FURTHER RESOLVED, that the Borough Clerk forward a copy of the Corrective Action Plan to the Director of Local Government Services, 101 South Broad, CN 803,
Trenton, NJ 08625-0803.
