AN ORDINANCE AMENDING THE CODE OF THE BOROUGH OF HADDONFIELD, COUNTY OF CAMDEN, STATE OF NEW JERSEY, CHAPTER 29 ENTITLED FIRE DEPARTMENT
BE IT ORDAINED BY the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:
SECTION I:
The code of the Borough of Haddonfield, County of Camden, State of New Jersey, Chapter 29 entitled “Fire Department” is hereby amended as follows:
§29-1. Haddon Fire Company No. 1
This Chapter ratifies the creation of the Fire Department of the Borough of Haddonfield which is to be referred to as Haddon Fire Company No. 1, which has and shall provide to the citizens of the Haddonfield Borough an efficient and timely emergency response to fire and other hazardous situations with the purpose of preservation of life, property and the environment. Haddon Fire Company No. 1 is herein referred to as the “Fire Department.”
§29-2. Mission Statement
The mission of Haddon Fire Company No. 1 is to:
A. Provide an efficient and timely response to fire(s) and other hazardous situations.
B. Provide public education and awareness about fire safety and related hazards.
C. Provide emergency and non-emergency support services to our community and other public safety agencies.
D. Provide their members with continuous training and education.
E. Provide a safe and healthy environment for their members.
Haddon Fire Company No. 1 takes great pride in its history and anticipates a progressive future while constantly striving to improve the quality of services provided.
§29-3. Appropriate Authority
The Director of Public Safety of the Borough of Haddonfield is designated as the Appropriate Authority of the Fire Department, and shall be responsible for the overall performance of the Fire Department.
§29-4. Fire Chief
There shall be one (1) Fire Chief in the Fire Department. The Fire Chief shall be the highest ranking fire fighter uniformed officer in the Fire Department and shall be directly responsible to and report to the Appropriate Authority. The Fire Chief is responsible for the day-to-day operations of the Fire Department, and shall exercise general authority and control over all Fire Department personnel, apparatus, equipment and the Fire Station located at 15 N. Haddon Avenue, Haddonfield, New Jersey. The Fire Chief shall be in command of all fires and other related emergencies. In the absence of the Fire Chief at a fire or emergency the next highest Fire Department uniformed fire fighter in accordance with the Fire Department’s “Chain of Command” shall be in command at such fire or emergency.
§29-5. Appointment of Acting Fire Chief
In the event the Fire Chief is unable to perform his/her duties and obligations for any reason, then in such event the Director of Public Safety as Appropriate Authority may designate an Acting Fire Chief. The Acting Fire Chief must be appointed from that group of individuals who hold the next ranked uniform officer title. The Acting Fire Chief may serve in such title during that period of time that the Fire Chief is unable to perform his/her duties and obligations, or until a new permanent Fire Chief is appointed.
§29-6. Other Uniform Officers
The Fire Department in it discretion may create one or more of the following fire fighter uniformed officers, as the need requires, and the chain of command and authority is as follows in descending order.
A. Assistant Fire Chief
B. Captains
C. Lieutenants
§29-7. Qualifications
No person shall hereafter become a member of the Haddon Fire Company No. 1 or any unit thereof unless he is above the age of 18; a citizen of the United States, nor unless deemed physically fit to perform the duties of a fire fighter as evidenced by a certificate to that effect completed by a licensed physician of the State of New Jersey, after physical examination made to determine such fitness. The further requirements for membership and for office in the Fire Department shall be those set forth in the amended Charter, Constitution, Bylaws, Rules and Regulations of the Company. Final acceptance shall be by resolution of the Board of Commissioners following receipt of a recommendation by the Fire Chief which includes certification that the applicant meets all membership requirements.
§29-8. Badges, Uniforms and Equipment.
After being entered on the roll of the Company, in the manner prescribed by its amended Charter, Constitution and Bylaws, each member shall be given a badge, uniforms and equipment by the Company, which shall only be worn and used when serving as a representative of the Company. The badge and all issues equipment shall be delivered and surrendered to the Chief Officer of the Fire Company, at any time, upon the demand of the Chief Officer or whenever the member shall be under charges or convicted of charges involving moral turpitude or neglect of duty, or whenever the member ceases from any cause to be an active fire fighter.
§29-9. Expectations regarding performance of duty.
Active Fire Fighters shall comply with the minimum participation requirements established by the Fire Department for fire call responses, training and Fire Department activities, in order to maintain active Fire Fighter status. Such activities shall be composed of actual attendance at fire calls, community events, training, and Company meetings. A record of such attendance shall be kept by the Chief of the Fire Company and reported annually to the Board of Commissioners.
§29-10. Employees of the Fire Department.
Upon recommendation of the Director of Public Safety, the Commissioners of the Borough of Haddonfield may employ and assign to the Fire Department employees as the need requires. Such employees include but are not limited to Medical Technicians, administrative assistants, station attendants, clerks, secretaries, dispatchers, etc.
§29-11. Discipline of Volunteer Members.
A Volunteer Member of the Fire Department may be subjected to discipline for negligence, wrongdoing, and for conduct unbecoming such volunteer member. Disciplinary actions against a volunteer member shall be brought and conducted in accordance with the Constitution, By-laws, rules, and regulations of the Fire Department consistent with Federal, State and Local Laws.
§29-12. Mutual Aid and Reciprocity With Other Communities.
The Borough of Haddonfield has agreed to the Mutual Aid Operation Plan established by Haddon Fire Company No. 1 consistent with the recommendations of the Camden County Fire Chiefs and Officers Association, which may be amended from time to time as needed. The Fire Department may terminate or modify their participation in such Mutual Aid Operation Plan at anytime as needed.
§29-13. Fire Chief’s Annual Report.
The Fire Chief shall submit to the governing body of the Borough of Haddonfield an annual report. The annual report shall be in summary form and contain the services rendered, services received, comments, recommendations and such other information regarding Fire Department operations as the Fire Chief deems appropriate. The Fire Chief shall submit such report as soon as practicable after close of operations of the preceding year.
§29-14. Financial Reports
Not later than April 1, 2010 each year the Fire Chief shall submit to the governing body of the Borough of Haddonfield financial statements in acceptable form, reviewed by a Certified Public Accountant, identifying the funds received and expenditures made, as well as the balance sheet, for and during the preceding calendar year, for Haddon Fire Company No. 1.
§29-15. Federal, State and Local Laws.
This Chapter shall be implemented and construed consistent with all Federal, State and Local Laws, and any provision herein inconsistent with such Laws shall be deemed void and of no legal effect.
SECTION II:
This Ordinance repeals §29-1, §29-2 and §29-3 of Chapter 29, Entitled “Fire Department,” of the Code of the Borough of Haddonfield, in that those sections have been repeated in this Ordinance. Any other Ordinance provision inconsistent with this Ordinance is hereby repealed.
SECTION III:
In the event a Court of Competent Jurisdiction declares any provision of this Ordinance unconstitutional or otherwise void, the remainder of this Ordinance shall remain in effect.
SECTION IV:
This ordinance shall be in effect upon passage and publication according to law.

AN ORDINANCE ESTABLISHING THE SCHEDULE OF SALARIES AND WAGES FOR CERTAIN EMPLOYEES TO BE PAID BY THE BOROUGH OF HADDONFIELD, COMMENCING ON THE FIRST PAY OF JULY 2010
The Board of Commissioners of the Borough of Haddonfield, County of Camden and State of New Jersey, do ordain, as follows:
SECTION I
The following base pay rates or minimum and maximum pay ranges are effective for the first pay date in July 2010, unless another effective date is specified, for the listed positions. All positions are 5 Steps unless otherwise noted.

AN ORDINANCE TO PRESERVE A CAP BANK
WHEREAS, the Local Government Cap Law, N.J.S.A. 40A:4-45.1 et seq., provides that in the preparation of its annual budget, a municipality shall limit any increase in said budget to 2.5% unless authorized by ordinance to increase it to 3.5% over the previous year’s final appropriations, subject to certain exceptions; and
WHEREAS, N.J.S.A. 40A:4-45.15a provides that a municipality may, when authorized by ordinance, appropriate the difference between the amount of its actual final appropriation and the 3.5% percentage rate as an exception to its final appropriations in either of the next two succeeding years; and
WHEREAS, the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, finds it advisable and necessary to increase its CY 2010 budget by up to 3.5% over the previous year’s final appropriations, in the interest of promoting the health, safety and welfare of the citizens; and
WHEREAS, the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, hereby determines that a 3.5% increase in the budget for said year, amounting to $346,796 in excess of the increase in final appropriations otherwise permitted by the Local Government Cap Law, is advisable and necessary; and
WHEREAS, the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, hereby determines that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years.
NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, a majority of the full authorized membership of this governing body affirmatively concurring, that, in the CY 2010 budget year, the final appropriations of the Borough of Haddonfield shall, in accordance with this ordinance and N.J.S.A. 40A:4-45.14, be increased to 3.5%, amounting to $346,796, and that the CY 2010 municipal budget for the Borough of Haddonfield be approved and adopted in accordance with this ordinance; and
BE IT FURTHER ORDAINED, that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years; and
BE IT FURTHER ORDAINED, that a certified copy of this ordinance as introduced be filed with the Director of the Division of Local Government Services within 5 days of introduction; and
BE IT FURTHER ORDAINED, that a certified copy of the ordinance upon adoption, with the recorded vote included thereon, be filed with said Director within 5 days after such adoption.
SECTION I:
All ordinances or parts of ordinances inconsistent with this amending ordinance be and they are hereby repealed to the extent of such inconsistencies only.
SECTION II:
If any section or provision of this ordinance shall be held unconstitutional or invalid by any court, the remaining sections and provisions shall, notwithstanding such holding, remain and be in full force and effect.

BOND ORDINANCE PROVIDING FOR VARIOUS CAPITAL IMPROVEMENTS IN AND BY THE BOROUGH OF HADDONFIELD, IN THE COUNTY OF CAMDEN, NEW JERSEY, APPROPRIATING THE AGGREGATE AMOUNT OF $1,985,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $1,885,750 BONDS OR NOTES OF THE BOROUGH TO FINANCE PART OF THE COST THEREOF
BE IT ORDAINED BY THE BOROUGH BOARD OF COMMISSIONERS OF THE BOROUGH OF HADDONFIELD, IN THE COUNTY OF CAMDEN, NEW JERSEY (not less than two-thirds of all members thereof affirmatively concurring) AS FOLLOWS:
SECTION I
The several improvements described in Section III of this bond ordinance are hereby respectively authorized to be undertaken by the Borough of Haddonfield, in the County of Camden, New Jersey (the “Borough”) as general improvements. For the several improvements or purposes described in Section III, there are hereby appropriated the respective sums of money therein stated as the appropriation made for each improvement or purpose, such sums amounting in the aggregate to $1,985,000, including the aggregate sum of $99,250 as the several down payments for the improvements or purposes required by the Local Bond Law. The down payments have been made available by virtue of provision for down payment or for capital improvement purposes in one or more previously adopted budgets.
SECTION II
In order to finance the cost of the several improvements or purposes not covered by application of the several down payments, negotiable bonds are hereby authorized to be issued in the principal amount of $1,885,750 pursuant to the Local Bond Law. In anticipation of the issuance of the bonds, negotiable bond anticipation notes are hereby authorized to be issued pursuant to and within the limitations prescribed by the Local Bond Law.
SECTION III
The several improvements hereby authorized and the several purposes for which the bonds are to be issued, the estimated cost of each improvement and the appropriation therefor, the estimated maximum amount of bonds or notes to be issued for each improvement and the period of usefulness of each improvement are as follows:

The excess of the appropriation made for each of the improvements or purposes aforesaid over the estimated maximum amount of bonds or notes to be issued therefor, as above stated, is the amount of the down payment for each purpose.
SECTION IV
All bond anticipation notes issued hereunder shall mature at such times as may be determined by the chief financial officer; provided that no note shall mature later than one year from its date. The notes shall bear interest at such rate or rates and be in such form as may be determined by the chief financial officer. The chief financial officer shall determine all matters in connection with notes issued pursuant to this ordinance, and the chief financial officer's signature upon the notes shall be conclusive evidence as to all such determinations. All notes issued hereunder may be renewed from time to time subject to the provisions of the Local Bond Law. The chief financial officer is hereby authorized to sell part or all of the notes from time to time at public or private sale and to deliver them to the purchasers thereof upon receipt of payment of the purchase price plus accrued interest from their dates to the date of delivery thereof. The chief financial officer is directed to report in writing to the governing body at the meeting next succeeding the date when any sale or delivery of the notes pursuant to this ordinance is made. Such report must include the amount, the description, the interest rate and the maturity schedule of the notes sold, the price obtained and the name of the purchaser.
SECTION V
The Borough hereby certifies that it has adopted a capital budget or a temporary capital budget, as applicable. The capital or temporary capital budget of the Borough is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency herewith. To the extent that the purposes authorized herein are inconsistent with the adopted capital or temporary capital budget, a revised capital or temporary capital budget has been filed with the Division of Local Government Services.
SECTION VI
The following additional matters are hereby determined, declared, recited and stated:
(a) The purposes described in Section III of this bond ordinance are not current expenses. They are all improvements that the Borough may lawfully undertake as general improvements, and no part of the costs thereof has been or shall be specially assessed on property specially benefitted thereby.
(b) The average period of usefulness, computed on the basis of the respective amounts of obligations authorized for each purpose and the reasonable life thereof within the limitations of the Local Bond Law, is 12.45 years.
(c) The Supplemental Debt Statement required by the Local Bond Law has been duly prepared and filed in the office of the Clerk, and a complete executed duplicate thereof has been filed in the office of the Director of the Division of Local Government Services in the Department of Community Affairs of the State of New Jersey. Such statement shows that the gross debt of the Borough as defined in the Local Bond Law is increased by the authorization of the bonds and notes provided in this bond ordinance by $1,885,750, and the obligations authorized herein will be within all debt limitations prescribed by that Law.
(d) An aggregate amount not exceeding $198,500 for items of expense listed in and permitted under N.J.S.A. 40A:2-20 is included in the estimated costs indicated herein for the purposes or improvements.
SECTION VII
Any grant moneys received for the purposes described in Section III hereof shall be applied either to direct payment of the cost of the improvements or to payment of the obligations issued pursuant to this ordinance. The amount of obligations authorized but not issued hereunder shall be reduced to the extent that such funds are so used.
SECTION VIII
The Township hereby declares the intent of the Township to issue the bonds or bond anticipation notes in the amount authorized in Section II of this bond ordinance and to use proceeds to pay or reimburse expenditures for the costs of the purposes described in Section III(a) of this bond ordinance. This Section VIII is a declaration of intent within the meaning and for purposes of Treasury Regulations §1.150-2 or any successor provisions of federal income tax law.
SECTION VIIII
The chief financial officer of the Borough is hereby authorized to prepare and to update from time to time as necessary a financial disclosure document to be distributed in connection with the sale of obligations of the Borough and to execute such disclosure document on behalf of the Borough. The chief financial officer is further authorized to enter into the appropriate undertaking to provide secondary market disclosure on behalf of the pursuant to Rule 15c2-12 of the Securities and Exchange Commission (the “Rule”) for the benefit of holders and beneficial owners of obligations of the Borough and to amend such undertaking from time to time in connection with any change in law, or interpretation thereof, provided such undertaking is and continues to be, in the opinion of a nationally recognized bond counsel, consistent with the requirements of the Rule. In the event that the Borough fails to comply with its undertaking, the Borough shall not be liable for any monetary damages, and the remedy shall be limited to specific performance of the undertaking.
SECTION X
The full faith and credit of the Borough are hereby pledged to the punctual payment of the principal of and the interest on the obligations authorized by this bond ordinance. The obligations shall be direct, unlimited obligations of the Borough, and the Borough shall be obligated to levy ad valorem taxes upon all the taxable real property within the for the payment of the obligations and the interest thereon without limitation of rate or amount.
SECTION XI
This bond ordinance shall take effect 20 days after the first publication thereof after final adoption, as provided by the Local Bond Law.

WHEREAS, the local municipal budget for the year 2010 was approved on the 29th day
of June, 2010; and
WHEREAS, the public hearing on said budget has been held as advertised; and
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that the 2010 Borough Budget is hereby adopted and shall constitute an appropriation for the purposes stated therein of the sums therein set for as appropriations, and authorization of the amount of $9,602,014 for municipal purposes and $113,211 for Open Space Trust Fund Levy.

Authority to Provide Tax Grace Period
WHEREAS, mailing of the third quarter property tax bills has been delayed due to the delay in the adoption of the 2010 Borough Budget; and
WHEREAS, the Board of Commissioners of the Borough of Haddonfield wishes to allow the property owners of the Borough a sufficient period of time to pay their third quarter property tax bills.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:
1. That the grace period for payment of the third quarter property tax bills shall be ten (10) days from August 1 to August 10, 2010, or the twenty-fifth calendar date after the third quarter installment was mailed pursuant to N.J.S.A. 54:4-64.
2. The tax bill shall contain a notice specifying the date on which interest may begin to accrue.
3. WHEREAS, the Borough of Haddonfield has received proposals in response to a Competitive Contracting Request for Proposal for Municipal & Consulting Engineer Services; and

Authorization to Set Tax Rate for Open Space Tax Fund
WHEREAS, the Borough of Haddonfield, County of Camden, State of New Jersey as established by Ordinance the Open Space Trust Fund in accordance with P.L. 1997, c.24 (N.J.S.A. 40:12-15 et seq.); and
WHEREAS, the Board of Commissioners must set the tax rate of no more than two cents per one hundred dollars of assessed value to be raised for the 2010 tax year per the enabling ordinance (Code Chapter 150) and be designated solely for the Open Space Trust Fund account; and
WHEREAS, pursuant to N.J.S.A. 40A:4-39 a “Dedicated Rider” account must be established and that such property taxes that are collected must be placed is said account.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:
1. That the open space property tax rate be set at one-half of one cent per one hundred dollars of assessed value for the 2010 tax year.
2. Such property taxes are to be place in a trust account considered a “Dedicated by Rider” to the budget of the Borough of Haddonfield per N.J.S.A. 40A:4-39 for the sole purpose stated above.
BE IT FURTHER RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that the municipal clerk of the Borough of Haddonfield is hereby directed to forward two certified copies of this resolution to the Director of the Division of Local Government Services and to the Camden County Board of Taxation.

Authorization to Sign Grant Agreement – Sharing Available Resources Efficiently (SHARE) Program
WHEREAS, the Governing Body of the Borough of Haddonfield received notice from the SHARE Program of its eligibility to receive a SHARE Grant in the amount of $24,408.00; and
WHEREAS, the purpose of the award is to conduct a feasibility study of shared municipal court services between Haddonfield, Haddon Heights and Audubon; and
NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, does hereby accept the award of $24,408.00, to conduct a feasibility study of shared municipal court services between Haddonfield, Haddon Heights and Audubon.
BE IT FURTHER RESOLVED, the Mayor of the Borough of Haddonfield be and hereby is authorized to execute a Grant Agreement with the New jersey Department of Community Affairs on behalf of the Borough of Haddonfield and all other local units that are party to the SHARE Grant Agreement, and upon execution of said Agreement, the Borough of Haddonfield does accept the Terms and Conditions specified in the Agreement in connection to this grant award.

Authorization to Amend Resolution 2010-05-25-100 Entitled Water Use Restrictions
WHEREAS, pursuant to Chapter 226, Article X of the Borough Code of Ordinances, on May 25, 2010 the Board of Commissioners approved Resolution 2010-05-25-100 allowing for both a LEVEL I and LEVEL II prohibition of outdoor use of potable water from the Haddonfield water system; and
WHEREAS, it has been determined that a LEVEL III needs to be incorporated into this Resolution authorizing the Director of Public Works to prohibit the use of potable water from the Haddonfield water system for any outdoor watering due to conditions affecting the health and safety of the public.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:
1. It has been determined that conditions affecting the health and safety of the public is further jeopardized by water use, causing the need to implement LEVEL II prohibitions of outdoor watering during the 6:00 p.m. to 6:00 a.m. period on alternate days, such that properties with odd numbered addresses are allowed to water only on odd numbered calendar dates and properties with even numbered addresses are allowed to water only on even numbered dates.
2. A LEVEL III restriction is hereby authorized for potential implementation in the case of conditions affecting health and safety of the public. A LEVEL III restriction constitutes the prohibition of all outdoor watering within the Borough of Haddonfield.

Authorization to Submit Application and Execute Grant Agreement with the NJ Department of Transportation for FY2011 Trust Fund Municipal Aid Program Centre Street Project
WHEREAS, the Board of Commissioners of the Borough of Haddonfield desires to apply to the New Jersey Department of Transportation for a grant under the Trust Fund for 2011; and
WHEREAS, said applications will be for the following categories and items:
1. Reconstruction of Centre Street
NOW, THEREFORE, BE IT RESOLVED, that the Board of Commissioners of the Borough of Haddonfield, County of Camden, formally approves the grant application for the above stated project.
BE IT FURTHER RESOLVED, that the appropriate official and Clerk are hereby authorized to submit an electronic grant application to be entered into the NJDOT SAGE program and submitted to the New Jersey Department of Transportation on behalf of the Borough of Haddonfield.
BE IT FURTHER RESOLVED, that the appropriate official and Clerk are hereby authorized to sign the grant agreement on behalf of the Borough of Haddonfield and that their signature constitutes acceptance of the terms and conditions of the grant agreement and approves the execution of the grant agreement.
