AN ORDINANCE OF THE BOROUGH OF HADDONFIELD, COUNTY OF CAMDEN AND STATE OF NEW JERSEY TO ADOPT BY REFERENCE CHAPTER 232, VEHICLES AND TRAFFIC, OF THE CODE OF THE BOROUGH OF HADDONFIELD
WHEREAS, a comprehensive codification of the Borough’s vehicles and traffic ordinances has been prepared; and
WHEREAS, the ordinances contained in the comprehensive codification had already been duly enacted at various times by the Board of Commissioners; and
WHEREAS, the comprehensive codification has been reviewed by the New Jersey Department of Transportation and preliminary approval has been given; and
WHEREAS, it is now necessary to adopt the Vehicles and Traffic Chapter prior to submission to the Department of Transportation for final approval;
NOW, THEREFORE BE IT ORDAINED, by the Board of Commissioners of the Borough of Haddonfield, in the County of Camden and State of New Jersey:
SECTION I
Pursuant to N.J.S.A. 40:49-4, there is hereby adopted and codified a new Chapter 232, Vehicles and Traffic, of the Code of the Borough of Haddonfield.
SECTION II
A complete copy of the new Chapter 232, Vehicles and Traffic, as adopted and codified by this ordinance has been filed in the office of the Municipal Clerk and shall remain there for the use and examination of the public until final action is taken on this ordinance.
SECTION III
All ordinances and parts of ordinances which are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. Specifically, Ordinance No. 1720, as amended, is hereby repealed; provided, however, that any amendment to Ord. No. 1720 adopted subsequent to June 8, 2004, is hereby expressed saved from repeal and may be included in the new Chapter 232.
SECTION IV
If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional or invalid, such decision shall not affect the remaining portions of this ordinance.
SECTION V
This ordinance shall take effect immediately upon final passage, approval, and publication as required by law and upon approval by the Commissioner of the Department of Transportation.

SECTION II
Regulations for Pay Classification System
(a) Wage rates for all permanent full time employees and certain permanent part time employees as determined by the Borough Administrator, are part of the Pay Classification System. The Borough Administrator shall determine equal increments for each position. Each increment shall be considered a step. The Borough Administrator shall annually review the salary of each salaried employee covered by this plan for the purpose of determining whether said employee shall be entitled to a step increase. The Borough Administrator may advance an employee in that employee's grade until the maximum step has been reached subject to budgetary limitations.
(b) New employees shall be paid the minimum step for his grade except that the Borough Administrator shall have the discretion to determine whether said new employee has qualifications greater than the minimum qualifications for the classification. In the greater qualification situation, the employee may receive a salary in a higher step.
(c) When an employee is promoted to a position in a higher classification, his salary shall be increased to the minimum rate for the higher classification subject to the discretion of the Borough Administrator. In the case of overlapping ranges, the salary of promoted employee shall be increased to the step immediately above his present salary, subject to the discretion of the Borough Administrator. When an employee is demoted to lower classification, he shall be paid at a rate which is within the approved range for the lower classification. The rate of pay shall be determined by the Borough Administrator.
(d) When a Public Works Supervisor is the qualified State required licensed individual designated by the Borough to be responsible for either the Water Treatment, Water distribution System or Sewer Collection System operation, the Administrator may increase the individual's weekly base salary by a maximum of $85.49 per week for each license.
SECTION III
Overtime Pay, Pay Dates and Longevity Pay
Except as stated below, time worked, when approved by the Administrator or his designee, which is in excess of regularly scheduled hours, will be paid at time and one half of the base rate of pay including longevity and education pay (where applicable). Department Supervisors and Office Heads are not eligible for overtime pay except for circumstances as determined by the Administrator. The Administrator may, at his discretion, approve compensatory time off for these management positions guided by the number of previously approved hours worked beyond regularly scheduled hours.
Salaries normally shall be paid on Friday of the week following the work week in which the salary was earned. If requested in writing, salaries may be paid in advance of vacations.
Upon completion of designated years of service, all officials and employees shall receive longevity pay as described below. Percentages used in the formula are only for the purpose of arriving at a dollar figure for individual salaries. The longevity figure which the employee will receive in the current year is the final dollar figure reached by using years of service, individual current year salaries and applicable percentages.

Longevity applies to the current year base salary only and not to educational incentives (where applicable). "Years of Service" means all time served with the Borough including previous periods of employment as long as previous separation was in good standing.
SECTION IV
All Ordinances or parts of Ordinances which are inconsistent with the provisions of this Ordinance, are hereby repealed to the extent of such inconsistency.
SECTION V
If any section or provision of this ordinance shall be held unconstitutional or invalid by any court, the remaining sections and provisions shall, notwithstanding such holding, remain and be in full force and effect.
SECTION VI
This Ordinance shall take effect immediately upon passage and publication as required by law.

Authorization to Read BID Budget By Title Only
WHEREAS, N.J.S.A. 40A:4-8 provides that the BID budget, as advertised, may be read by title only at the time of the public hearing provided that at least one week prior to the hearing a complete copy of the approved budget, as advertised, is posted in a public place where public notices are customarily posted in the municipal building and that the approved budget, as advertised, was made available to each person requesting same, and
WHEREAS, the Borough has complied with those two requirements, posting a copy of the approved budget, as advertised, on the municipal building notice board, and provided copies to each person who requested same.
NOW, THEREFORE BE IT RESOLVED, by the Board of Commissioners of Borough of Haddonfield, County of Camden, State of New Jersey, as follows:
1. The conditions set forth regarding posting and providing copies of the approved BID budget, as advertised, have been met.
2. The 2008 BID budget shall be read by title only.

WHEREAS, as the Borough of Haddonfield and the CCMUA have been charging 629 Centre Street for sewer charges; and
WHEREAS, it has been determined that 629 Centre Street has an operational septic system; and
WHEREAS, it has further been determined by the Municipal Code Inspector that 629 Centre Street is not connected to the Borough of Haddonfield’s sewer system; and
WHEREAS, the CCMUA has discontinued billing and cancelled all fees owed by 629 Centre Street; and
WHEREAS, there are two other properties that have provided proper documentation for billing errors; and

Authorization for Outdoor Eating Facility Permit – Di Vello’s Deli
WHEREAS, the Code of the Borough of Haddonfield, Chapter 151 permits outside eating facilities adjacent to existing restaurants and businesses selling prepared food in order to encourage the viability of restaurants and food-service establishments and to enhance the vitality of the Borough of Haddonfield; and
WHEREAS, the below listed business has submitted the required application and fees requesting such approval which has been reviewed by the Zoning Office with regard to compliance with the provisions of the Code.
NOW THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey as follows:
1. That the following business has been authorized to have an outdoor eating facility from the date of this Resolution to December 31, 2007 pursuant to The Code of the Borough of Haddonfield, Chapter 151 and their application:

6. The Borough of Haddonfield reserves the right to terminate its consent as its sole discretion at any time during this period.

Authorization to Release Performance Bond – Utility Replacement Project – 2007 Road Program – Water Main Replacement and Sanitary Sewer
WHEREAS, the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey previously approved a Performance Bond for the Utility Replacement Project – 2007 Road Program – Water Main Replacement and Sanitary Sewer in accordance with the bid accepted for such work and awarded on June 26, 2007; and
WHEREAS, the engineer has conducted an inspection for this project and based upon their investigation it is recommend to release the Performance Bond.
WHEREAS, prior to the recommended release of the Performance Bond, the Borough Engineer’s recommend the activation of the Maintenance Bond in the amount of $141,387, which represents 15% of the revised Construction Cost to be held for a period of two (2) years.
WHEREAS, the Borough of Haddonfield is in receipt of the recommended maintenance bond.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey that the Performance Bond be released in the amount of $405,829.69.

Authorization to Sign 3 Year Cooperation Agreement with Camden County – CDBG
WHEREAS, the Board of Commissioners of the Borough of Haddonfield and the County of Camden wish to establish a cooperative means of conducting certain eligible community development and affordable housing activities; and
WHEREAS, Title 1 of the Housing and Community Development Act of 1974, and the HOME Program Act of 1991, as amended, provides federal funds being made available to Camden County for use to carry out eligible Community Development Activities therein; and
WHEREAS, the Interlocal Services Act (N.J.S.A. 40:8A-1 et seq.), as amended, provides a mechanism through which counties and municipalities may enter into agreements for the provisions of joint services; and
WHEREAS, the Board of Commissioners of the Borough of Haddonfield will propose certain activities to be carried out under the 31st, 32nd, and 33rd Year Community Development and HOME Programs; and
WHEREAS, the aforesaid activities are in the best interest of the Borough of Haddonfield.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield that the 31st, 32nd, and 33rd Year Cooperation Agreement be adopted.
BE IT FURTHER RESOLVED, that this resolution shall take effect immediately upon its enactment as provided by law.

Authorization to Amend Resolution 2007-08-28-172 - Issuing of Checks for Fair Share Housing Estimate Refunds
WHEREAS, on August 28, 2007 the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey authorized that refund checks be drawn on the Fair Share Housing Escrow Account.
WHEREAS, these refunds represented overpayments of the Fair Share Housing estimates made after the actual added assessments were set.

WHEREAS, Women’s History Month provides our country the privilege of honoring the countless contributions that American women have made throughout our history. These contributions have enriched our culture, strengthened our Nation, and furthered our Founders’ vision for a free and just Republic that provides opportunity and safety at home and is an influence for peace around the world;
WHEREAS, Since its beginnings, our land has been blessed by noteworthy women who played defining roles in shaping our Nation. Women befriended explorers, wrote and spoke for equality, freedom and justice for all, and pioneered efforts as physicians helping others. Women showed us the power of determined human spirit and furthered the cause of freedom through service in government, the military and other organizations;
WHEREAS, The history of American Women is a story of outstanding individuals who sacrificed much and worked hard in pursuit of a better world, where peace, dignity and opportunity can reign. American women of strength, vision and character have long influenced our country by contributing their time, efforts and wisdom in vastly diverse ways to improve and enhance our government and communities, our schools and religious institutions, our businesses and the military, and the arts and sciences;
WHEREAS, Women also have fundamentally shaped our civilization in the care and nurturing of families. Today, women are furthering the Founders’ vision by working to advance freedom, increase equality, and administer justice in every corner of our land, through everyday work in schoolrooms, boardrooms, courtrooms, homes and communities.
NOW THEREFORE, BE IT RESOLVED, we, the Commissioners of the Borough of Haddonfield, do hereby proclaim March 2008 as Women’s History Month, and ask the residents of our community to join us in celebrating the many, varied, unique and truly wonderful gifts of women.
