BOND ORDINANCE PROVIDING FOR VARIOUS WATER AND SEWER IMPROVEMENTS IN AND BY THE BOROUGH OF HADDONFIELD, IN THE COUNTY OF CAMDEN, NEW JERSEY, APPROPRIATING $1,225,000 THEREFORE AND AUTHORIZING THE ISSUANCE OF $1,225,000 BONDS OR NOTES OF THE BOROUGH FOR FINANCING THE COST THEREOF.
BE IT ORDAINED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, New Jersey (not less than two-thirds of all members thereof affirmatively concurring) as follows:
SECTION I
The improvements described in Section 3 of this bond ordinance are hereby authorized to be undertaken by the Borough of Haddonfield, New Jersey (the “Borough”). For the several improvements or purposes described in Section 3, there are hereby appropriated the respective sums of money therein stated as the appropriation made for each improvement or purpose, such sums amounting in the aggregate to $1,225,000. No down payment is required as the purposes authorized herein are deemed self-liquidating and the obligations authorized herein are deductible from the gross debt of the Borough, as more fully explained in Section 6(e) of this ordinance.
SECTION II
In order to finance the cost of the improvements or purposes, negotiable bonds are hereby authorized to be issued in the principal amount of $1,225,000 pursuant to the Local Bond Law. In anticipation of the issuance of the bonds, negotiable bond anticipation notes are hereby authorized to be issued pursuant to and within the limitations prescribed by the Local Bond Law.
SECTION III
The several improvements hereby authorized and the several purposes for which the bonds are to be issued, the estimated cost of each improvement and the appropriation therefore, the estimated maximum amount of bonds or notes to be issued for each improvement and the period of usefulness of each improvement are as follows:

The excess of the appropriation made for each of the improvements or purposes aforesaid over the estimated maximum amount of bonds or notes to be issued therefore, as above stated, is the amount of the down payment for each purpose.
SECTION IV
All bond anticipation notes issued hereunder shall mature at such times as may be determined by the chief financial officer; provided that no note shall mature later than one year from its date. The notes shall bear interest at such rate or rates and be in such form as may be determined by the chief financial officer. The chief financial officer shall determine all matters in connection with notes issued pursuant to this ordinance, and the chief financial officer's signature upon the notes shall be conclusive evidence as to all such determinations. All notes issued hereunder may be renewed from time to time subject to the provisions of the Local Bond Law. The chief financial officer is hereby authorized to sell part or all of the notes from time to time at public or private sale and to deliver them to the purchasers thereof upon receipt of payment of the purchase price plus accrued interest from their dates to the date of delivery thereof. The chief financial officer is directed to report in writing to the governing body at the meeting next succeeding the date when any sale or delivery of the notes pursuant to this ordinance is made. Such report must include the amount, the description, the interest rate and the maturity schedule of the notes sold, the price obtained and the name of the purchaser.
SECTION V
The Borough hereby certifies that it has adopted a capital budget or a temporary capital budget, as applicable. The capital or temporary capital budget of the Borough is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency herewith. To the extent that the purposes authorized herein are inconsistent with the adopted capital or temporary capital budget, a revised capital or temporary capital budget has been filed with the Division of Local Government Services.
SECTION VI
The following additional matters are hereby determined, declared, recited and stated:
(a) The improvements or purposes described in Section 3 of this bond ordinance are not current expenses. They are all improvements or purposes that the Borough may lawfully undertake as self-liquidating purposes of a municipal public utility. No part of the costs thereof has been or shall be specially assessed on property specially benefitted thereby.
(b) The average period of usefulness, computed on the basis of the respective amounts of obligations authorized for each purpose and the reasonable life thereof within the limitations of the Local Bond Law, is 40 years.
(c) The Supplemental Debt Statement required by the Local Bond Law has been duly prepared and filed in the office of the Clerk, and a complete executed duplicate thereof has been filed in the office of the Director of the Division of Local Government Services in the Department of Community Affairs of the State of New Jersey. Such statement shows that the gross debt of the Borough as defined in the Local Bond Law is increased by the authorization of the bonds and notes provided in this bond ordinance by $1,225,000, but that the net debt of the Borough determined as provided in the Local Bond Law is not increased by this bond ordinance. The obligations authorized herein will be within all debt limitations prescribed by that Law.
(d) An aggregate amount not exceeding $183,750 for items of expense listed in and permitted under N.J.S.A. 40A:2-20 is included in the estimated cost indicated herein for the purposes or improvements.
(e) This bond ordinance authorizes obligations of the Borough solely for purposes described in N.J.S.A. 40A:2-7(h). The obligations authorized herein are to be issued for a purposes that is deemed to be self-liquidating pursuant to N.J.S.A. 40A:2-47(a) and are deductible from gross debt pursuant to N.J.S.A. 40A:2-44(c).
SECTION VII
Any grant moneys received for the purposes described in Section 3 hereof shall be applied either to direct payment of the cost of the improvements or to payment of the obligations issued pursuant to this ordinance. The amount of obligations authorized but not issued hereunder shall be reduced to the extent that such funds are so used.
SECTION VIII
The chief financial officer of the Borough is hereby authorized to prepare and to update from time to time as necessary a financial disclosure document to be distributed in connection with the sale of obligations of the Borough and to execute such disclosure document on behalf of the Borough. The chief financial officer is further authorized to enter into the appropriate undertaking to provide secondary market disclosure on behalf of the pursuant to Rule 15c2-12 of the Securities and Exchange Commission (the “Rule”) for the benefit of holders and beneficial owners of obligations of the Borough and to amend such undertaking from time to time in connection with any change in law, or interpretation thereof, provided such undertaking is and continues to be, in the opinion of a nationally recognized bond counsel, consistent with the requirements of the Rule. In the event that the Borough fails to comply with its undertaking, the Borough shall not be liable for any monetary damages, and the remedy shall be limited to specific performance of the undertaking.
SECTION IX
The full faith and credit of the Borough are hereby pledged to the punctual payment of the principal of and the interest on the obligations authorized by this bond ordinance. The obligations shall be direct, unlimited obligations of the Borough, and the Borough shall be obligated to levy ad valorem taxes upon all the taxable real property within the Borough for the payment of the obligations and the interest thereon without limitation of rate or amount.
SECTION X
This bond ordinance shall take effect 20 days after the first publication thereof after final adoption, as provided by the Local Bond Law.

BOND ORDINANCE PROVIDING FOR VARIOUS CAPITAL IMPROVEMENTS IN AND BY THE BOROUGH OF HADDONFIELD, IN THE COUNTY OF CAMDEN, NEW JERSEY, APPROPRIATING THE AGGREGATE AMOUNT OF $940,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $893,000 BONDS OR NOTES OF THE BOROUGH TO FINANCE PART OF THE COST THEREOF
BE IT ORDAINED by the Board of Commissioners of the Bborough of Haddonfield, County of Camden, State of New Jersey (by not less than two-thirds of all members thereof affirmatively concurring) as follows:

The several improvements described in Section 3 of this bond ordinance are hereby respectively authorized to be undertaken by the Borough of Haddonfield, in the County of Camden, New Jersey (the “Borough”) as general improvements. For the several improvements or purposes described in Section 3, there are hereby appropriated the respective sums of money therein stated as the appropriation made for each improvement or purpose, such sums amounting in the aggregate to $940,000, including the aggregate sum of $47,000 as the several down payments for the improvements or purposes required by the Local Bond Law. The down payments have been made available by virtue of provision for down payment or for capital improvement purposes in one or more previously adopted budgets.

In order to finance the cost of the several improvements or purposes not covered by application of the several down payments, negotiable bonds are hereby authorized to be issued in the principal amount of $893,000 pursuant to the Local Bond Law. In anticipation of the issuance of the bonds, negotiable bond anticipation notes are hereby authorized to be issued pursuant to and within the limitations prescribed by the Local Bond Law.

AN ORDINANCE AMENDING THE CODE OF THE BOROUGH OF HADDONFIELD, COUNTY OF CAMDEN, STATE OF NEW JERSEY, CHAPTER 135, ENTITLED LAND DEVELOPMENT WITH REGARD TO TREE PRESERVATION
The Commissioners of the Borough of Haddonfield, County of Camden and State of New Jersey, do ordain:
SECTION I:
Chapter 135, Article IX – Site Design Standards, Section 84(C)(3) of the Code of the Borough of Haddonfield hereby be amended to read as follows (changes are in bold):
§135-84 Landscaping.
C. Site protection and general planting requirements.
(3) Protection of existing plantings. Maximum effort should be made to save mature trees , including those trees with a diameter of ten inches or more. No material or temporary soil deposits shall be placed within four feet of shrubs or 10 feet of trees designated on the landscape plan to be retained. Protective barrier shall be installed around each plant group of plants that are to remain on site. Barriers shall not be supported by the plants they are protecting, but shall be self supporting. They shall be a minimum of four feet high and constructed of a durable material that will last until construction is completed. Snow fences and silt fences are examples of acceptable barriers.
(3.1) On Site compensatory tree planting. In the event that it is impractical or would cause undue hardship in the opinion of the planning board or zoning board of adjustment that an existing tree with a diameter of ten inches or more be retained, compensatory planting shall be provided according to the following schedule and standards:

(a) Replacement trees shall be nursery grown and comply with American Association of Nurserymen standards for nursery stock and shall be between 2.5 inches and 3.5 inches in caliper.
(b) Replacement trees may be used anywhere on site, unless prohibited by law and shall be planted in accordance with the standards of the American Association of Nurserymen.
(c) All trees shall be guaranteed for a minimum of one (1) year from the time of planting by the applicant against death and disease.
(d) In the event that it is impractical to install replacement trees immediately due to planting hazards or species availability, a bond covering the total cost of the plant material and installation shall be posted with the Borough.
(e) In the event it is impractical to provide the required number of replacement trees on the subject site, fewer, however, larger more valuable replacement trees shall be installed on the site, with an aggregate cost as installed not less than the estimated aggregate cost of the required number of replacement trees.
SECTION II:
All ordinances or parts of ordinances inconsistent with this amending ordinance be and they are hereby repealed to the extent of such inconsistencies only.
SECTION III:
If any section or provision of this ordinance shall be held unconstitutional or invalid by any court, the remaining sections and provisions shall, notwithstanding such holding, remain and be in full force and effect.
SECTION IV:
This ordinance shall be in effect upon passage and publication according to law.

Authorization to Grant Permission to Rotary to Hold Summer Concerts
WHEREAS, the Board of Commissioners of the Borough of Haddonfield deems it in the best interest of its citizens to encourage organized events and festivals for the benefit of the community; and
WHEREAS, the Rotary Club of Haddonfield has been appointed to promote a Summer Concert Series on Fridays in July between the hours of 6:00 p.m. and 9:00 p.m. on Kings Highway at Kings Court in the commercial district of the Borough of Haddonfield.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:
1. Permission is hereby granted to the Rotary Club of Haddonfield to utilize Kings Court and Kings Highway in front of Kings Court in the Borough of Haddonfield on June 27, July 11, 18, and 25, 2008 for the “Rotary Club Summer Concert Series.”
2. The closing of Kings Highway from Haddon Avenue to Tanner Street is authorized from 6:00 p.m. through 9:00 p.m. on the above dates.

Authorization to Hold Fireworks Display
WHEREAS, an application has been made by the Haddonfield Celebrations Association for a permit to allow the vendor under contract to provide a public display of fireworks as part of the Borough’s Annual Independence Day Celebration; and
WHEREAS, per State Statute, the Borough’s Chiefs of the Police and Fire Departments must approve said application and the required surety must be provided by the fireworks operator.
NOW, THEREFORE BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that upon the approval of the Borough’s Chiefs of the Police and Fire Departments, a permit shall be granted to said Haddonfield Celebrations Association for the public display of fireworks by the said Association in the High School Stadium, in the said Borough on Thursday, July 3, 2008 (rain date Saturday, July 5, 2008) between the hours of 9:00 p.m. and 11:00 p.m., Eastern Daylight Savings Time, subject to and in accordance with the statutes of the State of New Jersey.
BE IT FURTHER RESOLVED that a copy of said application and permit be forwarded by the Clerk of said Borough to the Camden County Fire Marshall Office in Blackwood, New Jersey, as foresaid.

Authorization to Hold Haddonfield Crafts and Fine Arts Festival
WHEREAS, the Board of Commissioners of the Borough of Haddonfield deems it in the best interest of its citizens to encourage organized events and festivals for the benefit of the community; and
WHEREAS, the Partnership for Haddonfield (PfH) wishes to sponsor a “Haddonfield Craft and Fine Arts Festival” on Saturday, July 12, 2008 from 11:00 a.m. to 8:00 p.m., and Sunday, July 13, 2008 from 12:00 noon to 5:00 p.m.; and
WHEREAS, PfH has provided the Borough of Haddonfield with the appropriate insurance liability coverage of at least $1,000,000.00 naming the Borough of Haddonfield as an additional insured;
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:
1. The closing of Kings Highway from Haddon Avenue to PATCO and portions of Tanner Street, Mechanic Street and Chestnut Street is hereby authorized from 6:00 a.m. on July 12, 2008 through 8:00 p.m. on July 13, 2007 for the “Haddonfield Craft and Fine Arts Festival.”
2. Permission is hereby granted to vendors designated by the PfH Events Committee to utilize specific locations on Kings Highway, Tanner Street, Mechanic Street and Chestnut Street, as well as, sidewalks and other public property as designated by the PfH Events Committee, within the commercial district in the Borough of Haddonfield to display goods, wares and food, etc. for sale as part of the “Haddonfield Craft and Fine Arts Festival.”
3. The various food purveyors in the commercial district are hereby given permission to display and sell food on the sidewalks in front of their stores or shops and food purveyors in Haddonfield whose shops or stores are not on Kings Highway in the Commercial District may sell food as determined by the PfH Events Committee, at locations designated by the Committee.
4. Food vendors without building locations within Haddonfield must receive approval by the PfH Marketing Committee to display and sell goods, wares and food.
5. Food vendors without building locations in Haddonfield who choose to set-up on the evening of Friday, July 11, 2008 must provide continuous security at their expense from the time of the drop off of their equipment until 6:00 a.m. on Saturday, July 12, 2008 when Kings Highway closes to vehicle traffic.
6. All food purveyors referenced above must either obtain a Temporary Event Permit from Camden County or an Outdoor Eating Facility Permit from the Borough as appropriate. All restaurants who cook outside must have a permit from the Department of Public Safety County Fire Marshall’s Office.
7. Only those Haddonfield merchants with a Merchandise Display Permit from the Borough of Haddonfield my have any merchandise on any Borough sidewalks.
8. Stationary outdoor entertainment is hereby permitted along public sidewalks and places within the business district as designated by the PfH Committee on Saturday, July 12, 2008 from 11:00 a.m. to 8:00 p.m. and Sunday, July 13, 2008 from 12:00 p.m. to 5:00 p.m.
9. As assortment of signage is hereby permitted along public sidewalks and places within the business district at locations determined by the PfH Committee.
10. Umbrellas, tables and chairs are hereby permitted in Kings Court at locations designated by the PfH Committee.
11. Port o’ Potties are authorized to be on Lantern Lane Lot and Mechanic Street Lot.

Authorization for Partnership for Haddonfield to Hold Sidewalk Festival
WHEREAS, the Board of Commissioners of the Borough of Haddonfield deems it in the best interest of its citizens to encourage organized events and festivals for the benefit of the community; and
WHEREAS, the Partnership for Haddonfield (PfH) will conduct its annual Sidewalk Sale Days on July 31st, August 1st, and 2nd, 2008 within the commercial district of the Borough of Haddonfield;
WHEREAS, in the interest of public safety the Board of Commissioners find it necessary to amend said resolution to remove the permission to various food purveyors in the Commercial District to display and sell food on the sidewalks in front of their stores or shops and for food purveyors in Haddonfield whose shops or stores are not on Kings Highway in the Commercial District to sell food as determined by the PfH Events Committee, at locations designated by the Committee.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that permission is granted only for the following items:
1. Permission is hereby granted to the Retail Shops and Stores in the Borough’s CBD zoning district to utilize the public sidewalks and other public property in front of their businesses only, within these Commercial Districts within the Borough of Haddonfield on July 31st, August 1st, and 2nd, 2008 as part of the PfH sponsored Sidewalk Sale Days, provided that the Retail Shops and Stores ensure safe pedestrian passage.
2. Outdoor entertainment is hereby permitted along public sidewalks and places within the business district as designated by the PfH Events Committee.
3. That Kings Court merchants assigned to a spot on Kings Highway if Kings Court is under construction.

WHEREAS, the Board of Commissioners of the Borough of Haddonfield desires to apply to the New Jersey Department of Transportation for a grant under the Trust Fund for 2008; and
WHEREAS, said application is due to be filed by June 20, 2008 with the New Jersey Department of Transportation; and
WHEREAS, said applications will be for the following categories and items:
1. 2009 State Aid Reconstruction for Redman Avenue (from Barberry Lane to West End Avenue).
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, formally approves the grant application for the above state project.
BE IT FURTHER RESOLVED, that the appropriate officials are hereby authorized to submit an electronic grant application identified as MA-2009-Haddonfield Borough-00397 to the New Jersey Department of Transportation on behalf of the Borough of Haddonfield.
