SECOND READING
2008-16
AN ORDINANCE OF THE BOROUGH OF HADDONFIELD, COUNTY OF CAMDEN AND STATE OF NEW JERSEY TO ADOPT BY REFERENCE CHAPTER 232, VEHICLES AND TRAFFIC, OF THE CODE OF THE BOROUGH OF HADDONFIELD

WHEREAS, a comprehensive codification of the Borough’s vehicles and traffic ordinances has been prepared; and

WHEREAS, the ordinances contained in the comprehensive codification had already been duly enacted at various times by the Board of Commissioners; and

WHEREAS, the comprehensive codification has been reviewed by the New Jersey Department of Transportation and preliminary approval has been given; and

WHEREAS, it is now necessary to adopt the Vehicles and Traffic Chapter prior to submission to the Department of Transportation for final approval.

NOW, THEREFORE BE IT ORDAINED, by the Board of Commissioners of the Borough of Haddonfield, in the County of Camden and State of New Jersey:

SECTION I

Pursuant to N.J.S.A. 40:49-4, there is hereby adopted and codified a new Chapter 232, Vehicles and Traffic, of the Code of the Borough of Haddonfield.

SECTION II

A complete copy of the new Chapter 232, Vehicles and Traffic, as adopted and codified by this ordinance has been filed in the office of the Municipal Clerk and shall remain there for the use and examination of the public until final action is taken on this ordinance.

SECTION III

All ordinances and parts of ordinances which are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. Specifically, Ordinance No. 1720, as amended, is hereby repealed; provided, however, that any amendment to Ord. No. 1720 adopted subsequent to June 8, 2004, is hereby expressed saved from repeal and may be included in the new Chapter 232.

SECTION IV

If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional or invalid, such decision shall not affect the remaining portions of this ordinance.

SECTION V

This ordinance shall take effect immediately upon final passage, approval, and publication as required by law and upon approval by the Commissioner of the Department of Transportation.

AN ORDINANCE TO AMEND THE CODE OF THE BOROUGH OF HADDONFIELD, COUNTY OF CAMDEN, STATE OF NEW JERSEY, CHAPTER 42 THEREOF ENTITLED OFFICERS AND EMPLOYEES TO PROVIDE FOR REGULATIONS GOVERNING THE DETERMINATION OF POSITIONS ELIGIBLE FOR THE DEFINED CONTRIBUTION RETIREMENT PROGRAM

WHEREAS, the State Legislature recently adopted Chapter 92 of the Laws of 2007 (N.J.S. 43:15C-1 et seq.) to create the Defined Contribution Retirement Program to provide retirement benefits to various county and municipal officials; and

WHEREAS, N.J.S. 43:15C-2 requires the governing body of each county, municipality, and other local entity to adopt, as appropriate, either a resolution or ordinance to determine the positions that are substantially similar in nature to the advice and consent of the Senate for appointments by the Governor of the State, pursuant to guidelines or policy that shall be established by the Local Finance Board in the Department of Community Affairs, and for which officials appointed to such positions shall be eligible for and shall participate in the Defined Contribution Retirement Program, subject to the provisions of law; and,

WHEREAS, the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey has considered the guidelines issues by the Local Finance Board.

NOW THEREFORE, BE IT ORDAINED by the Board of Commissioners of the Borough of Haddonfield, in the County of Camden and State of New Jersey, as follows:

SECTION I

Chapter 42 of the codified ordinances of the Borough of Haddonfield, entitled Officers and Employees is hereby amended as follows, by adding a new Article:

ARTICLE V
State of New Jersey’s Defined Contribution Retirement Program

§ 42-13. Participating positions

A. Pursuant to N.J.S. 43:15C-2, the following positions are deemed to be eligible for and shall participate in the State of New Jersey’s Defined Contribution Retirement Program:

a. Borough Administrator
b. Borough Solicitor
c. Borough Engineer
d. Fire Chief
e. Planning Board Solicitor
f. Zoning Board of Adjustment Solicitor
g. Municipal Prosecutor
h. Public Defender
i. Municipal Court Judge

B. Individuals serving in the following positions are exempt from Defined Contribution Retirement Program membership, pursuant to N.J.S. 43:15C-2:

d. Construction Code Official
e. Qualified Purchasing Agent
f. Tax Assessor

SECTION II

This Ordinance shall be implemented, construed and subject to the aforesaid Chapter 92 of the Laws of 2007 (N.J.S. 43:15C-1 et seq.) as amended from time to time, and any regulations or guidance documents from the Local Finance Board or the Division of Pensions and Benefits.

SECTION III

Should any part or parts of this Ordinance be held to be invalid by any competent court of law, such invalidity shall only affect the part or parts held to be invalid, and all other parts shall remain in effect.

SECTION IV

A copy of this Ordinance shall be filed with the Director of the Division of Pensions & Benefits of the New Jersey Department of the Treasury.

SECTION V

This ordinance shall take effect upon its passage and publication as required by law/take effect immediately.

AN ORDINANCE TO AMEND THE CODE OF THE BOROUGH OF HADDONFIELD, COUNTY OF CAMDEN, STATE OF NEW JERSEY, CHAPTER 232, ENTITLED VEHICLES AND TRAFFIC, TO ALLOW FOR RESTRICTED PARKING

Be it ordained by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:

SECTION I

1. Chapter 232 of the codified ordinances of the Borough of Haddonfield, entitled Vehicles and Traffic, Article IV, entitled Parking, Section 28, entitled Parking prohibited during certain hours on certain streets is hereby amended to remove the following street:

Authorization to Accept and Advertise Audit Report

WHEREAS, N.J.S.A. 40A:5-4 requires the governing body of every local unit to have made an annual audit of its books, accounts and financial transactions; and

WHEREAS, the Annual Report of Audit for the year 2006 has been filed by a Registered Municipal Accountant with the Haddonfield Borough Clerk as per the requirements of N.J.S.A. 40A:5-6, and a copy has been received by each member of the governing body; and

WHEREAS, R.S. 52:27BB-34 authorizes the Local Finance Board of the State of New Jersey to prescribe reports pertaining to the local fiscal affairs; and

WHEREAS, the Local Finance Board has promulgated N.J.A.C. 5:30-6.5, a regulation requiring that the governing body of each municipality shall by resolution, certify to the Local Finance Board of the State of New Jersey that all members of the governing body have reviewed, as a minimum, the sections of the annual audit entitled “Findings and Questioned Costs” or “Findings and Recommendations”; and

WHEREAS, the members of the governing body have personally reviewed as a minimum the Annual Report of Audit, and specifically the sections of the Annual Audit entitled “Findings and Questioned Costs” or “Findings and Recommendations” as evidenced by the group affidavit form of the governing body; and

WHEREAS, such resolution of certification shall be adopted by the governing body no later than forty-five days after the receipt of the annual audit, as per the regulations of the Local Finance Board; and

WHEREAS, all members of the governing body have received and have familiarized themselves with, at least, the minimum requirements of the Local Finance Board of the State of New Jersey, as stated aforesaid and have subscribed to the affidavit, as provided by the Local Finance Board; and

WHEREAS, failure to comply with the promulgations of the Local Finance Board of the State of New Jersey may subject the members of the governing body to the penalty provisions of R.S. 52:27BB-52 – to wit:

R.S. 52:27BB-52 – “A local officer or member of a local governing body who, after a date fixed for compliance, fails or refuses to obey an order of the director (Director of Local Government Services), under the provisions of this Article, shall be guilty of a misdemeanor and, upon conviction, may be fined no more than one thousand dollars ($1,000.00) or imprisoned for not more than one year, or both, in addition shall forfeit his office.”

NOW, THEREFORE BE IT RESOLVED, that the governing body of the Borough of Haddonfield, County of Camden, State of New Jersey, hereby states that it has complied with the promulgation of the Local Finance Board of the State of New Jersey dated July 30, 1968 and does hereby submit a certified copy of this resolution and the required affidavit to said Board to show evidence of said compliance.

Authority to Provide Tax Grace Period

WHEREAS, mailing of the third quarter property tax bills was delayed due to the
timing of receipt of the certified aid figures from the State of New Jersey; and

WHEREAS, the Board of Commissioners of the Borough of Haddonfield wishes to allow the property owners of the Borough a sufficient period of time to pay their third quarter property tax bills.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:

1. That the grace period for payment of the third quarter property tax bills shall be ten (10) days from August 1 to August 10, 2008.

2. That interest charged on third quarter taxes paid on or after August 11 through and inclusive of August 25, 2008 be at a rate of .0001%.

3. That interest charged on taxes received after August 25, 2008 be charged in accordance with the rates set by resolution dated January 2, 2008 and that said interest shall be computed retroactive to August 1, 2008 as required by State Statute.

Authorization To Apply for a Municipal Alliance Grant

WHEREAS, the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey recognizes that the abuse of alcohol and drugs is a serious problem in our society amongst persons of all ages; and

WHEREAS, the Board of Commissioners further recognizes that it is incumbent upon not only public officials but upon the entire community to take action to prevent such abuses in our community; and

WHEREAS, the Board of Commissioners has applied for funding to the Governor’s Council on Alcoholism and Drug Abuse through the County of Camden.

NOW THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey hereby recognizes the following:

1. The Board of Commissioners does hereby authorize submission of an application for the Haddonfield Municipal Alliance grant for calendar year 2009 in the amount of $14,226.00.

2. The Board of Commissioners acknowledges the terms and conditions for administering the Municipal Alliance grant, including the administrative compliance and audit requirements.

Authorization to Approve Signed Bike Routes

WHEREAS, the Haddonfield Transportation and Pedestrian Safety (TAPS) Bicycle Subcommittee has submitted a proposal for a network of signed bicycle routes, as well as new and/or improved crosswalks for the dual purpose of providing safe crossing sites for pedestrians and for cyclists throughout the Borough; and

WHEREAS, approval by the Board of Commissioners would provide support needed to apply for funding for signage and publicity from grant agencies; and

WHEREAS, the following has been designated as the official bicycle routes:

1. Loop Route - beginning at Borough Hall, the “counter-clockwise” route is as follows: east on Kings Hwy. to Hopkins Lane; north (left) on Hopkins Lane through the park to Grove St.; cross Grove St. onto Hopkins Ave. to Wood Lane; north (right) on Wood Lane to Merion Ave.; west (left) on Merion Ave. to N. Haddon Ave.; north (right) on N. Haddon Ave. (briefly) to Mt Vernon Ave.; west (left) on Mt. 3. Other possible signed gateways – linking via Haddon Twp. to the county’s planned East Atlantic bikeway are as follows: Station Avenue and Chews Landing Road.
NOW, THEREFORE BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, State of New Jersey, County of Camden, approval of the TAPS Bicycle Subcommittee proposal is endorsed and it is agreed to support applications to funding agencies for Signed Bike Routes and improvements to crosswalks.

WHEREAS, the Board of Commissioners of the Borough of Haddonfield, caused a notice to be published in The Courier Post inviting the submission to the Borough Clerk at the Borough Hall on Tuesday, July 22, 2008 at 10:00 a.m. of Sealed Bids for “KINGS COURT HARDSCAPE CONSTRUCTION” for the Borough of Haddonfield; and

WHEREAS, the bid(s) received are as follows:

Authorization to Release Performance Bond – P & D Construction

WHEREAS, the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey previously approved a Performance Bond for the Utility Replacement Project – 2007 Road Program – Rhoads Avenue - Contract #1 in accordance with the bid accepted for such work and awarded on June 26, 2007; and

WHEREAS, the engineer has conducted an inspection for this project and based upon their investigation it is recommend to release the Performance Bond.

WHEREAS, prior to the recommended release of the Performance Bond, the Borough Engineer’s recommend the activation of the Maintenance Bond in the amount of $479,497.90 to be held for a period of two (2) years.

WHEREAS, the effective date of activation of the Maintenance Bond is June 11, 2008; and

WHEREAS, the Borough of Haddonfield is in receipt of the recommended maintenance bond.

NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey that the Performance Bond be released in the amount of $405,829.69.

Authorization to Sign Shared Services Agreement with Camden County– 2008-2009 PARIS Grant Projects

WHEREAS, pursuant to funding provided by the Public Archives and Records Infrastructure Support (PARIS) grants program, the County of Camden will provide microfilming of record books and record organization services to various municipalities in the County of Camden; and

WHEREAS, the Borough of Haddonfield desires to participate in these services with the County of Camden for the benefit of its residents; and

WHEREAS, participation by the Borough of Haddonfield will be at no cost to the municipality and all costs for these services will be borne by the County.

NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that the appropriate Borough officials be authorized to sign an Interlocal Services Agreement with Camden County for participation in a shared services agreement for the provision of microfilming and records organization services with the County of Camden.

Authorization to Sign Shared Services Agreement with Camden County Public Health Services

WHEREAS, the County of Camden employs the services of a designated full-time Health Officer for all public health services and activities, including technical and professional services, that meet the standards set for in N.J.A.C. 8:52, Public Health Practice Standards of Performance for Local Boards of Health in New Jersey; and

WHEREAS, municipalities may satisfy the State statutory requirement for the provision of a program meeting the provisions of N.J.A.C. 8:52 by entering into a Shared Services Agreement with another governmental unit and its recognized local health agency; and

WHEREAS, N.J.A.C. 40A:65-1 et seq (“Uniform Shared Services and Consolidated Act”) permits two local units to enter into a contract for any service which any party to the agreement is empowered to render within its jurisdiction; and

WHEREAS, this Agreement will require the County Health Officer to assume daily responsibility for the coordination and direction of all routine activities, emergencies and necessary responses on 365/24/7 basis for each municipality so participating and entering into this Shared Services Agreement; and

WHEREAS, there shall be no cost to each municipality entering into an agreement with the County for the provision of local Public Health Officer Services and all costs for these services shall be borne by the County; and

WHEREAS, the term for the Agreement shall be for a period to two years commencing August 1, 2008 and ending July 31, 2010, with automatic extensions for successive two year periods unless renegotiated or terminated by either party; and

WHEREAS, during the term of this Agreement, the Recipient shall indemnify and hold harmless the County, its agents and employees, for any liability which may attach or arise either during or at any time subsequent to the completion of this Agreement; and

NOW, THEREFORE BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, State of New Jersey, County of Camden, in agreement with the County that their mutual public purposes and their best interest will be promoted by the execution and delivery of this Shared Services Agreement pursuant to the powers conferred by the Uniform Shared Services and Consolidation Act.

WHEREAS, the Borough of Haddonfield is a participant in a cooperative pricing project through Camden County known as Bid A-34, for Copy and Computer Paper and Envelopes under the Camden County Cooperative Pricing System, System Identifier No. 57 CCCPS; and

WHEREAS, the Board of Chosen Freeholders recommended the award as follows for the County and participating governments’ entities in the Cooperative for the term commencing September 1, 2008 through February 28, 2009 with the option of an additional six (6) months extension:

Authorization to Allow Use of Borough Right-of-Way Block 97, Lot 3.01

WHEREAS, the homeowners of a property located at Block 97, Lot 3.01, otherwise known as 311 Avondale Avenue, wish to construct a retaining at the front of their property; and

WHEREAS, this retaining wall will extend into the public right-of-way.

THEREFORE, BE IT RESOLVED, by the Board of Commissioner of the Borough of Haddonfield, County of Camden, State of New Jersey that:

1. The use of the public right-of-way is approved for Block 97, Lot 3.01, otherwise known as 311 Avondale Avenue, by no more than four (4) feet from the homeowner’s boundary line.

2. The Borough reserves the right to cause the retaining wall to be removed at the owner’s expense.
