Authorization for Outdoor Eating Facility – due Italian Bistro

WHEREAS, the Code of the Borough of Haddonfield, Chapter 151 permits outside eating facilities adjacent to existing restaurants and businesses selling prepared food in order to encourage the viability of restaurants and food-service establishments and to enhance the vitality of the Borough of Haddonfield; and

WHEREAS, the below listed business has submitted the required application and fees requesting such approval which has been reviewed by the Zoning Office with regard to compliance with the provisions of the Code;

NOW THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey as follows:

1. That the following business has been authorized to have an outdoor eating facility from the date of this Resolution to December 31, 2008 pursuant to The Code of the Borough of Haddonfield, Chapter 151 and their application:

Due Italian Bistro – 146-148 Kings Highway East

2. That the Borough of Haddonfield has received a certificate verifying they have an insurance liability policy with amounts of coverage of at least $1,000,000 acknowledging that outside seating is part of the coverage and naming the Borough of Haddonfield as an additional named insured.

3. That the above businesses comply with all other Federal, State and Local laws.

4. The above business hold harmless and indemnify the Borough of Haddonfield from any and all damages and/or claims, including attorney fees and court costs, which may arise out of its use of the public sidewalks in front of their premises.

5. No easement, license or right is hereby granted by this resolution other than the municipal consent, for the time period, as identified herein.

6. The Borough of Haddonfield reserves the right to terminate its consent as its sole discretion at any time during this period.

Jobel Drive Repaving – Daryl Vermaat Construction

WHEREAS, the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey required that $13,586 be deposited into escrow for the repaving of Jobel Drive; and

WHEREAS, the engineer has conducted an inspection for this project and based upon their investigation it is recommend to release the money in.

NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey that the escrow amount of $13,586.00 be released to Daryl Vermaat Construction, LLC.

WHEREAS, the Board of Commissioners of the Borough of Haddonfield, caused a notice to be published in the Retrospect inviting the submission to the Borough Clerk at the Borough Hall on Thursday, May 1, 2008 at 10:00 a.m. of Sealed Bids for a Chipper Truck for the Borough of Haddonfield; and

WHEREAS, the bid(s) received are as follows:

WHEREAS, the bid(s) received are as follows:

1. That W. E. Timmerman Co., Inc., 3554 Route 22 West, P.O. Box 71, Whitehouse, New Jersey 08888 is hereby determined to be the lowest qualified bidder in connection with the receipt of Sealed Bids on May 1, 2008 for a Bucket Truck for the Borough of Haddonfield.
2. That the Chief Financial Officer of the Borough has certified that the funds will be legally available in Account(s) # C-04-55-925-000-002 (ORD #2008-08 VARIOUS CAPITAL IMPROVE – Public Works Vehicles).

Authorization to Permit Insurance Coverage for Certain Organizations

WHEREAS, the Borough of Haddonfield is a participating member of the Camden County Municipal Joint Insurance Fund relative to General Liability and other coverage; and

WHEREAS, the “FUND” has adopted certain criteria to distinguish between bona fide municipal activities and other quasi-public entities not sponsored by the municipality and therefore, not subject to coverage by the “FUND;” and

WHEREAS, it has been determined that in order to be covered by the “FUND” an organization or activity provide a service of the type that historically municipalities have undertaken themselves or have provided with insurance coverage and/or is one which advances a bona fide local public purpose on a non-profit basis typically met by local government, the benefits of which are available to the municipality in general; and

WHEREAS, the Borough has asked the “FUND” to extend General Liability and non-owned Automobile Liability Coverage to the following entities:

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough Haddonfield, County of Camden, State of New Jersey, as follows:

1. It is hereby certified that the above listed organization exist within the Borough of Haddonfield as bona fide providers of charitable, educational, or recreational activities for the Borough and is, in fact, an organization that supports and/or provide services to the municipality in general and as such is sponsored or subsidized directly or indirectly by the municipality.

2. That the proper officer or officers of the Borough of Haddonfield be, and they are authorized and directed for and in the name of said Borough, to request the organization described herein be named as additional insured for General Liability and Non-Owned Automobile Liability coverage in accordance with the applicable limits and restrictions.

Authorization to Sign Agreement for Professional Services –
Water Rate Case Intervention - Anthony R. Francioso, Esq. of Fornaro Francioso, LLC

WHEREAS, the Borough of Haddonfield has a need to receive legal services as necessary for the intervention, in conjunction with several other affected public agencies, in the matter of New Jersey American Water Company, Inc. for approval of increased tariff rates and charges for water and sewer service; and

WHEREAS, Anthony R. Francioso, Esquire, of Fornaro Francioso, LLC has submitted a proposal to provide legal services as Special Counsel for all the participating public entities on this matter for $185.00 per hour, as well as reimbursement for allowable out of pocket costs, for a total not to exceed $15,000; and

WHEREAS, of the $15,000, Haddonfield’s share, based on its percentage of bulk water purchases from the above water purveyors in relationship to that of the other participating agencies, is estimated to be no more than ten (10%) percent, resulting in a maximum cost to Haddonfield for this contract of $1,500; and

WHEREAS, this contract is in effect until the above referenced rate case is completed; and

WHEREAS, Anthony R. Francioso, Esquire has completed and submitted a Business Entity Disclosure Certification which certifies that Fornaro Francioso, LLC has not made any reportable contributions to a political or candidate committee in the Borough of Haddonfield in the previous year, and that the contract will prohibit Fornario Francioso, LLC from making any reportable contributions through the term of the contract; and

WHEREAS, funds are available in Account 8-09-55-502-000-228 (Water/Sewer Fund – Professional Services) for this purpose.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey hereby authorizes the following:

1. The appropriate officials to enter into a contract with Anthony R. Francioso, Esquire, of Fornaro Francioso, LLC as described herein for a maximum of $1,500.
2. That the Business Disclosure Entity Certification and the Determination of Value be placed on file with this resolution
3. This Contract Award complies with N.J.S.A. 19:44A-20.4 et seq. in that the contract is awarded to one who has not made contributions to any one of the Commissioners on the Board of Commissioners of the Borough of Haddonfield
4. A notice shall be published in the Retrospect newspaper, as required by law, within ten (10) days of the passage of this resolution.

Water Rate Case Intervention - Raymond E. Makul

WHEREAS, the Borough of Haddonfield has a need to receive professional services as necessary for the intervention, in conjunction with several other affected public agencies, in the matter of New Jersey American Water Company, Inc for approval of increased tariff rates and charges for water and sewer service; and

WHEREAS, Raymond E. Makul has submitted a proposal to provide professional services as a Public Utility Consultant on this matter for all the participating public entities on this matter for $215.00 per hour, as well as reimbursement for allowable out of pocket costs, the total not to exceed $24,500; and

WHEREAS, of the $24,500, Haddonfield’s share, based on its percentage of bulk water purchases from the above water purveyors in relationship to that of the other participating agencies, is estimated to be no more than ten (10%) percent, resulting in a maximum cost to Haddonfield for this contract of $2,450;; and

WHEREAS, this contract is in effect until the above referenced rate case is completed; and

WHEREAS, Raymond E. Makul has completed and submitted a Business Entity Disclosure Certification which certifies that he has not made any reportable contributions to a political or candidate committee in the Borough of Haddonfield in the previous year, and that the contract will prohibit himself from making any reportable contributions through the term of the contract; and

WHEREAS, funds are available in Account 8-09-55-502-000-228 (Water/Sewer Fund – Professional Services) for this purpose.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey hereby authorizes the following:

1. The appropriate officials to enter into a contract with Raymond E. Makul as described herein for a maximum of $2,450.
2. That the Business Disclosure Entity Certification and the Determination of Value be placed on file with this resolution
3. This Contract Award complies with N.J.S.A. 19:44A-20.4 et seq. in that the contract is awarded to one who has not made contributions to any one of the Commissioners on the Board of Commissioners of the Borough of Haddonfield
4. A notice shall be published in the Retrospect newspaper, as required by law, within ten (10) days of the passage of this resolution.

Authorization to Extend Participation in Camden County Cooperative Pricing System –
Deer Carcass Removal Services

WHEREAS, by Resolution 2007-03-27-065 adopted March 27, 2007, the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey authorized the participation in a cooperative pricing project through Camden County known as Bid A-1, for deer carcass removal services under the Camden County Cooperative Pricing System, System Identifier No. 57CCCPS; and

WHEREAS, said contract was for the period May 1, 2007 through April 30, 2008 at a rate of $60.00 per carcass removal; and

WHEREAS, said Bid provided for a second year option encompassing the period of May 1, 2008 through April 30, 2009; and

WHEREAS, Camden County Board of Chosen Freeholders, in Resolution #14, dated April 17, 2008, awarded the second year option of Bid A-1 between the Camden County Cooperative Members and Deer Carcass Removal Services for the removal of Deer Carcasses in an amount not to exceed $70.00 per carcass removal; and

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey as follows:
1. That a contract is hereby extended to Deer Carcass Removal Service, P.O. Box 328, Cream Ridge, New Jersey 08514 for the County and participating government entities in the Cooperative for the term beginning May 1, 2008 through April 30, 2009, for an amount not to exceed $70.00 per carcass removal; and

2. That funding for this purpose for the Borough of Haddonfield shall not exceed the maximum line items for office supplies in the Borough of Haddonfield’s 2008 budget and shall be encumbered prior to incurring the obligation pursuant to N.J.A.C. 5:34-5.3(b)(2).

Authorization to Amend Contract – Reassessment Data Management

WHEREAS, on November 28, 2006 the Board of Commissioners of the Borough of Haddonfield passed Resolution No. 2006-11-28-240 awarding a professional services contract to J.H. Services, Inc. for reassessment data management services in the amount of $68,271; and

WHEREAS, a request has been approved from the Tax Assessor for an additional service by the Board of Commissioners; and

WHEREAS, the additional service includes the creation of all new property files and also includes the merging of the old and new files; and

WHEREAS, the cost for these additional services is $7,840, which is less than the 20% threshold for changes.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:
1. That the contract with J.H. Services Inc., P.O. Box 9, Marlton, New Jersey 08053 is hereby amended to include the additional services in the amount of $7,840 required for Reassessment Data Management for the Borough of Haddonfield.
2. That the Chief Financial Officer of the Borough has certified that the funds will be legally available in Account(s) 8-01-46-870-000-240 (Emergency Authorizations – Revaluation).
