ZONING BOARD OF ADJUSTMENTS
Of the
BOROUGH OF HADDONFIELD

The December 19, 2006 meeting of the Haddonfield Zoning Board of Adjustment was called to order by the Mr. Richard Cohn, Chairperson at 7:30PM. Adequate notice of this meeting has been provided by way of the official newspaper of the municipality. It is being held in accordance with the Open Public Meetings Act. The Board has decided that is generally unfair to everyone to make decisions late at night. Therefore, they will normally not allow any applications after 10:30 PM and the meeting will close at midnight regardless of any unheard applications. Unheard applications will be tabled to the next meeting.

The proposed addition would exceed the maximum building coverage of 22% by 1.5% proposing 23.5% building coverage and would exceed the maximum impervious coverage by 4.7% proposing 39.7% when 35% is the maximum permitted. The addition would exceed the maximum combined side yard of 25 by 1.3 feet proposing a combined side yard of 23.7%

Mr. & Mrs. Rohlfing, applicant & Mr. Wagner, the architect for the application, were present and sworn in.

Mr. Lungren outlined the application.

Mr. Rohlfing also gave a brief description of his application noting the expanding family that makes them decide the addition proposal is necessary.

Mr. Wagner described the proposal. The proposed addition meets the single side yard requirement except for a fireplace. The property has a long driveway with a garage in the rear (garage size 22x24 ). The project exceeds the maximum coverage’s due to the size of the garage and the length of the driveway

Mr. Wondrasch asked if the patio was included in the calculation. Mr. Wagner responded yes.

Mr. Burns asked if the stormwater management system will be installed as in the application. Mr. Wagner responded that it will be installed and probably exceeding the requirements depending on the engineers advice as to where they should put the system.

Mr. Wondrasch asked if there is any drainage problems whereas Mr. Chelotti responded, no.

Ms. Branton asked what is the hardship. Mr. Wagner responded that the applicant is trying to keep the garage in the rear of the property which is preferred in town. The existing garage and driveway cause the hardship.

PUBLIC COMMENTS:

John Shay, neighbor next door to the applicant. He expressed thought of the applicant as a good neighbor. He also thinks that the addition will improve the neighborhood.

Ms. Branton asked if Mr. Shay’s house is on the driveway or the addition side from the applicant. Mr. Shay responded their house is on the driveway side.

Jack Oveda, neighbor across the street to the applicant. He and his wife did look at the plans and thought that it is a beautiful. They hope that the applicant will be able to do the addition for their house.

Carolyn James, neighbor lives on Jefferson Ave. She thinks that with the addition to the proposal will at least add a value to the streets.

PUBLIC PORTION CLOSED:

Ms. Barnes motion to approve application as presented. Ms. Branton seconded the motion.

Mr. Cohn discussed the reasons to grant variance to the applicant, the hardship of the property, conforming lot & structures that benefits outweigh detriment and the garage issues.

Ms. Branton agreed with Mr. Cohn concerned about the issues.

Board comments. Vote 7-0. APPROVED.

ZBA #06-48 136 Gill Road
Eric & Joanne Carlson

The proposed additions would encroach into the required side yard 2.7 feet proposing a 15.4 feet setback when 18 feet is required and would encroach into the rear yard setback 14 feet proposing 31 feet when 45 feet in required. The proposed addition with exceed the maximum building coverage of 18% by 3.4% and will exceed the maximum impervious coverage if 28% to 0.1%

Mr. & Mrs. Carlson, applicant and Mr. Wagner, the architect for the application, were present and sworn in.

Mr. Lundgren outlined the application.

Mr. Carlson gave a brief description about their house. They have been living in the neighborhood for over 5years. They have 4 children which require a bigger living space.

Mr. Wagner described the proposal for the applicant. The lot is undersized in the zone. The lot is 10,800sq ft which minimum size is 12,500 sq ft., the width is 90 feet wide which minimum size 100 feet wide and the depth is 120 deep which minimum size is 125 deep. The property is also in a steep slope location.

Ms. Branton asked about the site plan which shows a patio, whether the porch as proposed will be an open porch. Mr. Wagner responded yes.

Ms. Baltake asked what is directly behind the house. Mr. Wagner responded that it is a side yard of the house.

PUBLIC COMMENTS: Jackie Murrey
100 Gill Road

Mr. Murrey expressed her thoughts that the applicant had make a beautiful garden, they made a magnificent look for their house and thinks that it will not hurt Gill Road with the addition to their house.

Marcy Gallagher, neighbor across the street from the applicant.
She claimed that she did get feedback from the other neighbor and they all are in favor for the proposed project.

PUBLIC PORTION CLOSED:

Mr. Burns asked if there any drainage issues. Mr .Chelotti responded, yes along Heritage Road. Mr. Burns asked if this will create any impact on the addition proposed. Mr. Chelotti responded, no.

Mr. Cohn motion to approve application as presented. Mr. Mazur seconded the motion.

Ms. Branton commented on the house as a lovely place to live, the
hardships as well as the location having steep slope area.

Mr. Cohn commented about the undersized lot such as the width, depth
as well as shallow lot.

Board comments. Vote 5-1. APPROVED
Mr. Wondrasch opposed the application.

ZBA#06-50 510 Redman Ave
John Carney

The proposed front porch addition would encroach into the required side yard 2 feet proposing 8 feet when 10 feet is required. The proposed basement stair addition would encroach into the required side yard 9 feet proposing 1 feet when 10 feet is required.

Mr. Carney were present and sworn in.

Mr. Lungren outlined the application.

Mr. Carney gave a brief description of his application. He live across the street from school. He requested a Bilco door to access to the basement as a second exit.

PUBLIC COMMENTS: None

PUBLIC PORTION CLOSED:

Mr. Burns motion to approve application as presented. Ms. Baltake seconded the motion

Mr. Cohn commented on the Bilco as a classic hardship and the front porch is being encouraged for the application.

Mr. Walko asked applicant how are they planning to dig for the bilco door? Mr. Carney responded that he is not sure and is up to the contractor to determine when he digs for the Bilco Door.

Mr. Walko discussed on the changes from the previous application and other changes Mr. Carney made that did not require a variance.

Board comments. Vote 7-0. APPROVED

ZBA#06-51 376 Farwood Road
Marlene M.Forster

The proposed additions would encroach into the side yard setback of 10 feet by 1.7 feet creating a side yard of 8.3 feet and the addition encroach on the aggregate side yard setback of 25 feet by 1.6 feet creating a side yard of 23.4 feet. The rear addition will encroach into the 40 feet required rear yard by ˝ foot creating a rear yard of 39.5 feet.

Mr. & Mrs. Forster were present and sworn in.

Mr. Forster gave a brief description on the application which is a second floor addition that will continue the lines of the existing house on the right side. This caused the addition to encroach into the side yard setback.

Ms. Branton expressed her gratitude to the applicant for specifying the variance very clearly and the reason why the variance should be granted.

Ms. Baltake asked if this is going to be an investment property. Mr. Foster responded that they are not sure and have not decided on anything yet.

There was discussion of the benefits of continuing the side elevations of the building.

Ms. Baltake expressed her mixed feeling on the changes in the Fargo. Mr.
Foster explained that the 6000sq ft lot will not have elaborate houses.
Also, the cost of the houses are pretty high.

Mr. Wondrasch asked about the oversized lot with the setback issues.
Mr. Cohn responded that the setback is the garage as well as the 2nd
story encroachment.

Ms. Branton comment that she is fine with the 8.29 for the 2nd floor side yard line, the second variances 39.49 feet for the rear yard as well as the aggregate.

370 Farwood Road

He expressed his concerned that he did not want the addition to be any closer then the house is now.

Board comments. Vote 7-0. APPROVED

ZBA#06-52 109 Estaugh Road
Jacqueline Martin

The proposed addition would encroach into the side yard 1.4 feet proposing 6.6 feet when 8 feet is required. The addition would also encroach into the combined side yard setback of 20 by 2.2 feet proposing 17.8 feet. The addition would exceed the maximum building coverage of 30% by 8.6% proposing a building coverage 38.6%.

Mr. Foster the architect for the project was present and still under oath.

Ms. Martin were present and sworn in.

Ms. Martin gave a brief description on the application for the proposed addition of 14x24.

Mr. Burns asked about the earlier variance that was granted. Mrs. Martin responded that it was a 2 story renovation raising the roof which never done.

Mr. Foster gave brief description on the overall project.
Mr. Chelotti comment on small stormwater issues.

PUBLIC PORTION CLOSED:

Mr. Wondrasch motion to approve application as presented. Ms Baltake seconded the motion

Board member had a discussion for the overall.

Mr. Wondrasch commented that the only reason for the variance was because that the lot depth is undersized from other properties in the neighborhood.

Board comments. Vote 7-0. APPROVED

Board member discussed on the municipal code which written that the zoning board presenting a report to the planning board every year about general feedback and recommendation from the members.

Board members also discussed on the nominate committee as well of the visioning of the downtown.

Board members also requested records for any variance or impervious variance application granted from Mr. Walko.
