A regular meeting of the Board of Commissioners of the Borough of Haddonfield was held on the above date at 8:00 p.m. in room 102 of the Borough Hall, Haddonfield, New Jersey.

RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that the semi-monthly list of bills dated October 28, 2003 and submitted, are approved for payment and are available for public inspection in the Borough Clerk’s office:

2. Auth. to Pay School Taxes October 28, 2003

RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that ONE MILLION, TWO HUNDRED SIXTY SEVEN THOUSAND, THREE HUNDRED NINE DOLLARS AND NO CENTS ($1,267,309.00) be wired from the Current Account, payable to the account of the School District of Haddonfield to pay the fifth installment of the 2003-2004 School Year Tax.

The foregoing resolution was adopted by the following vote: Ayes, Commissioners Colombi, Reisner and Tarditi. Nays, none.
3. Auth. to Issue Check – Library Payment October 28, 2003

RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that a check be drawn on the Current Account in the amount of TWO THOUSAND, SIX HUNDRED NINETY FIVE DOLLARS AND NO CENTS ($2,695.00) to pay the balance due in the 2003 Budget for the Fourth Quarter Library Appropriation.

4. Auth. to Insert Special Item of Revenue – Recycling Grant October 28, 2003

WHEREAS, N.J.S.A. 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget; and

WHEREAS, said Director may also approve the insertion of an item of appropriation for equal amount, and

WHEREAS, the Borough of Haddonfield has received $6,950.18 from the N.J. Department Of The Treasury, Solid Waste Administration and wishes to amend its 2003 Budget to include this amount as revenue.

NOW THEREFORE, BE IT RESOLVED that the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, request the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2003 in the sum of $6,950.18 which is now available as a revenue from:

Balanced Housing Program

WHEREAS, N.J.S.A. 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget; and

WHEREAS, said Director may also approve the insertion of an item of appropriation for equal amount, and

WHEREAS, the Borough of Haddonfield has received $174,000.00 from the State of New Jersey, Balanced Housing Program, and wishes to amend its 2003 Budget to include this amount as revenue.

NOW THEREFORE, BE IT FURTHER RESOLVED that the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, request the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2003 in the sum of $174,000.00 which is now available as a revenue from:

Tatem Garden Park Enhancements

RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that the appropriate officials sign an Interlocal Services Agreement with the County of Camden, 520 Market Street, Camden, New Jersey 08102 which provides for funding in an amount not to exceed $25,000.00 for certain enhancements to the Tatem Garden Park per the recommendations of the Camden County Open Space Preservation Trust Fund Advisory Committee with respect to Round 4 Recreation Facility Enhancement Funding.

12. Auth. to Reject Bids – October 28, 2003
Recreational Improvements Program

WHEREAS, the Board of Commissioners of the Borough of Haddonfield, caused a notice to be published in the Retrospect inviting the submission to the Borough Clerk at the Borough Hall on Wednesday, October 8, 2003 at 10:00 a.m. of Sealed Bids for RECREATIONAL IMPROVEMENTS PROGRAM for the Borough of Haddonfield; and

WHEREAS, bids for a unit price contract were received with the bid calculation used only to determine the low bid as follows:

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:

1. The Bids submitted by the Bidders are hereby rejected.
2. The Borough Administrator is hereby directed to return any security deposits received from the Bidders in accordance with the terms of the Bid Documents.
3. This resolution shall take effect immediately.

Drainage Improvements at Parks

BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that the Borough Clerk is hereby authorized to advertise for the receipt of sealed bids for Drainage Improvements at Parks. The advertisement shall include a statement that all bids are to be received, either in person or by mail, no later than 10:00 a.m. on Friday, November 21, 2003 in Room 101 of Borough Hall, 242 Kings Highway East, Haddonfield, New Jersey and that the bid opening will begin at 10:00 a.m. promptly in Room 102 of Borough Hall.

GENERAL COMMENTS - Commissioners Meeting – October 28, 2003

Ted Raiczyk, 615 Wayne Ave., asked about a payment to Sherwood Fence Co. He was told that this in payment for work done behind the 65 Club, around Snowden Ave. and at Crows Woods. We are happy to receive a check from the State for $174,000.00 to be used to help pay for our Senior Citizen Housing.

Regarding the new member of the Fire Company, Commissioner Reisner said that we are blessed in this town with people who volunteer. We are happy to approve this application.

Mayor Colombi said that we are going to take another look at the Centennial Park area to see if we can find a way to improve the recreational facility and help the football players as well. We are asking for bids for drainage at Centennial and at the Green Acres field on Mt. Vernon Avenue.

The fourth graders from Elizabeth Haddon School were asked to introduce themselves. They were Holly Harrington, 103 Woodland Ave.; John Otto, 60 Trueman Ave.; Andrew Peric, 128 Homestead Ave.; Matthew Bhaya, 415 Euclid Ave.; Vincent DelDuca, 412 Bradshaw Ave.; Kaleb Morales, 41 Linden Ave. and Quinn Jacobs, 510 Westminster Ave. Andrew asked if we are making sure there are enough trees at Crows Woods and other wooded areas. He was told we buy and plant 120 to 130 new trees every year. Quinn said that in front of his house there is no curb. It is dangerous and it looks horrible. Mayor Colombi said that we are checking on what that costs and we will see what we can do about it.

Commissioner Tarditi said that the Halloween Parade will be Thursday night. Costumed children will be judged from 6:30 on at the Presbyterian Church. The parade will begin at 7:00 and will proceed to the back of Borough Hall. This is sponsored by the Haddonfield Celebrations Association and is funded by contributions. This group also does the Fourth of July Parade, the July 3 Fireworks, and the tree lighting ceremony on the Friday after Thanksgiving. Collections have not increased enough to make up for the additional costs of the fireworks.

Mayor Colombi said that she hoped all were at the unveiling of “Haddie” the dinosaur. She thanked all who participated and donated to this project. Commissioner Tarditi said it was a great community effort. Commissioner Reisner said that the eagle at the Library was the first art object in an outdoor public area in town.

Tim Rogers, 116 Park Place, thanked the Commissioners for taking another look at the tree issue at Centennial. He feels neighbors should be more involved in the process. Mayor Colombi said that tree roots are on top of the ground and are dangerous for people walking there. We want people to walk on the new sidewalk. We will probably have to go back to the engineers for a better plan. Mr. Rogers said that he and the neighbors have felt powerless. It would satisfy them if they had a little more input on those who make the decisions.

Mr. Raiczyk said that a few months ago we were going to re-bid fixing intersections. Administrator Schwab said that the low bidder backed out. The next bidder will probable start around the first of November. Walnut and E. Park will be done. There are about 13 intersections or areas to be fixed. Mr. Raiczyk asked about the lights in the parking lots. Public Service finally connected them in the Presbyterian lot. The remaining lights will be done in early spring. We will try to have some ready for the holiday shopping season.

Mark Swanson of the Retrospect presented an award for the recent Fire House Chili Cook-Off. Haddon Fire Co. #1 was awarded $300.00 for second place.

FIRST READING September 23, 2003

AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE #1720 KNOWN AS AN ORDINANCE REVISING THE TRAFFIC AND PARKING REGULATIONS WITHIN THE BOROUGH OF HADDONFIELD, COUNTY OF CAMDEN, STATE OF NEW JERSEY - OVERNIGHT PARKING
The Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, do ordain:
Section 1. That Article XIV - Overnight Parking of Ordinance #1720 Regulating the Traffic and Parking within the Borough of Haddonfield, County of Camden, State of New Jersey, be amended and supplemented to read as hereinafter provided.
ARTICLE XIV. OVERNIGHT PARKING.
A. No individual shall park a motor vehicle at any time on any street in the Borough of Haddonfield between the hours of two o’clock (2:00) a.m. and five o’clock (5:00) a.m. in the morning.
B. The Haddonfield Chief of Police, or the Chief’s designee, may approve exceptions to the above under certain circumstances as provided for below.
1. DEFINITIONS
Off-street parking is defined as a location where a vehicle parks on a legal driveway or parking area, which meets the standards set by the Borough Zoning office, behind the inside line of the sidewalk so as to not interfere with the flow of pedestrian traffic.
Insufficient off-street parking is defined as a situation on a property upon which a resident resides that has no off-street area in which a motor vehicle may be parked or the off-street area in which a motor vehicle may be parked is too small to accommodate the number of vehicles used by the residents.
2. PARKING PERMITS
The Chief is authorized to issue permits for overnight parking on Haddonfield streets and will make the determination whether the permit will be approved or denied according to this ordinance. The process is to be completed in a timely manner.
a. Permit Requirements
1) The situation must meet the definition of insufficient off-street parking.
2) The applicant must be a full-time resident of the property in question.
3) The applicant’s driver’s license must be valid.
4) The vehicle for which the permit is to apply to must be legally registered.
5) The vehicle must have a nexus to the property, as determined by the Chief, such as the vehicle’s registration is that of the property, or the principal driver of the vehicle is a resident of the property.
b. Application Process
1) When a resident believes there is insufficient off-street parking on their property, the resident may apply for a permit for overnight on-street parking.
2) An application form, as required by the Chief, must be obtained at the Haddonfield Police Station during regular business hours.
3) Upon receipt of a completed application form, a Police Department representative will visit the property in question and check to see that it fits the requirements of insufficient off-street parking as set forth in this ordinance.
4) The Chief will determine approval or denial. If the application is approved, the applicant will be notified by phone or mail to come to pick up their permit. If denied the Chief will provide a written explanation with the reason for the denial.
5) Approved permits may be obtained from the Police Department during normal business hours after payment of a fee of fifty dollars ($50.00) for each vehicle issued a permit. For permits issued on or after July 1st the fee is thirty dollars ($30.00).
c. Permit Display
1) It is the responsibility of the resident to place the permit in the correct location on the vehicle as specified by the Chief.
2) The permit is for the vehicle applied for and cannot be used on any other vehicle.
d. Permit Duration
1) The permit shall be valid until December 31st of the year in which it is issued.
2) It is the responsibility of the permit holder to renew the permit each year.
3) A permit is not valid unless renewed and the yearly fee is paid.
4) A permit is no longer valid if there is a change in any of the conditions on which the issuance of the permit was based.
e. Miscellaneous Provisions
1) A permit may be issued for another vehicle, at no cost, upon the surrender of an existing permit, if the vehicle is a valid replacement for the vehicle the permit was initially issued for, subject to the approval of the Chief.
2) No refunds will be issued for any unused period of time after the annual permit is issued.
3) The Chief is authorized to create and implement other necessary regulations to operate the permit program that are consistent with the provisions of this ordinance.
3. TEMPORARY OVERNIGHT PARKING PERMISSION
a. The Chief of Police shall have the authority to permit temporary overnight parking.
b. Temporary Parking permission for a single night may be obtained by a system set up by the Chief.
c. An individual may call and request single night temporary parking permission for up to seven (7) times per month.
d. Additional on-street parking permission for more than one night or more than seven times per month may be granted by the Chief or the Chief’s designee due to exceptional circumstances. 4. CONDITIONS OF ALL OVERNIGHT PARKING EXCEPTIONS
a. An overnight parking permit or the temporary overnight parking permission does not allow any vehicle to be parked in violation of any State laws or other Borough Ordinance.
b. The Chief may revoke these permits on a permanent or temporary basis when:
1) The needs of the Borough require that vehicles not be parked on a particular street for street cleaning, leaf removal, snow removal, road construction or repair, utility work, a public event or other appropriate government purpose.
2) The permit holder is in violation of any of the conditions that qualified that vehicle for a permit.
Section 2. All Ordinances or parts of Ordinances inconsistent with the amending ordinance be and are hereby repealed to the extent of such inconsistencies only.
Section 3. This ordinance shall become effective upon passage and publication in accordance with the law.

FIRST READING September 23, 2003

AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE #1830 ENTITLED “AN ORDINANCE REGULATING DOGS UNDER CERTAIN CIRCUMSTANCES IN THE BOROUGH OF HADDONFIELD, KNOWN AS ORDINANCE #773.”
The Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, does ordain as follows:

SECTION I:
Ordinance # 1830 of the Borough of Haddonfield, specifically Section II, paragraph “d.)” of such ordinance, is hereby amended to read as follows:
d.) The regulations for dogs in the Crows Woods Recreation area and Nature area, located at the end of Southeast Atlantic Avenue in the Borough of Haddonfield, are as follows:

1) Until 5:00 p.m. each Saturday and between the hours of 12:00 noon and 5:00 p.m. during all other days, dogs must be led by a chain, cord or leash in the hands of a person capable of controlling such dog, whether inside or outside of the wooded area, in compliance with the provisions of Section I of Ordinance #773 as amended by Ordinance #1830.
2) Not withstanding the provisions of Section I of Ordinance #773 as amended by Ordinance #1830, at all hours that the Crows Woods Recreation and Nature area is open to the public other than those listed in 1) above, licensed dogs are permitted to run at large within the wooded area of Crows Woods and nowhere else.
3) A person having possession, custody, control and/or ownership of a dog running at large in Crows Woods shall be present in the immediate area of Crows Woods when such dog is. Such person shall be responsible for compliance with all ordinances of the Borough of Haddonfield and shall be responsible for any damage or injury to any person and/or property.

SECTION II:
All ordinances or parts of ordinances inconsistent with this amending ordinance be and they are hereby repealed to the extent of such inconsistencies only.

SECTION III:
If any section or provision of this ordinance shall be held unconstitutional or invalid by any court, the remaining sections and provisions shall, notwithstanding such holding, remain and be in full force and effect.

SECTION IV:
This ordinance shall be in effect until January 14, 2004 after which time it shall be null and void and of no effect.

10. Auth. to Approve Feasibility Study – September 23, 2003

Special Improvement District
BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:
1. The Borough Commissioners may commence studies to determine whether a Special Improvement District should be created for the Business District of the Borough of Haddonfield.
2. The Borough Commissioners may create a Feasibility Study Committee as per N.J.S.A. 40:56-65, et. seq., of volunteer Haddonfield citizens and retail merchants to conduct the above referred to studies. The number of members of such Study Committee appointed by the Borough Commissioners shall not exceed 15 individuals, and shall serve at the pleasure of the Borough Commissioners.
3. The Borough Commissioners shall provide overall policy information to the Study Committee concerning the subject matter of the studies and the time limitations for reporting back to the Borough Commissioners.

11. Auth. to Impose a Moratorium on Ordinance #1830 – September 23, 2003

Regulating Dogs
WHEREAS, on January 14, 2003, Ordinance #1830 entitled “AN ORDINANCE REGULATING DOGS UNDER CERTAIN CIRCUMSTANCES IN THE BOROUGH OF HADDONFIELD, KNOWN AS ORDINANCE #773” was adopted to specifically regulate dogs at the Crows Woods Recreation area and Nature area, located at the end of Southeast Atlantic Avenue in the Borough of Haddonfield; and
WHEREAS, Haddonfield is reviewing Ordinance #1830 to evaluate whether to maintain or modify regulations dealing with dogs running at large in the wooded area of the Crows Woods and desires to provide a temporary change in such regulation, to be effective immediately, to permit a trial period to gather data prior to the expiration of Ordinance #1830 scheduled for January 14, 2004; and
WHEREAS, the Board of Commissioners deems it in the best interests of the Borough of Haddonfield to place an immediate moratorium of the provisions of Section II, paragraph d. of Ordinance # 1830 and to insert an alternate temporary regulation.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey as follows:
1. That a moratorium is hereby imposed on Section II, paragraph “d.)” of Ordinance # 1830 entitled “AN ORDINANCE REGULATING DOGS UNDER CERTAIN CIRCUMSTANCES IN THE BOROUGH OF HADDONFIELD, KNOWN AT ORDINANCE #773” which regulates dogs running at large in the wooded area of the Crows Woods Recreation area and Nature area, located at the end of Southeast Atlantic Avenue in the Borough of Haddonfield.
2. That new, temporary regulations for dogs in the wooded area of the Crows Woods Recreation area and Nature area be put in place immediately as follows:
a) Until 5:00 p.m. each Saturday and between the hours of 12:00 noon and 5:00 p.m. during all other days, dogs must be led by a chain, cord or leash in the hands of a person capable of controlling such dog, whether inside or outside of the wooded area, in compliance with the provisions of Section I of Ordinance #773 as amended by Ordinance #1830;
b) Not withstanding the provisions of Section I of Ordinance #773 as amended by Ordinance #1830, at all hours that the Crows Woods Recreation and Nature area is open to the public other than those listed in 1) above, licensed dogs are permitted to run at large within the wooded area of Crows Woods and nowhere else.
c) A person having possession, custody, control and/or ownership of a dog running at large in Crows Woods shall be present in the immediate area of Crows Woods when such dog is. Such person shall be responsible for compliance with all ordinances of the Borough of Haddonfield and shall be responsible for any damage or injury to any person and/or property.
3. This moratorium is for the purpose of evaluating the alternative regulations and expires and is of no legal affect on January 14, 2004.

PROCLAMATION

WHEREAS, now that School is in session, more children are walking to and from neighborhood schools, many of them during the busiest time of the day, the time when many motorists are rushing to work or heading home after a tiring day at work; and
WHEREAS, it is vital that the safety of our children be addressed by making walking safer in our community; and
WHEREAS, each year, an estimated 4,800 pedestrians are killed, one out of seven of those are children; and
WHEREAS, hundreds of children could be saved each year if every community takes steps to make pedestrian safety a priority; and
WHEREAS, parents and caregivers should teach children about pedestrian safety and become aware of the difficulties and dangers that children face on their trip to school each day; and
WHEREAS, community leaders and parents should determine the “walkability” of their community by using the Walkability Checklist; and
WHEREAS, everyone should make a plan to make immediate changes to increase the safety of children who are walking in our communities and a list of suggestions for improvements that can be done over time; and
WHEREAS, children, parents and community leaders are joining together nationwide to walk to school and evaluate pedestrian safety in their community.
NOW, THEREFORE, BE IT RESOLVED that we, the Board of Commissioners of the Borough of Haddonfield proclaim October 2, 2003 as
“Walk to School Day”
in Haddonfield, New Jersey and encourage everyone to consider the safety of pedestrians today and everyday.

GENERAL COMMENTS - Commissioners Meeting – September 23, 2003

Commissioner Tarditi discussed the amendment to the overnight parking regulations. This allows greater discretion by the Police Department for people who have more vehicles than they have off-street parking spaces. The overnight parking ban will still go from 2:00 a.m. to 5:00 a.m.
Mr. Tarditi gave background on the amendment to the Dog Ordinance. Before this, all dogs had to be leashed when not on their own property. It was requested that dogs be allowed to run loose in the wooded area of Crows Woods. The Borough permitted this on a temporary trial basis. This has been discussed by the Environmental Commission regarding the impact the dogs would have on this area. There have been concerns regarding safety, but very few actual incidents. There have been 3 or 4 meetings with the dog walkers and the Environmental Commission. We think this amendment is a reasonable compromise. This provides that dogs must be leashed up to 5:00 p.m. on Saturday and from noon to 5 p.m. on Sunday. Commissioner Reisner said that this is another test to see if this will work, trying to balance the needs of many citizens. The Commissioners need to be able to measure results.

Greg Derham, 339 Bellevue Ave., is President of C.O.L.A., the Citizens for Off Leash Animals. He appreciates the work and time spent by the Commissioners. He introduced Chris Barnes, an attorney who lives at 716 Cedar Ave, who will discuss some legal aspects and Susan Perry, an environmentalist. Mr. Barnes distributed his legal opinion. Greg also had spoken to some Boy Scouts who were working in the area. He suggested a possible assessment of $100.00 per year for the privilege of walking dogs in Crows Woods. The Boy Scouts could provide some labor for badges.

Chris Barnes has discusses liability with Mayor Colombi and feels that the Borough will not incur liability. We might be sued, but should not be found liable. Susan Perry, 331 Woodland Ave., has read the Environmental Commission proposal. They seem to be against dogs being off leash at any time. The Commission refers to Crows Woods as a nature area. Nature areas have to have a staff. Damage to the woods is caused by neglect. Trails are not maintained. Vandalism is a problem. Dogs are not responsible for this. The dog walkers help keep the area clean. The controversy has caused hard feelings among people in the area. The bridge was build by dog walkers. Mountain bikers and teenagers have caused more damage than anyone else.

William Noone is an environmentalist with a master degree. He feels that no species are endangered. Crows Woods is not a pristine nature center. Multiple use is desirable. Greg felt that the dog walkers had compromised on several items. He asked that all of Saturday not be banned. There was discussion of possible hours, and the darkness factor of approaching winter. Commissioner Tarditi said that the Commissioners have heard both sides. Our intent is to continue to monitor the situation. We appreciate the constructive discussion.
Ann Gaughan, 320 West End Ave., asked how we would know if this is a success or a failure. Mr. Tarditi said that one test will be to see if people pay attention to the signs. Karen Berman, 126 West Pine St. Audubon, asked why this was being considered now.
Commissioner Reisner said that it was never allowed before. Michael Gross, Euclid Ave. said that he came to this late. He asked why there is an issue when so many people want it. Mr. Reisner said that some don’t want it. Sue Derham, 339 Bellevue, mentioned a bequest specifically for a pavilion at Crows Woods. Irene Basso, 612 Pardee Lane and Robin Robb, 35 Centre St., contributed to the discussion.
Harley Williams, 418 Washington Ave., said that the test seems to be (1) will the dog walkers obey the rules and (2) is the statement that people are staying out of the woods because of fear really true. Mr. Jan Sterling, 44 Birchall Dr., suggested a fence be installed 10 feet into the woods. Bonnie Edwards, 106 Washington Ave., said that the vehemence of the Environmental Commission concerns her. She is a dog trainer and most people do not have property large enough to let their dogs run any distance. She would be willing to pay for the privilege. Dierdre Justice, 345 E. Park Ave., is in favor of letting dogs run in the woods. Ed Pemberthy, 430 Pelham Rd., suggested Monday, Wednesday and Friday for one group and Tuesday and Thursday for another. Commissioner Reisner said that we do not want to make the regulations too complicated. Stella Bacella, 103 Centre St., asked that Saturday morning be considered as open time. The introduction of the Amendment then passed on First Reading.

Administrator Schwab described the work to be done at the Mabel Kay House and the Senior Services Building. It was announced that the Business Development Task Force has recommended a Business Improvement District. Some years ago a Special Improvement District was defeated after the Commissioners set it up. We are designating the task force as a “Feasibility Study Committee.”
Mrs. Lane, Cedar Ave., asked about the trees in the back of the properties that back onto the drainage easement. The Borough Engineer is to report to the Commissioners, then the neighbors will be invited to hear the presentation. She was concerned that nobody came to check the situation when we had many days of warning before “Isabel.” Commissioner Reisner said that steps were taken for the general safety of the town.

Ted Raiczyk, 615 Wayne Ave., asked if the Borough is covered by insurance for storms. We are not. Commissioner Tarditi said that it cost approximately $70,000 for the clean up efforts. This comes from the Budget.Janet G. Betley

PROCLAMATION
September 19, 2003

In a proclamation for NATIONAL POW\MIA RECOGNITION DAY the President of the United States of America reminds us that since our country's birth, Americans have responded to military threats against liberty and democracy, whether at home or in remote areas of the world. The young men and women of our Armed Forces understand the need to resist oppression and they have willingly put themselves in harm's way around the globe to do so. Those young Americans, including those from Haddonfield, who stand in the defense of freedom, are our country's most precious natural resource.

It is particularly painful when these brave Americans are made Prisoners of War, or are classified as Missing in Action. They have earned our deep appreciation and respect for the great sacrifices they have made so that all of us can continue to enjoy the privileges of liberty. In keeping faith with them, we continue our concerted efforts to determine the fate of all those who are unaccounted for and to bring home the remains of those who have perished.

Haddonfield, in particular, remembers USAF Capt. Ronald L. Bond, a 1965 graduate of Haddonfield Memorial High School. Capt. Bond failed to return from a mission over Laos in Southeast Asia on September 30, 1971 where, on that day, he served as the navigator in an F-4 Fighter Bomber. Capt. Bond's parents Mr. & Mrs. Errol Q. Bond., Sr., now living in California, have never given up their faith that their son is still alive.

The grief for our prisoners of war and those missing in action is most intense, of course, among their families and loved ones at home, who wait-often for years, and sometimes in vain-for confirmation of their fate. These families display their own courage too, by their endurance in the face of deep anxiety. Their cause is our cause, and we pledge ourselves to them anew on this special day.
On September 19, 2003 the United States flag will be displayed throughout the center of Haddonfield in recognition of those American Prisoners of War and Missing in Southeast Asia as Haddonfield's part in a nationwide effort to remind all Americans of the significance of this day. In Haddonfield, there is a deeper personal meaning as the family of Capt. Bond is in our thoughts and prayers.
NOW, THEREFORE, BE IT RESOLVED that we, the Board of Commissioners of the Borough of Haddonfield do hereby proclaim September 19, 2003 as

in the Borough of Haddonfield. GENERAL COMMENTS - Commissioners Meeting – September 9, 2003

Ted Raiczyk, 615 Wayne Ave., asked about a payment to MicroData. Administrator Schwab said that this was for equipment at the Water Plant.

Regarding park improvements, it was announced that a recreation survey was done two years ago. Some changes were recommended for our fields. Work will be done at Green Acres, Centennial and Crows Woods. We will do some work at Reillywood if we have any money left. Neal Rochford, 74 Birchall Drive, asked how much we plan to spend. He was told that we can use about $150,000 for these projects this year. Mayor Colombi said that some of the work has been done at Centennial in connection with the Lincoln Avenue paving project.
Mayor Colombi announced that sportscaster Bruce Casella will be opening Casella’s Pizza shop in the store formerly known as Peace O’ Pizza. She welcomed him to the Haddonfield commercial family.

Regarding appointments, Mr. Schwab explained that these were to fill slots left vacant when Debra Fourre left. She will become the Administrator in Gloucester City. We wish her success in her new position.

Commissioner Tarditi announced that on Thursday, September 11, we will lower the flags in front of Borough Hall at 8:46 a.m., the time that the first plane hit the World Trade Center.

The Borough Calendars have been mailed out. The committee was congratulated for another fine job.

Rosalie Shapiro was introduced. She is chairman of the Downtown Works Committee. Her husband Phil is helping out, along with Lisa Hurd, our Retail Coordinator. They presented a press release to be issued soon. We are grateful for the work done by all three of these fine people.
Commissioner Reisner congratulated the Police Department on their handling of the Mopsy caper. Mr. Reisner bailed her out soon after she was apprehended.

Commissioner Tarditi announced that on Saturday, September 13, the Antique Auto Show will take place. Registration is from 9 to 11. Judging will begin at 11:00 a.m. for the award of the Mayor’s Trophy. Kings Highway will be closed from the Speedline to Haddon Avenue. There will also be a Pancake Breakfast that morning at the Baptist Church sponsored by the Lions Club. All are invited.

Mayor Colombi asked all to look at the improvements to Lantern Lane. The dinosaur is due to be delivered after October 11 for the unveiling during the Fall Festival at 1:00 p.m. on October 18. She thanked the Garden Club and the Hatch Committee for their fund raising efforts.
Mayor Colombi said that leaf season bill begin the second week of October. Leaves will be picked up on the same day as trash day in the various areas.

Southern New Jersey Regional Employee Benefits Fund
WHEREAS, a number of public entities in the State of New Jersey have joined together to form the Southern New Jersey Regional Employee Benefits Fund, hereafter referred to as “FUND,” as permitted by N.J.S.A. 11:15-3, 17:1-8.1, and 40A:10-36 et seq.; and
WHEREAS, the FUND was approved to become operational by the Departments of Insurance and Community Affairs and has been operational since that date; and
WHEREAS, the statutes and regulations governing the creation and operation of a joint insurance fund, contain certain elaborate restrictions and safeguards concerning the safe and efficient administration of the public interest entrusted to such a FUND; and
WHEREAS, the governing body of the Borough of Haddonfield, hereinafter referred to as “LOCAL UNIT” has determined that membership in the FUND is in the best interest of the LOCAL UNIT.
NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, hereby agrees as follows:
1. Become a member of the FUND for the period outlined in the LOCAL UNIT’s Indemnity and Trust Agreements.
2. Will participate in the following type(s) of coverage(s):
a. Health Insurance as defined pursuant to N.J.S.A. 17B:17-4, the FUND’s Bylaws, and Plan of Risk Management.
3. Adopts and approves the FUND’s Bylaws.
4. Execute an application for membership and any accompanying certifications.
BE IT FURTHER RESOLVED that the governing body of the LOCAL UNIT is authorized and directed to execute the Indemnity and Trust Agreement and such other documents signifying membership in the FUND as required by the FUND’s Bylaws, and to deliver these documents to the FUND’s Executive Director with the express reservation that these documents shall become effective only upon:
1. Approval of the LOCAL UNIT by the FUND.
2. Receipt from the LOCAL UNIT of a Resolution accepting assessment.

WHEREAS, the Board of Commissioners of Borough of Haddonfield deems it in the best interest of its citizens to encourage organized festivals; and
WHEREAS, the Haddonfield Business and Professional Association (HBPA) and the Ankokas Antique Auto Club wish to sponsor an “Antique Auto Show” on Saturday, September 13, 2003 from 11:00 a.m. to 4:00 p.m. on Kings Highway (rain date, Sunday, September 14, 2003 from 12:00 noon to 5:00 p.m.).
NOW, THEREFORE BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:
1. The closing of Kings Highway from Haddon Avenue to PATCO is hereby authorized from 8:00 a.m. through 5:00 p.m. on Saturday, September 13, 2003 (rain date, Sunday, September 14, 2003, 10:00 a.m. to 6:00 p.m.) for the display of antique autos at locations specified by the Ankokas Antique Auto Club for the “Antique Auto Show.”
2. Permission is hereby granted to organizations designated by the Haddonfield Business and Professional Association (HBPA) to utilize specific locations on Kings Highway, as well as sidewalks and other public property as designated by the HBPA within the commercial district in the Borough of Haddonfield to display quality antiques for sale as part of the “Antique Auto Show.”
3. No other store or purveyor is permitted to display goods for sale outside of any store within the public right of way, except as part of an approved merchandise display per Ordinance #1742.

WHEREAS, Borough of Haddonfield deems it in the best interest of its citizens to encourage organized festivals to raise funds for charitable organizations and provide positive activities in the Borough’s commercial district; and
WHEREAS, the Haddonfield Activities Committee has been appointed to promote a Fall Festival Day on Saturday, October 18, 2003 from 10:00 a.m. to 5:00 p.m. (rain date Sunday, October 19, 2003 from 12:00 noon to 5:00 p.m.) within the commercial district of the Borough of Haddonfield;

NOW, THEREFORE BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden and State of New Jersey, as follows:

1. Permission is hereby granted to charitable organizations to utilize the public sidewalks and other public property within the commercial district in the Borough of Haddonfield to display goods, wares and foods, etc. for sale as part of Haddonfield’s Fall Festival Day.

2. During the Fall Festival various food purveyors in the commercial district are hereby given permission to display and sell food on the sidewalks in the front of their stores or shops and food purveyors in Haddonfield whose shops or stores are not on Kings Highway in the Commercial District may sell food as determined by the Haddonfield Activities Committee at locations designated by the representative of the Committee.

3. Food sales shall observe all applicable health rules.
4. The representative designated by the Haddonfield Activities Committee is hereby authorized to regulate the participation of entities, organizations, persons, etc. in the Fall Festival Day including the issuing of Permits (at a modest fee), and the assigning of specific locations for groups, activities and food sales by Haddonfield food purveyors.
5. To provide financial support for the Fall Festival, the committee representative is also authorized to permit sales booths of crafters in the assigned area at assigned locations for an appropriate fee.
6. No other entity, store or vendor is permitted to sell or display their wares outside in the commercial district during this time except those with specific permits to do so as allowed by Ordinance #1742

WHEREAS, the Borough of Haddonfield has received an application from Select Real Estate, L.L.C. for a water and sanitary sewer extension for the Willits Court Townhouse Complex; and
WHEREAS, the sewer extension requires a permit from the New Jersey Department of Environmental Protection and endorsement by the Camden County Municipal Utilities Authority.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners, Borough of Haddonfield, County of Camden, State of New Jersey, as follows:
1. The plans for the project prepared by Bach Associates, PC are hereby approved.
2. The Board of Commissioners of the Borough of Haddonfield authorizes the submittal of the application to the Camden County Municipal Utilities Authority for their endorsement.
3. The Board of Commissioners authorizes the submittal of the application to the New Jersey Department of Environmental Protection along with the plans and specifications and any other exhibits required.
4. The Board of Commissioners authorizes Joseph Keating, Director of Utilities for the Borough to sign the application on behalf of the Borough.

9. Auth to Use Sidewalks August 26, 2003

WHEREAS, the businesses listed below have been granted conditional use for outdoor restaurant purposes by resolution of the Haddonfield Planning or Zoning Board, based on certain conditions and obligations imposed on the applicants; and
WHEREAS, permission is needed from the Borough of Haddonfield in that, the activities in question will be conducted upon public sidewalks.

NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:

1. GENERAL COMMENTS - Commissioners Meeting – August 26, 2003

Joe Haro, 29 Evergreen Lane, said that it has been known for a long time that air conditioners could not be placed in front of buildings, or on the side when visible from the street. He is disappointed that the Borough has placed an air conditioning unit in front of Borough Hall. Administrator Schwab said that we are trying to find an alternative location. We thought it would be smaller and could be put in the window well.

Ted Raiczyk, 615 Wayne Ave., said that last week he got a notice at his home regarding the cutting of trees touching wires. Mr. Schwab said that Public Works Superintendent Howard Frazier and our Shade Tree Commission have discussed this with Public Service. They sometimes butcher our trees. Solicitor Iavicoli said that he had also received a similar notice. Residents should call the Public Works Department if they have questions.
