An Ordinance by Mrs. Colombi:
SECOND READING December 23, 2002

BOND ORDINANCE OF THE BOROUGH OF HADDONFIELD, COUNTY OF CAMDEN, STATE OF NEW JERSEY, FOR AN APPROPRIATION IN THE AMOUNT OF $60,000 FOR SUPPLEMENTAL IMPROVEMENTS FOR CONSTRUCTION OF NEW LIBRARY AND RELATED ITEMS AUTHORIZING THE ISSUANCE OF $57,000 FOR BOND ANTICIPATION NOTES OF THE BOROUGH OF HADDONFIELD FOR SAID PROJECT.

BE IT ORDAINED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, (not less than two thirds of the full membership thereof affirmatively concurring), as follows:

Section 1: There is hereby authorized the expenditure of the sum of $60,000 for Additional library improvements and related Items for the Borough of Haddonfield, in the County of Camden, New Jersey. There is hereby appropriated the sum of $60,000 said sum being inclusive of all appropriations theretofore made and $3,000 as down payment for said improvements. A down payment of $3,000 is hereby appropriated from the Capital Improvement Fund.

Section 2: For the financing of said project and to meet the part of said $3,000 appropriation not provided for by application hereunder of said down payment, negotiable bonds of the Borough are hereby authorized to be issued in the principal amount of $57,000 pursuant to the Local Bond Law of New Jersey. In anticipation of the issuance of said bonds and to temporarily finance said improvements or purposes, negotiable notes of the Borough in a principal amount not exceeding $57,000 are hereby authorized to be issued pursuant to and within the limitations prescribed by law. The rate of interest, which any of said obligations shall bear, shall be the maximum then permitted by law.

Section 3:
(A) The improvements hereby authorized to be performed and the purpose for financing of which said obligations are to be issued is for improvements to the Haddonfield Public Library and related items, for the Borough of Haddonfield.
(B) The estimated maximum amount of bonds and notes to be issued for said purpose is $57,000.
(C) The estimated maximum amount of money to be raised from all sources for said purpose is $60,000 which total is over the said amount of bonds or notes to be issued, and includes the amount of $3,000 as down payment for said purpose.

Section 4: All bond anticipation notes issued hereunder shall mature at such times as may be determined by the chief financial officer; provided that no note shall mature later than one year from its date. The notes shall bear interest at such rate or rates and be in such form as may be determined by the chief financial officer. The chief financial officer shall determine all matters in connection with notes issued pursuant to this bond ordinance, and the chief financial officer’s signature upon the notes shall be conclusive evidence as to all such determinations. All notes issued hereunder may be renewed from time to time subject to the provisions of N.J.S.A. 40A2-8(a). The chief financial officer is hereby authorized to sell part or all of the notes from time to time, at not less than par and accrued interest, at public or private sale and to deliver them to the purchasers thereof upon receipt of payment of the purchase price plus accrued interest from their dates to the date of delivery thereof. The chief financial officer is directed to report in writing to the governing body at the meeting next succeeding the date when any sale or delivery of the notes pursuant to this bond ordinance is made. Such report must include the amount, the description, the interest rate and the maturity schedule of the notes sold, the price obtained and the name of the purchaser

Section 5: The following additional matters are hereby determined, declared, and recited and stated:
(A) The said purpose described in Section 3 of this bond ordinance is not a current expense and is an improvement which the Borough of Haddonfield may lawfully make as a general improvement and no part of the cost thereof has been or shall be specially assessed on property specially benefited thereby.

(B) The period of usefulness of said improvement with the limitation of said Local Bond Law and according to the reasonable life thereof is Thirty (30) years.

(C) The Supplemental Debt Statement required by said law has been duly made and filed in the Office of the Borough Clerk and a completely executed original thereof has been filed in the office of the Director of the Division of Local Government Services of the State of New Jersey, and such statement shows that the gross debt of the Borough as defined in Section 40A:2-43 of said law is increased by this Ordinance in the amount of $57,000 and will be within all debt limitations prescribed by law.

(D) An amount not exceeding $3,000 in the aggregate for items of expense permitted under N.J.S.A. 40A:2-20 of said Local Bond Law have been included in the foregoing estimate of costs of said improvement or purpose.

(E) The Borough reasonably expects to commence acquisition and/or construction of the improvements or purposes described in Section 3 hereof, and to advance all or a portion of the costs in respect thereof, prior to the issuance of bonds or notes hereunder. To the extent such costs are advanced, the Township further reasonably expects to reimburse such expenditures from the proceeds of the bonds or notes authorized by this bond ordinance, in an aggregate amount not to exceed the amount of bonds or notes authorized in Section 2 hereof.

Section 6: The capital budget is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency therewith and the resolutions promulgated by the Local Finance Board showing full detail for the amended capital budget and capital improvement program as approved by the Director, Division of Local Government Services, are on file with the Borough Clerk and are available for public inspection.

Section 7: The full faith and credit of the Borough are hereby pledged to the punctual payment of the principal and interest on the said obligations authorized by this Ordinance. Said obligations shall be direct, unlimited obligations of the Borough, and the Borough shall be obligated to levy ad valorem taxes upon all the taxable property within the Borough for the payment of said obligations and interest thereon, without limitations of rate or amount.

Section 8: This bond ordinance shall take effect twenty (20) days after its final passage and publication as required by law.

AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE #1826 KNOWN AS AN ORDINANCE ESTABLISHING THE SCHEDULE OF SALARIES AND WAGES FOR PUBLIC WORKS EMPLOYEES TO BE PAID BY THE BOROUGH OF HADDONFIELD, COMMENCING ON THE FIRST PAY DATE IN JANUARY 2002.

AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE #773 REGULATING THE RUNNING AT LARGE OF DOGS IN THE BOROUGH OF HADDONFIELD, ET AL

The Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, does ordain the following:

SECTION I:
The title of this ordinance is hereby amended and shall be entitled, “An Ordinance Regulating Dogs Under Certain Circumstances in the Borough of Haddonfield, known as Ordinance #773.”

SECTION II:
Ordinance #773 of the Borough of Haddonfield, specifically Section 1 of such ordinance is hereby amended to read as follows:

a.) Any person having possession, custody, control, and/or ownership of any dog shall not permit such dog to run at large upon the public streets and/or public property of the Borough of Haddonfield and/or the public property of the Haddonfield Board of Education.
b.) A dog shall be led by chain, cord, or leash in the hands of a person capable of controlling such dog when such dog is walking upon the public streets and/or public property of the Borough of Haddonfield, and/or the public property of the Haddonfield Board of Education.
c.) Dogs may be permitted to be confined in an automobile which is upon a public street or public property of the Borough of Haddonfield and/or the public property of the Haddonfield Board of Education.
d.) Not withstanding the provisions of this section of this ordinance, licensed dogs are permitted to run at large within the wooded area of Crow’s Woods which is located at the end of Southeast Atlantic Avenue in the Borough of Haddonfield. A person having possession, custody, control, and/or ownership of such dog shall be present in the immediate area of Crow’s Woods when such dog is running at large in Crow’s Woods. Such person shall be responsible for compliance with all ordinances of the Borough of Haddonfield and shall be responsible for any damage or injury to any person and/or property.

SECTION III:
All Ordinances or parts of ordinances inconsistent with this amending ordinance be and they are hereby repealed to the extent of such inconsistencies only.

SECTION IV:
If any section or provision of this ordinance shall be held unconstitutional or invalid by any court, the remaining sections and provisions shall, notwithstanding such holding, remain and be in full force and effect.

SECTION V:
This ordinance shall take effect immediately upon its publication after final passage as required by law.

SECTION VI:
This ordinance shall be in effect for a period of one (1) year from the date of adoption, after which time it shall be null and void and of no effect.

7. Auth. to Make Joint Insurance Fund Appointments December 23, 2002

WHEREAS, the Borough of Haddonfield has joined the Camden County Municipal Joint Insurance Fund, a self/excess insured fund, following a detailed analysis; and
WHEREAS, by the bylaws of said Fund require that each Municipality appoint a RISK MANAGEMENT CONSULTANT to perform various professional services as detailed in the bylaws; and
WHEREAS, the bylaws indicate a minimum fee equal to six percent (6%) reasonable compensation for the services required and was included in the cost considered by the Borough Commissioners; and
WHEREAS, the nature of Risk Management Consultant’s duties renders competitive bidding impractical;
NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of the Borough of Haddonfield does hereby appoint Henry D. Bean and Sons, Inc. as its Risk Management Consultant for the Calendar Year 2003 in accordance with N.J.S.A. 40A:11-5;
BE IT FURTHER RESOLVED that the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, does hereby appoint John J. Tarditi, Jr. as its Fund Commissioner and John H. Reisner, III for Alternate Fund Commissioner for the Camden County Municipal Joint Insurance Fund for the Year 2003.

8. Auth. to Hold Fireworks Display December 23, 2002

WHEREAS, an application has been made by the Haddonfield Cultural Events Commission for a permit to allow Pyrotechnico, P.O. Box 149, New Castle, PA 16103 to provide a public display of fireworks as part of the Borough’s First Night Celebration; and
WHEREAS, per State Statute, the Borough’s Chiefs of Police and Fire Departments have approved said application and the required insurance has been provided.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that a permit be and is hereby granted to the said Haddonfield Cultural Events Commission for the public display of fireworks by the said Commission on Chestnut Street at Kings Highway East in the said Borough on December 31, 2002 between the hours of 8:45 p.m. and 9:15 p.m. and on January 1, 2003 between the hours of 12:00 a.m. and 12:30 a.m. Eastern Standard Time, subject to and in accordance with the statutes of the State of New Jersey.
BE IT FURTHER RESOLVED, that a copy of said application and permit be forwarded by the Clerk of said Borough to the Office of Safety Compliance of the Department of Labor of the State of New Jersey.

9. Auth. to Award Contract for Police Vehicle December 23, 2002

WHEREAS, the Borough of Haddonfield, pursuant to N.J.S.A. 40A:11-12, may purchase goods or services under state contract without advertising for bids, based on the premise that the State of New Jersey has undergone the public advertising requirements on behalf of contracting units within the state, and has identified the lowest responsible, responsive bidder for specified goods and services, and
WHEREAS, a 2003 Ford Crown Victoria Police Car is available for $20,058.00 from Winner Ford, 250 Haddonfield-Berlin Road, Cherry Hill, under State Contract #A45069.
NOW, THEREFORE BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:

1. That Winner Ford, 250 Haddonfield-Berlin Road, Cherry Hill, New Jersey 08034, under State Contract #A45069, is offering a 2003 Crown Victoria for $20,058.00.
2. That the Chief Financial Officer of the Borough has certified that the funds will be available legally in Account #01-113-13 (Police Other Expenses, Vehicle Lease/Purchase).
3. That the proper officer or officers of the Borough of Haddonfield be, and they are authorized and directed for and in the name of said Borough, to execute a contract with the above listed vendor for contract amounts specified in the bids.

GENERAL COMMENTS - Commissioners Meeting – December 23, 2002

Commissioner Reisner explained that the Bond Anticipation Note is for the balance of the architect’s fees for the addition to the Library. The Salary Ordinance amendment is to clear up some language not in the contract.

The Ordinance regarding dogs will have a “sunset clause” and will be reviewed next year. We will again allow dogs to run at large at Crows Woods in the wooded area only. After we provided for this last year we received nineteen letters in favor of the policy and only one opposed. Mayor Colombi introduced Ed Poynton, the caretaker at Crows Woods. He has asked for more authority to stop people who let their dogs run on the playing fields. It was stressed that the only place dogs should run without a lease is in the wooded part of Crows Woods.

Regarding the appointments, it was noted that Debra Fourre will be our new Deputy Borough Clerk. Ms. Fourre is the Assistant to Administrator Schwab and had passed all of the courses required for Borough Clerk.

It was noted that we have received a check for around $55,000 as a dividend from our insurance premiums for our membership in the Joint Insurance Fund. The J.I.F. has been very beneficial to the Borough since we joined with other towns many years ago.

Commissioner Tarditi thanked the Police Department and the Fire Department for their cooperation for the First Night fireworks and for all their extra work over the holiday season.

Mayor Colombi reported on the leaf collection program. The weather put us behind schedule, but we have completed one cycle and are working to complete the town again. The leaf crews will work all day December 24 instead of a half day to try to catch up. The delays this year had nothing to do with our people. The rains made the leaves heavier and then the snow covered them and our drivers had to be used to plow snow. We won’t stop until they are all picked up.

For First Night this year there are twenty-two different venues with great entertainment. The Middle School is open this year so acts that draw the biggest crowds will be there.

Ted Raiczyk, 615 Wayne Ave., mentioned a large pile of leaves on Euclid Avenue. He also discussed a nasty article in the paper regarding Potter Street. Chief Tsonis said that we are monitoring this area to support claims of volume and speed. Mr. Raiczyk wished the Commissioners and the staff a Merry Christmas and a Happy New Year and said that he thinks we all do a good job.

FIRST READING December 10, 2002

BOND ORDINANCE OF THE BOROUGH OF HADDONFIELD, COUNTY OF CAMDEN, STATE OF NEW JERSEY, FOR AN APPROPRIATION IN THE AMOUNT OF $60,000 FOR SUPPLEMENTAL IMPROVEMENTS FOR CONSTRUCTION OF NEW LIBRARY AND RELATED ITEMS AUTHORIZING THE ISSUANCE OF $57,000 FOR BOND ANTICIPATION NOTES OF THE BOROUGH OF HADDONFIELD FOR SAID PROJECT.

BE IT ORDAINED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, (not less than two thirds of the full membership thereof affirmatively concurring), as follows:
Section 1: There is hereby authorized the expenditure of the sum of $60,000 for Additional library improvements and related Items for the Borough of Haddonfield, in the County of Camden, New Jersey. There is hereby appropriated the sum of $60,000 said sum being inclusive of all appropriations theretofore made and $3,000 as down payment for said improvements. A down payment of $3,000 is hereby appropriated from the Capital Improvement Fund.
Section 2: For the financing of said project and to meet the part of said $3,000 appropriation not provided for by application hereunder of said down payment, negotiable bonds of the Borough are hereby authorized to be issued in the principal amount of $57,000 pursuant to the Local Bond Law of New Jersey. In anticipation of the issuance of said bonds and to temporarily finance said improvements or purposes, negotiable notes of the Borough in a principal amount not exceeding $57,000 are hereby authorized to be issued pursuant to and within the limitations prescribed by law. The rate of interest, which any of said obligations shall bear, shall be the maximum then permitted by law.

Section 3:
(A) The improvements hereby authorized to be performed and the purpose for financing of which said obligations are to be issued is for improvements to the Haddonfield Public Library and related items, for the Borough of Haddonfield.
(B) The estimated maximum amount of bonds and notes to be issued for said purpose is $57,000.
(C) The estimated maximum amount of money to be raised from all sources for said purpose is $60,000 which total is over the said amount of bonds or notes to be issued, and includes the amount of $3,000 as down payment for said purpose.

Section 4: All bond anticipation notes issued hereunder shall mature at such times as may be determined by the chief financial officer; provided that no note shall mature later than one year from its date. The notes shall bear interest at such rate or rates and be in such form as may be determined by the chief financial officer. The chief financial officer shall determine all matters in connection with notes issued pursuant to this bond ordinance, and the chief financial officer’s signature upon the notes shall be conclusive evidence as to all such determinations. All notes issued hereunder may be renewed from time to time subject to the provisions of N.J.S.A. 40A2-8(a). The chief financial officer is hereby authorized to sell part or all of the notes from time to time, at not less than par and accrued interest, at public or private sale and to deliver them to the purchasers thereof upon receipt of payment of the purchase price plus accrued interest from their dates to the date of delivery thereof. The chief financial officer is directed to report in writing to the governing body at the meeting next succeeding the date when any sale or delivery of the notes pursuant to this bond ordinance is made. Such report must include the amount, the description, the interest rate and the maturity schedule of the notes sold, the price obtained and the name of the purchaser

Section 5: The following additional matters are hereby determined, declared, and recited and stated:
(A) The said purpose described in Section 3 of this bond ordinance is not a current expense and is an improvement which the Borough of Haddonfield may lawfully make as a general improvement and no part of the cost thereof has been or shall be specially assessed on property specially benefited thereby.

(B) The period of usefulness of said improvement with the limitation of said Local Bond Law and according to the reasonable life thereof is Thirty (30) years.

(C) The Supplemental Debt Statement required by said law has been duly made and filed in the Office of the Borough Clerk and a completely executed original thereof has been filed in the office of the Director of the Division of Local Government Services of the State of New Jersey, and such statement shows that the gross debt of the Borough as defined in Section 40A:2-43 of said law is increased by this Ordinance in the amount of $57,000 and will be within all debt limitations prescribed by law.

(D) An amount not exceeding $3,000 in the aggregate for items of expense permitted under N.J.S.A. 40A:2-20 of said Local Bond Law have been included in the foregoing estimate of costs of said improvement or purpose.

(E) The Borough reasonably expects to commence acquisition and/or construction of the improvements or purposes described in Section 3 hereof, and to advance all or a portion of the costs in respect thereof, prior to the issuance of bonds or notes hereunder. To the extent such costs are advanced, the Township further reasonably expects to reimburse such expenditures from the proceeds of the bonds or notes authorized by this bond ordinance, in an aggregate amount not to exceed the amount of bonds or notes authorized in Section 2 hereof.

Section 6: The capital budget is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency therewith and the resolutions promulgated by the Local Finance Board showing full detail for the amended capital budget and capital improvement program as approved by the Director, Division of Local Government Services, are on file with the Borough Clerk and are available for public inspection.
Section 7: The full faith and credit of the Borough are hereby pledged to the punctual payment of the principal and interest on the said obligations authorized by this Ordinance. Said obligations shall be direct, unlimited obligations of the Borough, and the Borough shall be obligated to levy ad valorem taxes upon all the taxable property within the Borough for the payment of said obligations and interest thereon, without limitations of rate or amount.

Section 8: This bond ordinance shall take effect twenty (20) days after its final passage and publication as required by law.

3. Auth. to Award Contract for Animal Control Services December 10, 2002

RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that the appropriate officials are authorized to sign an agreement with Superior Animal Control of Westmont, 21 East Albertson Avenue, Westmont, NJ 08108 to provide services as the Borough’s Animal Control Officer effective January 1, 2003 through December 31, 2003 at a rate of $534.37 per month.

4. Auth. for Employee Gifts December 10, 2002
WHEREAS, the employees of the Borough of Haddonfield have during 2002 performed their duties in a very commendable manner.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that said regular full time employees be rewarded for their meritorious service through a program wherein each will receive a Twenty Five Dollar Holiday Gift Certificate valid at numerous Haddonfield Business and Professional Association member organizations or at Acme Markets, Inc.

5. Auth. to Amend Collective Bargaining Agreement – December 10, 2002
Teamsters No. 676

WHEREAS, on August 13, 2002, the Board of Commissioners of the Borough of Haddonfield authorized the proper Borough Officials to execute a Collective Bargaining Agreement with Teamsters Local No. 676 for the period of January 1, 2002 up to and including March 31, 2006; and

WHEREAS, it has been determined that through error or misunderstanding, certain changes were not made to items in Article 27 involving rates for Advanced Water Plant Operator/Mechanic Helper – Full time, and the number of required years of service for the top longevity step so that those sections of the Arcticle read as attached.

NOW, THEREFORE, BE IT RESOLVED, that the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, authorize the proper officials of the Borough to execute a document to amend the Collective Bargaining Agreement with Teamsters Local No. 676, as described above.

6. Auth. to Cancel Bid Award – Lane of Acres December 10, 2002

WHEREAS, the Board of Commissioners of the Borough of Haddonfield authorized award of a contract to Bud Concrete for Lane of Acres Concrete Swale and Roadway Improvements in the amount of $22,570 at their meeting on July 23, 2002; and

WHEREAS, at the time of award, Borough officials were in the process of finalizing negotiations with the affected property owners concerning easements across their property to permit the project; and

WHEREAS, easements were not agreed to by property owners and therefore the project could not proceed; and
WHEREAS, Bud Concrete has agreed to the cancellation of the bid award but has indicated that there have been costs incurred with preparing the bid and other tasks associated with preparing for said contract in the amount of $500.

NOW, THEREFORE, BE IT RESOLVED, that the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:

1. That the above referenced bid award, made to Bud Concrete in the amount of $22,570 for Lane of Acres Concrete Swale and Roadway Improvements is cancelled.
2. That a check be drawn on Account #03-731-02 (Various Drainage Improvements) in the amount of $500 (Five hundred dollars and no cents) made payable to Bud Concrete, 2120 Route 47, Sewell, New Jersey 08080 as full and final settlement of any and all claims related to said bid and award.

7. Auth. to Make Payment for Change Orders- December 10, 2002
Storm Sewer Improvements by Developer

WHEREAS, by resolution dated July 9, 2002 a contract was approved with Lincoln Commons Urban Renewal, L.P. and The Ingerman Group/MBI Development Corp., to participate financially in the construction of a storm sewer and related improvements within the right-of-way of Lincoln Avenue to meet the requirements for construction by the developer of affordable senior citizen apartments at 325 Lincoln Avenue and which were determined to also be desirable for the benefit of the general public and other existing residents of Lincoln Avenue; and

WHEREAS, the project has been completed to the satisfaction of the Borough and, based on the terms of the agreement, payment has already been made by the Borough to the developer in the amount of $42,500.00, equaling half the originally estimated project construction costs of $85,000 plus $9,416.00 for additional improvements on Lincoln Avenue that were outside the scope of the storm sewer project; and

WHEREAS, during the storm sewer construction, the developer found a significant number of unknown conditions requiring additional construction work which the Borough Engineer approved at the time resulting in added costs of approximately $50,000 to the project; and

WHEREAS, the Borough Engineer has agreed that the additional costs were both necessary and reasonable and would have been built into the original contract if the underground conditions were fully known at the time of the design, resulting in a storm sewer system of greater value due to the changes; and

WHEREAS, the developer has asked the Borough to participate in up to half of these additional costs under the circumstances.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that a check payable to the The Ingerman Group, 725 Cuthbert Boulevard, Cherry Hill, New Jersey 08002 in the amount of $15,000.00 from the Capital Fund, as certified by the Chief Financial Officer as available from Account #03-731-02 (Various Drainage Improvements), be authorized as the amount the Borough considers a reasonable additional contribution towards the storm sewer project based on the above set of facts and the developer’s agreement that this payment is considered to fulfill all financial obligations under the agreement.

GENERAL COMMENTS – Commissioners Meeting – December 10, 2002

Commissioner Reisner explained that the Bond Ordinance for the supplemental library construction provides for financing for architectural services. It is needed because we are now at the end of our budget year. Next year’s temporary budget will include money to cover architectural services. A Bond Anticipation Note, or BAN, is for short term debt, and is in a different legal category than a long term bond. Short-term borrowing is for a 12 month period.

Administrator Schwab explained the reason for the ordinance entitled “Ordinance Amending Public Works Employees Salary Ordinance.” He explained that as with all large documents there were a few errors and misunderstandings when the current negotiated agreement was adopted. These proposed changes allow for a step 4A, which had been in prior contracts and for the same longevity rates as for all other Borough employees. Commissioner Reisner noted that by proposing this ordinance, the Borough is acting in good faith for its employees, and respecting what we should do although under law we are not required.

Mr. Raiczyk, 615 Wayne Avenue, asked about payment to the Ingerman Group. Administrator Schwab explained that this is for payment to the developer of the Lincoln Commons project for storm sewer and related improvements within the right-of-way of Lincoln Avenue. During construction the developer found a significant number of unknown conditions requiring additional construction work. The Borough agreed to contribute $15,000. as its share of the cost of the additional work because our engineer confirmed that this was work that could not have been reasonably anticipated.

Commissioner Tarditi explained that GPM Associates, Inc. is the consultant hired to research the practicality and feasibility of the Borough selling its water system. Realizing that many towns in the area have divested of the water business, the Commissioners engaged the services of the consultant. If the selling price is attractive, the voters will be asked if they want to sell. The final report is due within a few weeks. The Borough is also evaluating options to providing its own sewer collection systems.

Commissioner Tarditi explained the Borough’s medical insurance opt-out plan as an incentive for employees to receive a percentage of the cost to the Borough for medical coverage rather than the Borough paying the full cost for employees who have coverage from other sources. Commissioner Tarditi abstained from the vote because he receives a payment under the opt-out program.

Administrator Schwab explained that the bid award for the Lane of Acres project has to be cancelled, because there was no agreement reached between the property owners and the Borough over property easements. The decision provided the contractor be reimbursed for their bid-related expenses, which were $500. Kirk Peterson, 214 Lakeview Avenue, asked if the project was a dead issue. Mayor Colombi answered that it is for now because we were not able to get the property owners to agree with our engineers. Until the property owners agree to give easements, the project can not move forward. Administrator Schwab explained that the funds would be used for another project.

Mayor Colombi explained that each year the Borough gives its employees a gift certificate. This year, each full time employee will be given a $25 Haddonfield gift certificate which can be used at participating businesses. The employees will be given the option to trade the certificate in for an Acme certificate.

Mayor Colombi noted that the Borough is very fortunate to have so many residents volunteer for various activities and committees. We are very thankful for all of volunteers and we appreciate their efforts. She also noted that the Borough is particularly appreciative of Margee Kanupke’s dedication on the Zoning Board.

Mayor Colombi addressed the fourth graders in attendance and invited them to stand up, give their address, and ask a question. Isabella Canuso, 440 Kings Highway, asked why there are no sidewalks on sections of Euclid and Hawthorne. Mayor Colombi explained that sidewalks were not required when the houses were built but homeowners are allowed to put in sidewalks.

Nicole Bull, 465 Loucroft Road, asked if dogs will be able to run around Crows Woods. Mayor Colombi explained that the Commissioners are currently seeking public input about allowing dogs to run at large in the wooded area of Crows Woods. Mr. Poynton, the Coordinator of Crows Woods, suggested that dogs be allowed to run loose in the woods but the there should be greater police enforcement in other parts of park.

Sionna Kelly, 315 Mt. Vernon Avenue, asked about a stop sign at the corner of Vernon Avenue and Estaugh Avenue. Commissioner Tarditi explained that it could be very difficult to get approvals for four way stops but maybe we could consider changing the direction of the stop signs.

Meghan Burns, 14 Summit West or 37 Linden, had no question.

Brigid Connell, 50 North Drive, was wondering why POW flags are outside of the building. Mayor Colombi responded that Borough still has a Prisoner of War missing who went to school with our former Mayor, Eugene Kain. We are also required to fly the flag by state law. Commissioner Reisner added that the flag is there so we do not forget those who have sacrificed for us.

Kathryn Derk, 127 Linden Avenue, asked why it takes so long to pick up leaves and sticks. Mayor Colombi noted that picking up of leaves depends on the weather. This year we had two weeks of intense rain, and we were further slowed down because of the snow, which also caused two of our trucks to break down. We will keep working until the leaves are all picked up and we have our staff working ten hour days, with seven trucks in service.

Mr. Raiczyk noted that his car slid at the intersection of Euclid Avenue and West End. Mayor Colombi explained that we use a mixture of sand and salt so we do not get absolutely clean streets. The snow plows are deployed when there is three inches of snow. Administrator Schwab added that the plows are set to be one inch from the pavement to protect the equipment from damage.

Sandy Zeller, of the Mews, at 464 Kings Highway, asked if the Borough Commissioners were considering hiring an independent consultant to assist the Zoning Board in responding to Bancroft. Commissioner Tarditi indicated that the Zoning Board has the authority to hire consultants and Commissioner Reisner added that it is likely the Borough would accommodate the Board’s needs.

6. Auth. to Impose Moratorium on Ordinance #750-Fire House November 26, 2002

WHEREAS, Haddonfield Borough has an Ordinance #750, adopted February 4, 1941, which prohibits dispensing alcoholic beverages in Haddonfield Borough’s public buildings; and
WHEREAS, for at least 62 years in the past, alcoholic beverages were dispensed and consumed at certain events on the second floor of the Haddon Fire Company No. 1 Building; and
WHEREAS, Haddonfield Borough is reviewing the Ordinance #750 to evaluate whether alcoholic beverages would be permitted at certain events on the second floor of Haddon Fire Company No. 1 Building; and

WHEREAS, Haddonfield Borough seeks to impose a moratorium of Ordinance #750 for two specific identifiable events with respect to the second floor of Haddon Fire Company No. 1 Building.
NOW, THEREFORE, BE IT RESOLVED by the Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey as follows:
(1) A moratorium is hereby imposed on Ordinance #750 as to two (2) specific identifiable events to be held on the second floor of Haddonfield Fire Company No. 1 Building as recited herein below.
(2) The two (2) specific identified events are:
(a) On December 14, 2002, an event referred to as the Annual Holiday Dinner Party; and
(b) On January 2, 2003, an event referred to as The Installation of Officers Dinner.
(3) A fireman who attends an above event and consumes alcoholic beverages at that event shall not respond to a fire call during the event and for eight (8) hours after the end of the event.
(4) This moratorium is a one time passage specifically for the above two events. This moratorium expires and is of no legal effect on January 3, 2003.

7. Auth. to Issue Payment-Settlement of a Legal Matter November 26, 2002

RESOLVED, by the Board of Commissioners of Haddonfield, County of Camden, State of New Jersey, that the Borough of Haddonfield agrees to settle the disciplinary litigation, Ames v. Haddonfield, Docket No. L-9663-98 as follows:

1. The Defendants, Borough of Haddonfield, shall pay to the Plaintiff, George Ames, the sum of $10,404.64 representing back wages for the period September 1, 1998 through February 28, 2001. This amount shall be paid to the Plaintiff on or before November 30, 2002.
2. The Defendants, Borough of Haddonfield, shall pay to Plaintiff’s attorney the sum of $12,628.50 in counsel fees.
3. The Defendants, Borough of Haddonfield, shall issue the Plaintiff, George Ames, a retired Sergeant’s identification card no later than December 31, 2002.
4. The Plaintiff, George Ames, agrees not to seek future employment with the Borough of Haddonfield and/or the Borough of Haddonfield Police Department.
5. The Defendants, Borough of Haddonfield, shall be responsible for contacting the Police and Fireman’s Retirement System and insuring that the Plaintiff’s pension is adjusted to reflect the rate differential between his pension benefits as a Patrolman versus his pension benefits as a Sergeant. This shall also apply to the Plaintiff’s retroactive benefits. The Defendants shall be responsible for contacting the Pension Board and make the necessary changes no later than December 31, 2002.
6. If the Defendants are unable to accomplish their obligations outlined in Paragraph 5 above without retaining the services of an expert, then the Defendants shall pay up to the sum of $2,000.00 to an expert of the Plaintiff’s choice.

8. Auth. to Sign Building Lease for Temporary Library Space November 26, 2002

WHEREAS, the Borough of Haddonfield is planning to expand the Haddonfield Public Library which will result is the inability to provide Library services from that site during the construction process; and
WHEREAS, Haddonfield‘s Library Director has led a detailed review of multiple options for providing library service during this period and has not found any significant acceptable space in Haddonfield which can provide significant library services to all Haddonfield residents and therefore has recommended the lease of approximately 9600 square feet of lower
level office space in a property known at Haddon Hill Office Building at 63 Kresson Road, Cherry Hill, NJ, adjacent to Haddonfield, as the only alternative space found that can house the entire library collection and provide these services; and
WHEREAS, the Haddonfield Library Board has endorsed the recommendation and the Borough Commissioners have negotiated acceptable financial and operational conditions with the owner of the property in question; and
WHEREAS, funds will be available to pay the lease and expense costs involved in contracting for the space through funds available in Capital Account 03-731-03 (Construction of Library) and future capital funds to be authorized for the new Library project.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that the proper Borough officials are hereby authorized to sign an agreement with Levco Enterprises, L.L.C., P.O. Box 16, Woodbury, NJ 08096 for approximately 9600 square feet of lower level space in Levco’s property known at Haddon Hill Office Building at 63 Kresson Road, Cherry Hill, NJ, per the attached lease agreement which has as its main provisions an initial lease term of April 1, 2003, to September 30, 2004 at a monthly lease rate of $5,875.00; and
BE IT FURTHER RESOLVED that per the agreement, a check payable to Levco Enterprises in the amount of $10,000 be authorized to be issued at the signing of the lease.

GENERAL COMMENTS - Commissioners Meeting – November 26, 2002

Joe Haro, 29 Evergreen Lane, asked about a check to the Homeowners Assoc. at the Mews. He was told that this is for street lighting. Because of a Supreme Court decision we must now pay for streetlights in that development.

Commissioner Tarditi, as Commissioner of Public Safety, explained the moratorium for two special events at the firehouse. During these events, we are covered by mutual aid from surrounding companies. Joe Haro asked if the firehouse could be rented out. He was told that we do not rent it for social events. Commissioner Reisner said that this is for one time only. It is not a promise for the future. Commissioner Tarditi said that we want to provide positive recognition for volunteer groups.

Solicitor Iavicoli explained the Resolution regarding Ames vs. Haddonfield. This concerned a disciplinary action. Counsel fees were negotiated downward. Mr. Ames agreed not to seek rehiring if his disability is no longer valid. Mr. Reisner said that considering the amount of the original claims, this has been handled very well by our legal representatives. We now have closure on a long and difficult issue.

Mayor Colombi said that we are fortunate to solve the problem of what to do with the Library and its books during the construction of the expansion. Librarian Doug Rauschenberger found a location to house the entire collection in one location. We can occupy the building in March. The worst case for construction will be two and a half years. We are very happy about this solution to a difficult problem The Kresson Road location is in the building that was the Hideaway restaurant.

The fourth graders from Elizabeth Haddon School were asked to introduce themselves.
They were: Joe LaMaina, 510 Kings Highway West; Erin Brogan, 124 Lansdowne Avenue; Katie Ierardi, 312 Westmont Avenue and Emily Russo, 215 Woodland Avenue.
None of the children had any questions.

Commissioner Tarditi announced that Administrator Schwas has a news release regarding a moratorium for parking meters after noon on weekdays during the month of December.
Mayor Colombi said that the noon starting time was because we did not want employees to park first thing in the morning and leave their cars at the meters all day.

Commissioner Reisner said that the Library will begin its 200th year on March 5. In March of 1803 a private library was established in Haddonfield.

Mayor Colombi announced that the Holiday Tree Lighting will take place on Friday. Santa will then lead all to his new location at the gazebo in Kings Court. She also said that she had attended the dedication at the Central-Middle School yesterday. It is a beautiful new addition.

Joe Haro asked what services the Borough provided for the Borough of Tavistock. He was told that we provide police and fire services and our public works people pick up the trash there. Tavistock pays us a fee each year for these, and other inspection services when required.

Kirk Peterson, 214 Lakeview Ave., raised a question regarding a sign in front of a house on Potter Street. It seems to have been put up by the resident and it concerns speeding.
Chief Tsonis will check to see if this sign is legal.

Ted Raiczyk commented that the Public Works Department is doing an excellent job on removing leaves. He noted that some lawn services are putting the leaves in the street. They should be notified not to do this. Mayor Colombi said that we write to landscapers every year telling them the rules. He asked about two locations. At Colonial and Kings Highway there is a gas main that needs repair. At Warwick Road the traffic light is being replaced. The contractor knows to be careful of the trees.

Mr. Raiczyk mentioned that on an errand to Woodbury he noticed that they did not have any parking meters. He asked if we really need the meters downtown with a two hour limit. Commissioner Tarditi said that the main reason is to force turnovers and to prevent office workers from taking spaces all day. Mayor Colombi said that the last study done told us how to time the meters for the best use.

4. Auth. to Accept Installment Payments- November 12, 2002
Water and Sewer Charges

WHEREAS, water and sewer charges for prior years have not been paid on property known as Block 11, Lot 29, Account #681033, in the Borough of Haddonfield; and

WHEREAS, the owner of said property has indicated his intention to make regular monthly payments of $100.00 until all such charges, with interest, have been paid; and

WHEREAS, said owner realizes that all present and future taxes, water and sewer charges, and other municipal charges must be paid as they become due.

NOW, THEREFORE BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that the tax collector be directed to accept installment payments of $100.00 per month until the account is fully paid; and

BE IT FURTHER RESOLVED, that in the event any such installment of arrears or any new charges are not promptly paid, this agreement shall be void and the tax collector shall proceed to enforce the lien at the net regularly scheduled tax sale, or at a special tax sale.

GENERAL COMMENTS - Commissioners Meeting – November 12, 2002

Commissioner Reisner chaired the meeting in his capacity as Deputy Mayor. He announced that Mayor Colombi was attending a charity event and could not be with us tonight.

Ted Raiczyk, 615 Wayne Ave., questioned a voucher for Tom Wagner. It was explained that Mr. Wagner has been hired on a limited contract to examine some Borough buildings to evaluate their condition.

Commissioner Tarditi announced that there will be a meeting on Thursday, November 21 to review and discuss the plans for the Library addition.

The fourth graders from Elizabeth Haddon were asked to introduce themselves. They were: Catie Sullivan, 651 Pomona Ave.; Emma Carpenter, 50 Chew Landing Road; Griffin Apgar, 263 Kings Highway West; Connor and Nolan Meeker, 255 West Summit Ave. and Jonathan Hughes, 636 Pomona Ave. None of the children had any questions.

Kirk Peterson, 214 Lakeview Ave., said that the Senior Citizen housing (Lincoln Commons) is a beautiful building. He suggested locations for curb cuts near the building and for additional street lighting, so seniors could walk in the areas near the site. Capt. Banning was asked to review the situation.

County Ice & Snow Removal

RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that the appropriate officials of the Borough of Haddonfield are authorized to sign an Interlocal Services Agreement with the County of Camden wherein the Borough will provide snow and ice removal services on 3.31 miles of County Roads within Haddonfield during the 2002-2003 winter season and the County will provide the Borough with sand and salt materials equal to $100 per mile per storm.

8. Auth. for Moratorium on Overnight Parking Enforcement- October 22, 2002
First Night

WHEREAS, Section XIV of Ordinance #1720 adopted December 12, 1995 which codified traffic and parking regulations in the Borough of Haddonfield prohibits parking on public streets in the Borough from 2:00 a.m. to 5:00 a.m.; and

WHEREAS, on New Year’s Eve, the evening of December 31, 2002 and the early morning hours of January 1, 2003, a Borough approved activity known as First Night will be taking place in Haddonfield which will attract thousands of people with their vehicles to Haddonfield; and

WHEREAS, during and after the First Night activities vehicles of residents and guests may be parked on Borough streets between midnight and 6:00 a.m. on January 1, 2003 as a result of public activities as well as private ones; and

WHEREAS, it has been determined that it would not be detrimental to the safety of the public to allow “overnight parking” throughout the Borough on this date:

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that a moratorium is declared for January 1, 2003 regarding the enforcement of Section XIV of Ordinance #1720 “overnight parking” and the Haddonfield Police Department is directed to refrain from enforcing that particular section of the parking regulation on that date as this moratorium renders that section unenforceable.
