A regular meeting of the Board of Commissioners of the Borough of Haddonfield was held on the above date at 8:00 p.m. in the Auditorium of the Borough Hall, Haddonfield, New Jersey.

That the Annual Notice has been filed with the Retrospect stating the time, date and locations of all meetings in accordance with the Open Public Meetings Act.

AN ORDINANCE AMENDING AN ORDINANCE CREATING SPECIAL IMPROVEMENT DISTRICT AND DESIGNATING A DISTRICT MANAGEMENT CORPORATION, FOR THE BOROUGH OF HADDONFIELD, COUNTY OF CAMDEN, STATE OF NEW JERSEY, AS AMENDED, TO CHANGE CATEGORIES AND TERMS OF APPOINTEES TO THE DISTRICT MANAGEMENT CORPORATION AND TO DELETE CERTAIN POWERS OF THE DESIGNATED DISTRICT MANAGEMENT CORPORATION AND TO CORRECT INCLUDED PROPERTIES.

SECTION 2: (a) Wages and salaries for positions listed in Sections 1 (A), (B), (C), (D), (E) and (F) shall take effect on the first pay date in April 2004.

SECTION 3: Regulations for Pay Classification System

(a) Wage rates for all permanent full time employees and certain permanent part time employees as determined by the Borough Administrator, are part of the Pay Classification System. The Borough Administrator shall determine equal increments for each position. Each increment shall be considered a step. The Borough Administrator shall annually review the salary of each salaried employee covered by this plan for the purpose of determining whether said employee shall be entitled to a step increase. The Borough Administrator may advance an employee in that employee's grade until the maximum step has been reached subject to budgetary limitations.

(b) New employees shall be paid the minimum step for his grade except that the Borough Administrator shall have the discretion to determine whether said new employee has qualifications greater than the minimum qualifications for the classification. In the greater qualification situation, the employee may receive a salary in a higher step.

(c) When an employee is promoted to a position in a higher classification, his salary shall be increased to the minimum rate for the higher classification subject to the discretion of the Borough Administrator. In the case of overlapping ranges, the salary of promoted employee shall be increased to the step immediately above his present salary, subject to the discretion of the Borough Administrator. When an employee is demoted to lower classification, he shall be paid at a rate which is within the approved range for the lower classification. The rate of pay shall be determined by the Borough Administrator.

(d) When a Public Works Supervisor is the qualified State required licensed individual designated by the Borough to be responsible for either the Water Treatment, Water distribution System or Sewer Collection System operation, the Administrator may increase the individual's weekly base salary by a maximum of $80.00 per week for each license.

SECTION 4: Overtime Pay, Pay Dates and Longevity Pay

Except as stated below, time worked, when approved by the Administrator or his designee, which is in excess of regularly scheduled hours, will be paid at time and one half of the base rate of pay including longevity and education pay (where applicable). Department Supervisors and Office Heads are not eligible for overtime pay except for circumstances as determined by the Administrator. The Administrator may, at his discretion, approve compensatory time off for these management positions guided by the number of previously approved hours worked beyond regularly scheduled hours.

Salaries normally shall be paid on Friday of the week following the work week in which the salary was earned. If requested in writing, salaries may be paid in advance of vacations.

Upon completion of designated years of service, all officials and employees shall receive longevity pay as described below. Percentages used in the formula are only for the purpose of arriving at a dollar figure for individual salaries. The longevity figure which the employee will receive in the current year is the final dollar figure reached by using years of service, individual current year salaries and applicable percentages.

Longevity applies to the current year base salary only and not to educational incentives (where applicable). "Years of Service" means all time served with the Borough including previous periods of employment as long as previous separation was in good standing.

SECTION 5: All Ordinances or parts of Ordinances which are inconsistent with the provisions of this Ordinance, are hereby repealed to the extent of such inconsistency.

SECTION 6: This Ordinance shall take effect immediately upon passage and publication as required by law.

2. Authorization to Request Extension to March 23, 2004

Waive Filing Deadline of the 2004 Budget

WHEREAS, the Director of the Division of Local Government Services, under the provision of N.J.S.A. 40A:4-5, provided that municipalities, must introduce their budgets by February 10 of each calendar year, and

WHEREAS, the Board of Commissioners of the Borough of Haddonfield did not find it possible to meet this deadline due to the need for more extensive review of budget requests.

NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that the permission of the Director of the Division of Local Government Services be sought to waive the provisions of the required February 10, 2004 introduction date for the 2004 Local Municipal Budget.

BE IT FURTHER RESOLVED, that (3) certified copies of this Resolution be forwarded to the Director of the Division of Local Government Services in this regard.

3. Auth. for Emergency Temporary Appropriations March 23, 2004

WHEREAS, an emergency condition has arisen with respect to 2004 permanent budget and no adequate provision has been made in the 2004 temporary appropriations for the aforesaid purpose, and N.J.S.A. 40A:4-20 provides for the creation of an emergency temporary appropriation for the purpose above mentioned; and

WHEREAS, the total emergency temporary resolutions adopted in the year 2004 pursuant to the provisions of Chapter 96, P.L. 1951 (N.J.S.A. 40:A4-20) including this resolution total $1,744,055.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners, County of Camden, State of New Jersey (not less than two-thirds of all the members thereof affirmatively concurring) that in accordance with N.J.S.A. 40:A4-20:

  • Emergency temporary appropriations be and the same is hereby made for:

$ 1,406,055 – Current Fund

$ 338,000 – Water & Sewer Fund

  • That said emergency temporary appropriation will be provided for in the 2004 permanent budget under the title of: see attachment

RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that a check be drawn on Current Account in the amount of ONE HUNDRED NINETY FOUR THOUSAND, NINE HUNDRED TWENTY-TWO DOLLARS AND FIFTY CENTS ($194,922.50) payable to the Board of Trustees of the Free Public Library of Haddonfield to pay the second of four installments of the 2004 Budget appropriation.

8. Auth. to Hold MayFest and Close Tanner Street March 23, 2004

WHEREAS, the Board of Commissioners of the Borough of Haddonfield deems it in the best interest of its citizens to encourage organized festivals; and

WHEREAS, the Haddonfield Business and Professional Association (HBPA) wishes to sponsor a “MayFest” event on Saturday, May 1, 2004 from 9:00 a.m. to 5:00 p.m. (rain date Sunday, May 2, 2004 from 12 noon to 5:00 p.m.); and

WHEREAS, the HBPA has requested that Tanner Street, from Kings Highway East to Euclid Avenue, be closed to traffic for the event; and

WHEREAS, HBPA has provided the Borough of Haddonfield with the appropriate insurance liability coverage of at least $1,000,000.00 naming the Borough of Haddonfield as an additional insured.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that permission is granted for the “MayFest” event for the following:

  1. The closing of Tanner Street, from Kings Highway East to Euclid Avenue from 8:00 a.m. through 8:00 p.m. on Saturday, May 1, 2004 (rain date Sunday, May 2, 2004 from noon to 5:00 p.m.).
  2. The display of herbs, plants and flowers for sale at Kings Court and Lantern Lane by the Haddonfield Historical Society and the Haddonfield Fortnightly Junior Division and other Haddonfield Civic groups authorized by the HBPA.
  3. The display and sale of food on the sidewalks in front of the shops and on Kings Highway in the commercial district as determined by the HBPA at locations designated by the HBPA along Kings Highway and within the closed section of Tanner Street.
  4. The display and sale of outdoor related home and garden items and services authorized by the HBPA at locations designated by the HBPA.
  5. Music and entertainment from sidewalks and other public and private property in the commercial district as arranged for and designated by the HBPA.

10. Auth. to Adopt Personnel Policies – 2004 March 23, 2004

WHEREAS, it is the policy of Borough of Haddonfield to treat employees and prospective employees in a manner consistent with all applicable employment laws and regulations including, but not limited to Title VII of the Civil Rights Act of 1964, as amended by the Equal Opportunity Act of 1972, the Age Discrimination in Employment Act, the Equal Pay for Equal Work Act, the Fair Labor Standards Act, the New Jersey Law Against Discrimination, the Americans with Disabilities Act, the Family and Medical Leave Act, the Conscientious Employee Protection Act, the Public Employee Occupational Safety and Health Act, the New Jersey Attorney General’s guidelines with respect to Police Department personnel matters, the New Jersey Workers Compensation Act, the Federal Consolidated Omnibus Budget Reconciliation Act (COBRA) and the Open Public Meeting Act; and

WHEREAS, the Board of Commissioners has determined that there is a need for personnel policies and procedures to ensure that employees and prospective employees are treated in a manner consistent with these laws and regulations.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that the Personnel Policies and Procedures Manual attached hereto is hereby adopted, and shall become effective on April 1, 2004. The manual presently in existence and adopted by prior resolutions shall be of no force and effect on April 1, 2004.

BE IT FURTHER RESOLVED that these personnel policies and procedures shall apply to all Borough officials, appointees, employees, volunteers and independent contractors. In the event there is a conflict between these rules and any collective bargaining agreement, personnel services contract or Federal or State law, the terms and conditions of that contract or law shall prevail. In all other cases, these policies and procedures shall prevail.

BE IT FURTHER RESOLVED that this manual is intended to provide guidelines covering public service by Borough employees and is not a contract. The provisions of this manual may be amended and supplemented from time to time without notice and at the sole discretion of the Board of Commissioners.

BE IT FURTHER RESOLVED that to the maximum extent permitted by law, employment practices for the Borough shall operate under the legal doctrine known as “employment at will.”

BE IT FURTHER RESOLVED that the Borough Administrator and all managerial/supervisory personnel are responsible for these employment practices. The Personnel Officer and the Borough Solicitor shall assist the Borough Administrator in the implementation of the policies and procedures in this manual.

RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, that the appropriate Borough officials be authorized to sign the proposed Interlocal Services Agreement among the County of Camden, Borough of Haddonfield and the Township of Haddon for jurisdictional change of Maple Avenue CR642 for a period of one (1) year.

12. Auth. to Purchase Police Car Under State Contract and March 23, 2004

Enter Into Lease Agreement

WHEREAS, the Borough of Haddonfield, pursuant to N.J.S.A. 40A:11-12, may purchase goods or services under state contract without advertising for bids, based on the premise that the State of New Jersey has undergone the public advertising requirements on behalf of contracting units within the State, and has identified the lowest responsible, responsive bidder for specified goods and services; and

WHEREAS, a 2004 Ford Crown Victoria Police Car is available for $20,358.00 from Winner Ford, 250 Haddonfield-Berlin Road, Cherry Hill, under State Contract #A45069.

NOW, THEREFORE BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:

  • That Winner Ford, 250 Haddonfield-Berlin Road, Cherry Hill, New Jersey 08034, under State Contract #A45069, is offering a 2004 Crown Victoria for $20,358.00.
  • That the appropriate officials are authorized to sign a three year lease-purchase agreement with Ford Motor Credit Company, Commercial Lending – MD 7500, P.O. Box 1739, Suite 2277, Dearborn, MI 48121-1739 for the lease of one (1) 2004 Ford Crown Victoria Police Package vehicle for three (3) annual payments totaling $7,201.30 per year for a three (3) year total of $21,603.90 with the option to purchase the vehicle at the end of the lease for $1.00.
  • That the Chief Financial Officer of the Borough has certified that the funds will be available legally in Account #01-113-13 (Police Other Expenses, Vehicle Lease/Purchase).

WHEREAS, Women’s History Month provides our country the privilege of honoring the countless contributions that American women have made throughout our history. These contributions have enriched our culture, strengthened our Nation, and furthered our Founders’ vision for a free and just Republic that provides opportunity and safety at home and is an influence for peace around the world;

WHEREAS, Since its beginnings, our land has been blessed by noteworthy women who played defining roles in shaping our Nation. Women befriended explorers, wrote and spoke for equality, freedom and justice for all, and pioneered efforts as physicians helping others. Women showed us the power of determined human spirit and furthered the cause of freedom through service in government, the military and other organizations;

WHEREAS, The history of American Women is a story of outstanding individuals who sacrificed much and worked hard in pursuit of a better world, where peace, dignity and opportunity can reign. American women of strength, vision and character have long influenced our country by contributing their time, efforts and wisdom in vastly diverse ways to improve and enhance our government and communities, our schools and religious institutions, our businesses and the military, and the arts and sciences;

WHEREAS, Women also have fundamentally shaped our civilization in the care and nurturing of families. Today, women are furthering the Founders’ vision by working to advance freedom, increase equality, and administer justice in every corner of our land, through everyday work in schoolrooms, boardrooms, courtrooms, homes and communities.

PROCLAMATION

WHEREAS, Lions International, with over 1.4 million members, is the largest service organization in the world; and

WHEREAS, the Lions Club became committed to sight when Helen Keller spoke at the 1924 International Convention in Canada and asked the Lions Clubs to become the “knights of the blind;” and

WHEREAS, the Lions Clubs in New Jersey have organized a Sight Conservation Program for the month of April; and

WHEREAS, the Lions Clubs are making a concerted effort to educate the public about eye related diseases through displays and the distribution of brochures and materials that explain diseases such as

age related macular degeneration, glaucoma, cataracts, lazy eye (amblyopia) strabismus as well as diabetes; and

WHEREAS, the Lions Eye Banks of Delaware Valley and New Jersey, supported by the Lions Clubs of New Jersey, have provided tissue for corneal transplantation to over 25,000 recipients in the tri-state area during the last 43 years; and

WHEREAS, the Lions Clubs are joining together to organize and conduct eye screenings throughout the state; and
