A regular meeting of the Board of Commissioners of the Borough of Haddonfield was held on the above date at 8:00 p.m. in room 102 of the Borough Hall, Haddonfield, New Jersey.

That the Annual Notice has been filed with the Retrospect stating the time, date and locations of all meetings in accordance with the Open Public Meetings Act.

AN ORDINANCE AMENDING BOND ORDINANCE #16-2004 AUTHORIZING THE ACQUISITION, CONSTRUCTION, REPAIR AND INSTALLATION, AS THE CASE MAY BE OF VARIOUS WATER AND SEWER CAPITAL IMPROVEMENTS AS GENERAL IMPROVEMENTS IN AND FOR THE BOROUGH OF HADDONFIELD

The foregoing Ordinance was set forth in the minutes of the meeting of August 10, 2004 and was read by title and a public hearing was held thereon. After a public hearing the Ordinance was adopted by the following vote: Ayes, Commissioners Colombi, Reisner and Tarditi. Nays, none.

AN ORDINANCE AMENDING ORDINANCE #11-2004 ESTABLISHING THE SALARIES AND WAGES FOR CERTAIN EMPLOYEES TO BE PAID BY THE BOROUGH OF HADDONFIELD FOR THE YEAR 2004.

The Board of Commissioners of the Borough of Haddonfield, County of Camden and State of New Jersey, do ordain, as follows:

An Ordinance by Mr. Reisner:

FIRST READING August 24, 2004

AN ORDINANCE AMENDING BOND ORDINANCE #14-2004 AUTHORIZING THE ACQUISITION, CONSTRUCTION, REPAIR AND INSTALLATION, AS THE CASE MAY BE, OF VARIOUS CAPITAL IMPROVEMENTS AS GENERAL IMPROVEMENTS IN AND FOR THE BOROUGH OF HADDONFIELD

WHEREAS, Ordinance #14-2004 adopted April 27, 2004 authorized appropriations in the amount of $1,902,000.00 and the issuance of $1,806,900.00 aggregate principal amount of general obligation bonds or notes of the Borough for financing of various General capital projects; and

WHEREAS, said Ordinance included the purchase of Property, Demolition, Construction of a Parking Lot; and

WHEREAS, it is the desire to change the scope of the project to include all potential related costs.

NOW, THEREFORE, BE IT ORDAINED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, (not less than two thirds, of the full membership thereof affirmatively concurring), as follows:

SECTION I:

Ordinance #14-2004 adopted April 27, 2004 is hereby amended to replace paragraph 1.9 of Section I of said Ordinance to read as follows:

1.9 (a) Redevelopment of land including necessary studies which may include but are not limited to engineering, architectural or planning, and to also include purchase of property, demolition and construction.

1.9 (b) Estimated Cost of the Improvement is $800,000.

1.9 (c ) The Estimated Useful Life of the Improvement is twenty (20) years, as provided in Section 40A:2-22 et seq of the Local Bond Law.

SECTION II:

All ordinances or parts of ordinances inconsistent with this amending ordinance be and they are hereby repealed to the extent of such inconsistencies only.

SECTION III:

If any section or provision of this ordinance shall be held unconstitutional or invalid by any court, the remaining sections and provisions shall, notwithstanding such holding, remain and be in full force and effect.

SECTION IV:

This bond ordinance shall take effect twenty (20) days after its final passage and publication as required by law.

4. Auth. to Issue Check – Pennsauken Landfill Case August 24, 2004

WHEREAS, the Borough of Haddonfield is a named party in the Pennsauken Solid Waste Management Authority, et. al v. Ward Sand and Material Company, Inc., et. al case; and

WHEREAS, certain legal fees have been generated for the defense of the Borough in this litigation but the coverage determination between the Borough and its insurers has not yet been resolved; and

WHEREAS, these legal fees need to be paid at this time but without giving up the Borough’s rights to challenge this assessment and be reimbursed in the future and without accepting any liability for future fees, costs and judgments.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:

  • That a check be issued from the Current Fund payable to “Pennsauken Municipalities Joint Defense Group”, and sent to The Law Offices of George N. Styliades, Suite 308, 1060 N. Kings Highway, Cherry Hill, New Jersey 08034-1910 in the amount of $1,440.00 for Liaison Counsel Fees.
  • That the expenses be charged to 01-104-00 Legal, Other Expenses where adequate funds are available.
  • That the Borough reserves all rights in this matter as to its liability and responsibility for future fees, costs, settlements or judgments.

8. Auth. to Accept Filing of Audit Corrective Action Plan August 24, 2004

WHEREAS, on July 27, 2004 the Board of Commissioners of the Borough of Haddonfield accepted the 2003 Audit Report; and

WHEREAS, a Corrective Action Plan was required; and

WHEREAS, the Chief Financial Officer has submitted a Corrective Action Plan that is on file.

NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, does acknowledge the receipt of the Corrective Action Plan.

BE IT FURTHER RESOLVED, that the Borough Clerk forward a copy of the Corrective Action Plan to the Director of Local Government Services, 101 South Broad, CN 803,

Trenton, NJ 08625-0803.

9. Auth. to Hold Antique Auto Show August 24, 2004

WHEREAS, the Board of Commissioners of Borough of Haddonfield deems it in the best interest of its citizens to encourage organized festivals; and

WHEREAS, the Ankokas Antique Auto Club wish to sponsor an “Antique Auto Show” on Saturday, September 11, 2004 from 11:00 a.m. to 4:00 p.m. on Kings Highway (rain date, Sunday, September 12, 2004 from 12:00 noon to 5:00 p.m.).

NOW, THEREFORE BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:

1. The closing of Kings Highway from Haddon Avenue to PATCO is hereby authorized from 8:00 a.m. through 5:00 p.m. on Saturday, September 11, 2004 (rain date, Sunday, September 12, 2004, 10:00 a.m. to 6:00 p.m.) for the display of antique autos at locations specified by the Ankokas Antique Auto Club for the “Antique Auto Show.”

2. No other store or purveyor is permitted to display goods for sale outside of any store within the public right of way, except as part of an approved merchandise display.

10. Auth. to Conduct Fall Festival August 24, 2004

WHEREAS, Borough of Haddonfield deems it in the best interest of its citizens to encourage organized festivals to raise funds for charitable organizations and provide positive activities in the Borough’s commercial district; and

WHEREAS, the Haddonfield Activities Committee has been appointed to promote a Fall Festival Day on Saturday, October 16, 2004 from 10:00 a.m. to 5:00 p.m. (rain date Sunday, October 17, 2004 from 12:00 noon to 5:00 p.m.) within the commercial district of the Borough of Haddonfield.

NOW, THEREFORE BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:

  • Permission is hereby granted to charitable organizations to utilize the public sidewalks and other public property within the commercial district in the Borough of Haddonfield to display goods, wares and foods, etc. for sale as part of Haddonfield’s Fall Festival Day.
  • During the Fall Festival various food purveyors in the commercial districtare hereby given permission to display and sell food on the sidewalks in the front of their stores or shops and food purveyors in Haddonfield whose shops or stores are not on Kings Highway in the Commercial District may sell food as determined by the Haddonfield Activities Committee at locations designated by the representative of the Committee.
  • Food sales shall observe all applicable health rules.
  • The representative designated by the Haddonfield Activities Committee is hereby authorized to regulate the participation of entities, organizations, persons, etc. in the Fall Festival Day including the issuing of Permits (at a modest fee), and the assigning of specific locations for groups, activities and food sales by Haddonfield food purveyors.
  • To provide financial support for the Fall Festival, the committee representative is also authorized to permit sales booths of crafters in the assigned area at assigned locations for an appropriate fee.
  • No other entity, store or vendor is permitted to sell or display their wares outside in the commercial district during this time except those with specific permits to do so.

11.Auth. for Outdoor Eating Facility - August 24, 2004

Diane’s La Patisserie

WHEREAS, the Code of the Borough of Haddonfield, Chapter 151 permits outside eating facilities adjacent to existing restaurants and businesses selling prepared food in order to encourage the viability of restaurants and food-service establishments and to enhance the vitality of the Borough of Haddonfield; and

WHEREAS , the below listed business has submitted the required application and fees requesting such approval which has been reviewed by the Zoning Office with regard to compliance with the provisions of the Code.

NOW THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey as follows:

  • That the following business has been authorized to have an outdoor eating facility from the date of this Resolution to December 31, 2004 pursuant to The Code of the Borough of Haddonfield, Chapter 151 and their application:

Diane’s La Patisserie, 146 – 148 Kings Highway #4, Haddonfield, NJ 08033

  • That the Borough of Haddonfield has received a certificate verifying they have an insurance liability policy with amounts of coverage of at least $1,000,000 acknowledging that outside seating is part of the coverage and naming the Borough of Haddonfield as an additional named insured.
  • That the above businesses comply with all other Federal, State and Local laws.
  • The above business hold harmless and indemnify the Borough of Haddonfield from any and all damages and/or claims, including attorney fees and court costs, which may arise out of its use of the public sidewalks in front of their premises.
  • No easement, license or right is hereby granted by this resolution other than the municipal consent, for the time period, as identified herein.
  • The Borough of Haddonfield reserves the right to terminate its consent as its sole discretion at any time during this period.

13. Auth. to Award Unspecifiable Service Contract - August 24, 2004

Computer Software

Whereas, there exists a need for new computer software to handle the Borough’s financial, payroll, human resources, utility and tax packages for the Borough of Haddonfield; and

WHEREAS, the Chief Financial Officer/Tax Collector, in conjunction with a computer consultant, have reviewed the various options available to the Borough; and

WHEREAS, proposals were received from four different companies; and

WHEREAS, these proposals were reviewed based on price and content; and

WHEREAS, it has been determined that, based on the recommendation of the Chief Financial Officer/Tax Collector and computer consultant, Edmunds and Associates provides the most comprehensive set of packages at a reasonable price; and

WHEREAS, funds are available in Account 03-734-01 (General Capital Fund – Computer Upgrades) for this purpose; and

WHEREAS, the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., requires that a resolution authorizing the award of a Contract for Professional and/or Extraordinary and Unspecifiable Services without competitive bids must be publicly advertised.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey as follows:

1. The Borough is hereby authorized to purchase computer software from Edmunds and Associates, 301A Tilton Road, Northfield, New Jersey 08225 per their proposal for a maximum amount of $49,841.00.

2. This contract is made without competitive bidding as a “Professional and Extraordinary and Unspecifiable Service” under the provisions of the Local Public Contracts Law because of the qualitative nature of the services being utilized.

3. A notice shall be published in The Courier Post newspaper, as required by law, within ten (10) days of the passage of this resolution.

4. This resolution shall take effect immediately.

14. Auth. to Award Purchase of Computers August 24, 2004

WHEREAS, the State of New Jersey has determined that a municipality may adopt a resolution authorizing purchase without competitive bidding if that purchase is an item which can be purchased through an awarded State contract; and

WHEREAS, the State of New Jersey has further determined if the municipality has solicited and received at least three quotations on equipment for which a State contract has been issued and the lowest responsible quotation is at least 10% less than the price the contracting unit would be charged for the identical equipment under the State contract, a municipality may also authorize such purchase without competitive bidding; and

WHEREAS, the authorization to purchase must be adopted by the affirmative vote of two-thirds of the full membership of the governing body; and

WHEREAS, a copy of the purchase order, the documentation identifying the price of the equipment under the State contract and the State contract number shall be filed with the Director of the Division of Purchase and Property in the Department of the Treasury within five working days of the award; and

WHEREAS, the Borough of Haddonfield has complied with all the requirements to purchase computer equipment for at least 10% less than the price the contracting unit would be charged for the identical equipment under the State contract.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:

  • That the purchase of desktop computers and a file server for the Borough municipal building in the amount of up to $27,000.00, and desktop computers for the library in the amount of $33,000.00 be awarded to Dell Computers at a price, per their quote on file, that is more than 10% less than under State contact #61030.
  • That the Chief Financial Officer of the Borough has certified that the funds are legally available in Capital Fund budget accounts #03-734-01 Computer Upgrades and 03-734-04 Library Computer Replacement.
  • That the documentation supporting this purchase be filed with the Director of the Division of Purchase and Property in the Department of the Treasury within five working days.

GENERAL COMMENTS – Commissioner’s Meeting – August 24, 2004

At 8:00pm the meeting was called to order and the announcement of Public Meetings was read by Commissioner Colombi. After the Pledge of Allegiance and a moment of silence, roll was taken. Commissioner Colombi and Commissioner Tarditi were present along with the Borough Solicitor, Borough Administrator, Assistant to the Administrator, and the Borough Clerk.

Commissioner Tarditi made a motion to waive the reading of the Minutes from the August 10, 2004 meeting. This motion was seconded by Commissioner Colombi and the motion was passed with a unanimous vote of those present.

Commissioner Reisner arrived at 8:05pm.

The public hearing on the ordinance amending Bond Ordinance #16-2004 was held. Commissioner Colombi explained that this is a correction to remove a line item from the original ordinance. As there were no questions or public comments, Commissioner Tarditi motioned to close the public hearing, which was seconded by Commissioner Reisner. The motion was passed unanimously. The ordinance was then adopted by unanimous vote.

On the first reading of the amendment to Ordinance #11-2004 the Borough Administrator commented that the Section 1 amounts are to correct the numbers only; the employees were paid correctly, but the numbers shown in the original ordinance were incorrect. It was also noted that the amounts in Section 2 are adjustments and the employee payroll will change accordingly. Commissioner Tarditi explained that these adjustments were based on input from the Ambulance Association. The first reading was passed by unanimous vote.

The first reading of the amendment to Bond Ordinance #14-2004 was explained by Commissioner Reisner as a technical amendment to include architectural and planning costs. Mr. Joe Haro, 29 Evergreen Lane, asked for this ordinance to be explained further. Both Commissioner Reisner and Commissioner Tarditi explained that this ordinance is to implement the recommendation of the Business District Taskforce to look into acquiring the 21 Tanner Street property for parking. It might also be part of a future redevelopment zone, now under study by the Planning Board. This item was passed by unanimous vote.

Resolution items one (1) and two (2) were read and passed unanimously when no questions were asked.

Commissioner Reisner gave a brief description of the resolution authorizing the Borough to issue a check for BID taxes to be paid to the Partnership for Haddonfield, Inc. As no questions were asked the resolution was passed unanimously.

The resolution authorizing the Borough to issue a check for the Pennsauken Landfill Case was briefly explained by Commissioner Tarditi. Kirk Peterson, 214 Lakeview Avenue, inquired as to why the Borough is still involved in this case. The Borough Solicitor explained that any entity that produced or delivered trash to the landfill was involved. This type of case could, and has, gone on for years. The resolution was then passed by an unanimous vote.

The resolution authorizing the Borough to issue a check for the overpayment of taxes was unanimously passed when no questions were asked.

The resolution authorizing the Borough to issue a check for the overpayment of water and sewer charges was passed by a two-thirds vote. Commissioner Reisner did not vote.

Resolution items 7 through 12 were all passed unanimously when there were no questions from the public.

The resolutions to award an unspecifiable service contract for computer software and for the purchase of computers were explained by the Borough Administrator. These purchases were extensively researched and are necessary as the current programs used are all DOS based and the computers need to be upgraded also to be able to properly handle the new software. The Library will be receiving 26 of these new computers and Borough hall will be getting 14, as well as the server. It was noted that the cost of the computers is at a price of 10% less that the state contract cost. Both resolutions were passed unanimously when no questions were asked by the public.

Commissioner Colombi commented that the resolution authorizing the approval of Change Order No. 1 for the North Haddon Avenue Pedestrian Circulation and Traffic Calming Plan is a reduction in the price. It was also noted that the lanterns have been ordered and should be put in sometime in October. Commissioner Tarditi noted that this project was mostly funded by the State.

Commissioner Colombi announced that the meeting was now open for public comment.

Ted Raicyzk, 615 Wayne Avenue, questioned the payment made to Son’s Auto Supply for $2,240.22 and the Schoor DePalma payment of $3,006.00. It was explained that the first item is through Public Works and is most likely for items that were damaged due to the flood and the second item is for an open space study.

Mr. Raicyzk also asked if the Commissioners were aware of a petition being passed around on Radnor and Wayne Avenues with regards to proposed work on Radnor Field. Commissioner Tarditi explained that he believes this is a school project and nothing had been presented to the Commissioners at this time.

Joe Haro asked if the Borough had changed tree service companies recently. Commissioner Colombi explained that due to the high bid received by long-time contractor Asplundh at the recent bid request, a new company provided the lowest bid and was awarded the contract. The Borough Administrator explained that although the company is different the crew is the same as they were laid off when Asplundh did not get awarded the contract.

AN ORDINANCE AMENDING BOND ORDINANCE #16-2004 AUTHORIZING THE ACQUISITION, CONSTRUCTION, REPAIR AND INSTALLATION, AS THE CASE MAY BE OF VARIOUS WATER AND SEWER CAPITAL IMPROVEMENTS AS GENERAL IMPROVEMENTS IN AND FOR THE BOROUGH OF HADDONFIELD

WHEREAS, Ordinance #16-2004 adopted May 25, 2004 authorized appropriations in the amount of $1,039,500.00 and the issuance of $987,525.00 aggregate principal amount of general obligation bonds or notes of the Borough for financing of various Water and Sewer capital projects; and

WHEREAS, said Ordinance included the purchase of a utility truck replacement, which was not intended to be funded by this ordinance.

NOW, THEREFORE, BE IT ORDAINED, by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, (not less than two thirds, of the full membership thereof affirmatively concurring), as follows:

SECTION I:

Ordinance #16-2004 adopted May 25, 2004 should be amended to delete from Section I of said Ordinance the following:

7. Authorization to Renew Membership – August 10, 2004

Camden County Municipal Joint Insurance Fund

WHEREAS, the Borough of Haddonfield is a member of the Camden County Municipal Joint Insurance Fund; and

WHEREAS, said renewed membership terminates as of December 31, 2004 unless earlier renewed by agreement between the Municipality and the Fund; and

WHEREAS, the Municipality desires to renew said membership.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield as follows:

  • The Borough of Haddonfield agrees to renew its membership in the Camden County Municipal Joint Insurance Fund and to be subject to the Bylaws, Rules and Regulations, coverages, and operating procedures thereof as presently existing or as modified from time to time by lawful act of the Fund.
  • The Mayor and Clerk shall be and hereby are authorized to execute the agreement to renew membership annexed hereto and made a part hereof and to deliver same to the Camden County Municipal Joint Insurance Fund evidencing the Municipality’s intention to renew its membership.

GENERAL COMMENTS – Commissioner’s Meeting – August 10, 2004

At 8:00pm the meeting was called to order and the announcement of Public Meetings was read by Commissioner Colombi. After the Pledge of Allegiance and a moment of silence, roll was taken. All Commissioners were present along with the Borough Solicitor, Borough Administrator, Assistant to the Administrator, and the Borough Clerk.

Commissioner Tarditi made a motion to waive the reading of the Minutes from the July 13, 2004 meeting. This motion was seconded by Commissioner Reisner and the motion was passed with a unanimous vote.

An ordinance amending Bond Ordinance #16-2004 was introduced. Commissioner Reisner explained that this is a technical amendment removing a line item for $35,000 for a utility truck that should not have been included in the original Bond Ordinance. It will be purchased with operating funds. This first reading of this ordinance was passed unanimously by all Commissioners.

Resolutions for items one (1) through six (6) were read and passed unanimously when no questions were asked.

Commissioner Tarditi commented on the resolution to renew membership in the Camden County Municipal Joint Insurance Fund, stating that the Borough has been a member since 1987 and that this membership has saved the Borough over two million dollars since then. It is basically a joint purchasing agreement. The resolution was passed unanimously when no questions were asked by the attending public.

Commissioner Colombi gave a brief description of the resolution authorizing the Borough to apply for State Road Aid for the resurfacing of Marne Avenue. When no questions arose a vote was taken and the resolution passed unanimously.

Commissioner Colombi discussed how fortunate the Borough is to have the new members and renewing members of the various boards and commissions when the resolution to make various appointments was addressed. Commissioner Tarditi expressed the Borough’s gratitude to those who have served on these boards and commissions and are now leaving. The resolution was passed by a unanimous vote.

Commissioner Colombi announced that in the August 10-17, 2004 edition of the new newspaper, The Haddonfield Sun, there is an article published concerning the Borough Administrator, Mr. Richard Schwab, and the fact that he has been with the Borough now for 25 years.

Commissioner Tarditi noted that in attendance was Lt. Ted Steussy, who is filling in for Chief Tsonis who is on vacation.

Betty Anne Young, 46 Grove Street, asked for an update on building a new library and what needs to be done to the current building so that it can continue to be used until a new library is built. Commissioner Colombi responded that a Consultant, Leslie Burger, has been selected to look at the space needs for a new library and should have a report to the Borough within a few months. The Borough has authorized architects Voith and MacTavish to work up plans for a smaller library that will be approximately 30,000 square feet. However, we need to take care of mold issues so the current building can stay in operation.

Ms. Young then addressed the issue of the $800,000 being set aside to purchase 21 Tanner Street for parking facilities and asked for a status on this situation and inquired about the long term plans for this project. Commissioner Tarditi explained that the Borough has set up a Parking and Access Task Force to evaluate parking issues. The Commissioner briefly mentioned the proposed Redevelopment Zone and commented that the eventual goal is to increase parking through private investment which would probably include configuring a parking structure with residential apartments or condominiums. It was stated that although no developer has been chosen to work at this site the Borough has been approached by a few who would be interested.

Ms. Young also asked for an explanation of the affordable housing issues and whether or not the condominiums planned for Kings Court would be affected. The Borough Solicitor explained that all projects above five (5) units that have not already been approved are on hold at this time due to this situation. This matter is before the State Council on Affordable Housing (COAH). Ms. Young noted that Planner, Betsy McKenzie, had been hired again by the Borough. Commissioner Colombi noted that she has been hired to assist with issues related to affordable housing along with an attorney who specializes in this area. Commissioner Reisner gave a brief background on what is happening with COAH and explained that the Borough will get recommendations from the professionals hired, but that the Borough does not yet know where things will go at this time.

The last item addressed by Ms. Young was Bancroft NeuroHealth and what is being done regarding the Zoning violations at the Lindens facility. Commissioner Colombi stated that this is being worked on with the new CEO, Dr. Martin. The Borough Solicitor explained that Dr. Martin is hoping that the Borough will work with Bancroft by allowing them to reduce the number of patients/residents at the Lindens by attrition so that as they are discharged, no replacement will be made until the total number of patients/residents reaches fifteen (15). Ms. Young stated that she felt Bancroft should be fined until they come into compliance.

Pam Blake, 616 Grove Street, asked how the problem with speeding and traffic volume on Grove Street can be solved? She suggested additional stop signs and more speed bumps as possibilities. Commissioner Tarditi explained that there has been an increased amount of radar recently throughout the Borough and that most of this has been on Grove Street. The Borough is looking at traffic calming techniques to implement. Lt. Stuessy mentioned that there will be another “Drive 25” week in October and the police department is on the streets now addressing this issue.

Susan Lowe, 616B Grove Street, asked for a time frame on the implementation of traffic calming techniques. She feels unsafe just walking on the sidewalk now due to the speed of vehicles and the use by drivers of cell phones and their lack of attention. Commissioner Tarditi explained that the Borough is now a “demo program” for a Borough-wide traffic calming study, funded by the state and that a recommendation can be expected by this fall.

Jim McGarry, 208 Westmont Avenue, noted that he has heard about various studies that are ongoing with the Borough at this meeting and would like to find out where he can get copies of the results. The Commissioners explained that as these are public records they are available to the public at the Borough Hall. We also provide them to the Library and are putting some on our Borough webpage.

Steve Lick, 47 Heritage Road, stated that the issue of flooding and sewage contamination on Heritage Road needs to be addressed. Commissioner Tarditi commented that this issue was addressed before, but apparently needs to be worked on again. The Borough will reopen the issue and talk with the architects to see what can be done. Mr. Lick gave copies of a letter from Ethel Harrison, 17 Heritage Road, to all of the Commissioners which also addressed this issue.

Mr. Ted Raiczyk, 615 Wayne Avenue, asked about a payment made to First American Tax Service. Commissioner Reisner explained that the payment is specifically addressed in the resolution to issue a check for overpayment of taxes.

Mr. Raiczyk also asked if something could be done to change the fact that root trimmings are done only once a week. He explained that he had a new driveway put in and there were problems with scheduling due to root work only being done on Thursdays. Commissioner Colombi explained that as there is only one crew in the Borough to work on trees and related issues it was decided that this would be the best way to get things done rather than having this crew constantly stop working on projects to do root work.

Kirk Peterson, Lakeview Avenue, noted that there are problems on Tanner Street with driveways that are very low and which retain water and cause problems. He also mentioned what he believed to be vandalism at the eagle fountain. Commissioner Tarditi stated that this is actually repair work on the fountain. Mr. Peterson also mentioned that he has been having a problem with water in his basement and he would like to get a determination from the Borough if it is due to Borough owned property to his rear. Commissioner Colombi acknowledged his problem.

Mr. Lick asked what can be done about a dead tree on his neighbors property which could potentially damage his property if it fell. Commissioner Tarditi explained that he should write a letter to the neighbor detailing the problem and this would then put that neighbor on “notice”. This would help with liability issues should something occur.

Anthony Doginero, the brother of Robert Dogineri asked the Commissioners about a situation with his brother getting a tax refund due to being a veteran. Commissioner Tarditi stated that the Borough is aware of the situation and is looking into what can be done.

6. Auth. to Provide Tax Grace Period July 27, 2004

WHEREAS, mailing of the third quarter property tax bills was delayed due to the

timing of receipt of the certified aid figures from the State of New Jersey; and

WHEREAS, the Board of Commissioners of the Borough of Haddonfield wishes to allow the property owners of the Borough a sufficient period of time to pay their third quarter property tax bills.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:

  • That the grace period for payment of the third quarter property tax bills shall be ten (10) days from August 1 to August 10, 2004.
  • That interest charged on third quarter taxes paid after August 11 through and inclusive of August 20, 2004 be at a rate of .001%.

That interest charged on taxes received after August 20, 2004 be charged in accordance with the rates set by resolution dated January 2, 2004 and that said interest shall be computed retroactive to August 1, 2004 as required by State Statute.

7. Auth. to Accept and Advertise Audit Report July 27, 2004

WHEREAS, N.J.S.A. 40A:5-4 requires the governing body of every local unit to have made an annual audit of its books, accounts and financial transactions; and

WHEREAS, the Annual Report of Audit for the year 2003 has been filed by a Registered Municipal Accountant with the Haddonfield Borough Clerk as per the requirements of N.J.S.A. 40A:5-6, and a copy has been received by each member of the governing body; and

WHEREAS, the Local Finance Board of the State of New Jersey is authorized to prescribe reports pertaining to the local fiscal affairs, as per R.S. 52:27BB-34; and

WHEREAS, the Local Finance Board has promulgated a regulation requiring that the governing body of each municipality shall by resolution certify to the Local Finance Board of the State of New Jersey that all members of the governing body have reviewed, as a minimum, the sections of the annual audit entitled:

Schedule of Findings and Questioned Costs Or

Schedule of Findings and Recommendations; and

WHEREAS, the members of the governing body have personally reviewed as a minimum the Annual Report of Audit, and specifically the sections of the Annual Audit entitled:

Schedule of Findings and Questioned Costs Or

Schedule of Findings and Recommendations as evidenced by the group affidavit form of the governing body; and

WHEREAS, such resolution of certification shall be adopted by the governing body no later than forty-five days after the receipt of the annual audit, as per the regulations of the Local Finance Board; and

WHEREAS, all members of the governing body have received and have familiarized themselves with, at least, the minimum requirements of the Local Finance Board of the State of New Jersey, as stated aforesaid and have subscribed to the affidavit, as provided by the Local Finance Board; and

WHEREAS, failure to comply with the promulgations of the Local Finance Board of the State of New Jersey may subject the members of the governing body to the penalty provisions of R.S. 52:27BB-52 – to wit:

R.S. 52:27BB-52 – “A local officer or member of a local governing body who, after a date fixed for compliance, fails or refuses to obey an order of the director (Director of Local Government Services), under the provisions of this Article, shall be guilty of a misdemeanor and, upon conviction, may be fined no more than one thousand dollars ($1,000.00) or imprisoned for not more than one year, or both, in addition shall forfeit his office.”

NOW, THEREFORE BE IT RESOLVED, that the governing body of the Borough of Haddonfield, County of Camden, State of New Jersey, hereby states that it has complied with the promulgation of the Local Finance Board of the State of New Jersey dated July 30, 1968 and does hereby submit a certified copy of this resolution and the required affidavit to said Board to show evidence of said compliance.

GENERAL COMMENTS – Commissioner’s Meeting – July 27, 2004

At 8:00 p.m. the meeting was called to order and the announcement of Public Meetings was read by Commissioner Colombi. After the Pledge of Allegiance and a moment of silence, roll was taken. All Commissioners were present along with the Borough Solicitor, Borough Administrator, Assistant to the Administrator, and the Borough Clerk.

Commissioner Tarditi motioned to waive the reading of the Minutes from the July 13, 2004 meeting. This motion was seconded by Commissioner Reisner and the motion was passed with a unanimous vote.

Commissioner Colombi, the Borough Administrator and Judge Mark Barrett a resident of the affected area gave brief backgrounds on the Ordinance to Amend Ordinance #1720 and Code Chapter 232 entitled Traffic to provide permit parking for certain streets. It was noted that this is for the 100 block of Ardmore Avenue. Thanks were given to Judge Barrett for initially realizing the situation and bringing it to the Borough’s attention. Chief Tsonis explained that the time frame required to implement this would be 2-3 months, as the Borough still has to determine where the proper permits will be purchased and other items along those lines. It was mentioned that this time frame may be shorted to one (1) month if we could retro-fit existing permits for this use. The Borough Administrator noted that the Borough will notify the appropriate residences when the permits are available. The second reading of the ordinance passed with a unanimous vote.

Paul Eckman, 140 Ardmore Avenue, questioned whether or not the parking permits are granted to a particular residence or to a specific vehicle. The Borough Administrator responded that the permits are to a residence, but all vehicles must be listed in the permit.

Commissioner Reisner discussed the Amendment to the Code Chapter 107 – Fees briefly. It was noted that these changes are due to the Open Public Records Act. The second reading of this ordinance passed with a unanimous vote.

The Amendment to the Code Chapter 135 – Land Development was commented on by all the Commissioners, who noted that this is specifically to encourage restaurants in Haddonfield. This Ordinance passed with a unanimous vote.

Kirk Peterson, Lakeview Avenue, questioned the payment to Haddonfield Youth Football. The Borough Administrator responded that this is most likely a reimbursement for some type of service done.

Ted Raiczyk, 615 Wayne Avenue, asked about the payment to Line Systems, Inc. and who they were. It was stated that this would have to be looked up after the meeting to give a correct answer. (It was for the Borough’s telephone service.)

Commissioner Reisner commented that the BAN-2-2004 Resolution represents short-term debt and is used for capital improvements; $49,416.80 net interest is the actual cost involved.

It was noted that the payment of the school taxes is the second of eleven (11) installments the Borough makes every year.

The Resolution authorizing the Borough to provide a tax grace period was commented on by Commissioner Reisner. This is a resolution the Borough does any year that the tax bills don’t go out by July 15 th. It is usually because the tax rates are not received in a timely manner from the County and to delays in State Aid calculations.

Commissioner Reisner also commented on the Resolution authorizing the Borough to accept and advertise the Audit Report. It was noted that the Borough received a very good report this year.

All resolutions were passed unanimously by the Commissioners.

Commissioner Colombi introduced Mr. Alan Bauer, an Editor and General Manager of Haddonfield’s newest newspaper – The Haddonfield Sun. It was announced that the first publication would come out on August 4, 2004.

Thanks were given to the Rotary Club for the 23 rd year of July Summer Concerts by Commissioner Tarditi.

Mr. Ted Raiczyk commented that the Haddon Avenue project is great for pedestrians, however, when two trucks go through the area at the same time they have to slow way down. Chief Tsonis responded that the project is then working as is was intended.

Kirk Peterson noted that he approves of this project on Haddon Avenue and will recommend others areas within the town that would benefit from the same type of project. He also noted that the no parking signs at 401 N. Haddon Avenue need to be replaced. In addition Mr. Peterson commented that the area between the Public Works facility and Reillywood Park needs to be looked at and cleaned up as children are using this area. Chief Tsonis stated that this has already been done, but will check it again.

AN ORDINANCE TO AMEND ORDINANCE #1720 REGULATING TRAFFIC AND PARKING IN THE BOROUGH OF HADDONFIELD AND THE CODE OF THE BOROUGH OF HADDONFIELD, COUNTY OF CAMDEN, STATE OF NEW JERSEY, CHAPTER 232 THEREOF ENTITLED VEHICLES AND TRAFFIC, TO PROVIDE FOR PERMIT PARKING FOR CERTAIN STREETS

Be it ordained by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:

SECTION I:

Ordinance #1720 regulating traffic and parking in the Borough of Haddonfield, also known as Chapter 232 of the codified ordinances of the Borough of Haddonfield entitled vehicles and traffic, is hereby amended as follows:

1. Ord. 1720, Art. XXXIII entitled “RESTRICTED PARKING”, also known as Section 232-28 of the codified ordinances, entitled “Parking prohibitions during certain hours on certain streets” is amended to read as follows:

“No person shall park a vehicle, between the dates and on the days specified below where so listed, or where no dates or days are specified, on any day, between the hours specified below, upon any of the streets or parts of streets described:”

and further to delete “Marne Avenue” and “Wayne Avenue” from the listed streets.

2. Ord. 1720 Art. XIA, also known as Section 232-26 of the codified ordinances, entitled “Exemptions from time-limit parking” is amended to add the following:

A. (No change)

B. Overnight permits issued per Ord. #1720 Art. XIV, also known as section 232-29, shall be valid for parking during the days and times listed for streets in Art. XXXIII, also known as section 232-28.

1. Residents of properties that abut the portions of streets listed in Art. XXXIII, also known as sec. 232-28, who wish to provide for temporary parking of vehicles during the days and times listed for their street under such regulation where they do not obtain overnight permits per Art. XIV, also known as sec. 232-29, may request up to two (2) temporary parking permits, to be provided at no charge, that will be valid during the hours of restriction. When displayed in or upon such vehicles as directed by the Chief of Police, such permit will allow the vehicle to be legally parked, as long as there is no other exceptional condition such as provided under Art. XIV 4, also known as sec. 232-29 F.

C. The application for on-street parking permits provided for by this section shall be submitted to the Chief of Police who shall cause his designee to evaluate the application and shall grant parking permits if the terms of this section are in accordance with the rules and regulations promulgated by the Borough Administrator.

D. The residents, covered under A. above, shall pay a fee of $25 per yearly permit. Applicants who hold a valid overnight parking permit listed in Art. XIV, also known as sec. 232-29, shall be charged only $15.

E. All permits shall expire at the end of each calendar year.

SECTION II:

All ordinances or parts of ordinances inconsistent with this amending ordinance be and they are hereby repealed to the extent of such inconsistencies only.

SECTION III:

If any section or provision of this ordinance shall be held unconstitutional or invalid by any court, the remaining sections and provisions shall, notwithstanding such holding, remain and be in full force and effect.

SECTION IV:

This ordinance shall be in effect upon passage and publication according to law.

Section 1. Section 45:3(B)(1) of Chapter 107, Fees, of the Code of the Borough of Haddonfield, is hereby amended to change the fee of ten dollars ($10.00) to twenty dollars ($20.00), to read as follows:

AN ORDINANCE TO AMEND THE CODE OF THE BOROUGH OF HADDONFIELD, COUNTY OF CAMDEN, STATE OF NEW JERSEY, CHAPTER 135 THEREOF ENTITLED LAND DEVELOPMENT, TO INCREASE THE MAXIMUM SIZE OF RESTAURANTS PERMITTED AS A CONDITIONAL USE IN THE CENTRAL BUSINESS DISTRICT ZONE AND TO CHANGE SOME ASSOCIATED PARKING REQUIREMENTS

WHEREAS, recent analysis of the best mix of uses in the Central Business District (CBD) zone concluded that restaurants should be encouraged; and

WHEREAS, currently restaurants are only permitted in the CBD zone as a Conditional Use with a maximum size of 2,000 square feet and extensive parking requirements; and

WHEREAS, current restaurant uses can require an area of up to 5,000 square feet to be successful; and

WHEREAS, the reality has been that most properties that have been used as restaurants in the CBD zone have not had sufficient off-street parking to meet the conditions without requiring approval of the restaurant as a Use Variance; and

WHEREAS, virtually every existing restaurant has obtained a use variance with an off-street parking waiver and the history of these uses has proven that the lack of off-street parking has not resulted in a negative impact on the Borough in the core of the downtown business district along Kings Highway and adjacent streets; and

WHEREAS , one way to encourage restaurants to open in Haddonfield is to insure regulations meet current business needs and to eliminate clearly unnecessary regulation; and

WHEREAS , it is therefore appropriate to change the Land Development regulations to permit larger restaurants, by Conditional Use, in the CBD district and to eliminate the requirement of providing off-street parking in the downtown business portion of the CBD zone district along Kings Highway and adjacent streets, while still requiring new restaurants to meet the other Conditional Use requirements which deal with operations unique to restaurants, such as solid waste handling, odor control and health and sanitation as well as normal site plan approval, historic district approval (where applicable) and sign approval.

THEREFORE, be it ordained by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:

SECTION I:

Chapter 135 of the codified ordinances of the Borough of Haddonfield entitled Land Development is hereby amended as follows:

1. Article VII Conditional Uses, Section 135-65 Specific Requirements subsection “D(5). Restaurants”, is amended to change to read as follows:

(5) No restaurant shall have in excess of 5,000 square feet of total floor area, exclusive of storage area.

2. Article IX Site Design Standards, Section 135-86 Off-street Parking, subsection B(2) Number of spaces, Non-residential uses, the portion entitled Restaurants and catering halls, is amended to read as follows:

Restaurants and catering halls
(a) Quick food
1 space per 30 square feet of GFA
(b) Other

(i) Restaurants in permitted zones fronting on or adjacent to:

Kings Highway – East and West (between Linden Ave and Friends Ave);

Tanner Street;

Haddon Avenue between Euclid Avenue and Ellis Street;

Kings Court (between Kings Highway and Ellis & Centre St.)

No off-street parking required.

(ii) Restaurants at all other legal locations

1 parking space per 100 square feet of GFA

SECTION II:

All ordinances or parts of ordinances inconsistent with this amending ordinance be and they are hereby repealed to the extent of such inconsistencies only.

SECTION III:

If any section or provision of this ordinance shall be held unconstitutional or invalid by any court, the remaining sections and provisions shall, notwithstanding such holding, remain and be in full force and effect.

SECTION IV:

This ordinance shall be in effect upon passage and publication according to law.

7. Auth. to Create a Haddonfield Affordable Housing Committee July 13, 2004

and Appoint Members

WHEREAS, the New Jersey Council on Affordable Housing (“COAH”) certified Haddonfield’s Housing Element and Fair Share Plan (hereinafter “affordable housing plan”) on July 7, 1999; and

WHEREAS, in conjunction with certifying the Borough’s plan, COAH determined that the Borough had a scarcity of land for development and assigned the Borough a “realistic development potential” of zero; and

WHEREAS, the Borough and its Planning Board have implemented the Borough’s certified plan; and

WHEREAS, redevelopment activity has occurred since COAH certified the Borough’s plan even though neither the Borough nor COAH anticipated such activity at the time of certification; and

WHEREAS, notwithstanding the above, Fair Share Housing Center (“FSHC”) has brought a “scarce resource motion” and raised questions regarding the responsibilities of the Borough under the circumstances; and

WHEREAS, the Board of Commissioners believes this issue needs prompt and serious attention to meet the interests of all concerned; and

WHEREAS, accordingly, the Borough has retained Special Mount Laurel counsel and a planner with expertise in affordable housing to help provide guidance to the Borough with respect to the matters raised by the motion; and

WHEREAS, in a further effort to address the issues raised by the motion and Mount Laurel issues generally, the Borough has determined that it is in its best interest to create a committee of officials to develop an understanding of the issues raised by the motion and to provide assistance in formulating the Borough’s position in this matter; and

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:

  • That a committee, to be known as the Haddonfield Affordable Housing Committee, be formed immediately, with the responsibility to review all issues relating to the Borough’s current Fair Share Housing plan and recommending any immediate steps to change the plan along with implementation steps.
  • That the Committee consist of the Mayor, the Borough Solicitor, the Planning Board Solicitor, a member of the Haddonfield Planning Board appointed by the chair of that board, the Zoning Officer, the Borough Administrator, the Special Planner and the Special Counsel for Affordable Housing matters, to be chaired by the Special Counsel.
  • That the Committee shall provide guidance and make recommendations to the Borough and its Planning Board.

Whereas, there exists a need for expertise in planning for the best use of area lands for parks, recreation and open space or the benefit of the Borough of Haddonfield; and

WHEREAS, in response to a Request for Proposals, three professional landscape architectural/planning/engineering firms submitted proposals to update the Parks, Recreation, Open Space element of the Borough’s Master Plan for the Haddonfield Planning Board; and

WHEREAS, a committee designated by the Planning Board investigated the most reasonable financial proposals and interviewed representatives for the purpose of recommending to the Planning Board and the Commissioners a professional firm that they believe would be of the best assistance to the Borough within the budgeted funds available; and

WHEREAS, it has been determined that the services required are both professional and extraordinary and unspecified in nature; and

WHEREAS, it has been determined that, based on the recommendation of the committee, the engineering/planning/landscape architecture firm of Schoor DePalma Inc. is well qualified to provide the required services; and

WHEREAS, funds are available in Account 01-108-02 (Current Fund – Planning, studies, OE) for this purpose; and

WHEREAS, the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., requires that a resolution authorizing the award of a Contract for Professional and/or Extraordinary and Unspecifiable Services without competitive bids must be publicly advertised.

GENERAL COMMENTS – Commissioner’s Meeting – July 13, 2004

At 8:00 p.m. the meeting was called to order and the announcement of Public Meetings was read by Deputy Mayor Reisner, who commented that Commissioner Colombi was absent for this meeting due to an out of town vacation. After the Pledge of Allegiance and a moment of silence, roll was taken. Commissioner Tarditi was present along with the Borough Solicitor, Borough Administrator, Assistant to the Administrator, and the Borough Clerk.

The Borough Administrator gave a brief background on the Ordinance to Amend Ordinance #1720 and Code Chapter 232 entitled Traffic to provide permit parking for certain streets. He noted that this is for Ardmore Avenue. The first reading of the ordinance passed with a unanimous vote.

Commissioner Reisner discussed the amendments to the Code Chapter 107 – Fees and the Borough Administrator discussed each item in detail. It was noted that these changes are due to the Open Public Records Act. The first reading of this ordinance passed with a unanimous vote.

The Amendment to the Code Chapter 135 – Land Development was briefly commented on by Commissioner Reisner, who noted that this is specifically to encourage restaurants in Haddonfield. Dan Keashen of the Haddon Herald questioned if there are new restaurants showing an interest in moving to Haddonfield. Commissioner Reisner stated that there are and Commissioner Tarditi commented that there are existing ones that are interested in upgrading or moving to new locations within the Borough.

This Ordinance passed with a unanimous vote.

Commissioner Reisner briefly commented that the resolution to award professional services contract to hire a planner is for someone that we have hired before, Elizabeth McKenzie and that this time she will be helping with the COAH project. He also explained the next resolution to designate an affordable housing committee to make a recommendation on amending Haddonfield’s Fair Share Housing Plan.

Commissioner Tarditi moved to make an addition to the resolution to award the bid for Shade Tree trimming and removal to Elite Tree Service. He requested that the date of August 1, 2004 be added as the date the contract starts. The Borough Administrator gave a brief background on Elite Tree Service, specifically noting that they have state contract in six counties and that there is expected to be a smooth transition to this new company.

Commissioner Tarditi stated that Schooner DePalma is a client of his insurance company, but that under the rule of absolute necessity due to Commissioner Colombi’s absence, and as advised by the Borough Solicitor, he will be voting on this resolution.

All resolutions were passed unanimously by the Commissioners.

Mr. Ted Raiszyk, 615 Wayne Avenue, questioned the high numbers shown on the resolution to cancel water and sewer charges. The Borough Administrator stated that the cancellations dealing with large dollar amounts are to correct estimated readings once actual readings are obtained as well as reading errors.. Commissioner Reisner explained that when the Borough is notified of an error of this sort that it is investigated and the reasons for the error are determined before making this type of correction.

Mr. Raiszyk also questioned who provided the fireworks for the Independence Day celebration and if this was the same group who does the First Night fireworks? Commissioner Tarditi stated that it has been the same company for a few years now for both events.

Commissioner Reisner requested a moment of silence for Gene Hinsky, a previous Mayor of Haddonfield, who passed away recently.

The meeting was adjourned at 8:25 pm.

WHEREAS , the Board of Commissioners has deemed it necessary to contract with Bowman & Company, LLP, 601 White Horse Road, Voorhees, New Jersey to perform certain additional non-audit services to assist the Tax Collector in analyzing open balances in various tax accounts to clarify the make up of these accounts; and

GENERAL COMMENTS – Commissioner’s Meeting – June 22, 2004

At 8:05 p.m. the meeting was called to order and the announcement of Public Meetings was read by Mayor Colombi. After the Pledge of Allegiance and a moment of silence, roll was taken; all Commissioners were present along with the Borough Solicitor, Borough Administrator, Assistant to the Administrator, and the Borough Clerk.

Commissioner Tarditi called to waive the reading of the June 8, 2004 meeting minutes, which was seconded by Commissioner Reisner. There was a unanimous vote to waive the reading of these minutes.

Ted Raiczyk, 615 Wayne Avenue, asked about the payment made to Pollution Control Financing. Commissioner Colombi stated that this is the cost to take trash to the incinerator.

On the authorization to sign an engagement contract with the Auditor for addition services, Commissioner Reisner briefly explained that this is to have them determine the status of all tax liens due to tax sales certificates. Once all liens are clearly identified, the auditors will he;p assure future entries are being done correctly. The results will be used to tighten up the Borough’s procedures.

All resolutions were passed unanimously by the Commissioners.

Ted Raiczyk noted that the speed bump on Maple Avenue was removed and asked the reasons behind this. Commissioner Tarditi informed him that the State removed this bump because it had been installed incorrectly and has since put in a new, lower bump. This had been brought to the State’s attention because of the number of complaints that had been received.

Judy Ellis, 810 Wayside Lane, stated that she would like to see the R5 zoning returned to a 35-40’ front yard set back. Russell Snyder, also of 810 Wayside Lane, stated they liked the continuity of lawn scapes when the houses are back further. Commissioner Tarditi commented that the Commissioners would be reviewing the recommendations of the Planning Board.

Mr. Raiczyk asked about the bump out that has been approved for Rhoads Avenue and whether or not this would cause problems with people turning left onto Wayne Avenue and therefore backing traffic up on Rhoads as they will not be able to go around on the right of the turning vehicle. Commissioner Tarditi explained that this is expected, but there is a higher concern with safety and pedestrians.

After a quick reminder of the July 4 th Parade and celebrations being held on July 5 th, the meeting was adjourned at 8:25 p.m.

WHEREAS, the Rotary Club of Haddonfield has been appointed to promote a Summer Concert Series on Fridays in July including July 2, 9, 16, 23 and 30, 2004 between the hours of 6:00 p.m. and 9:00 p.m. at Kings Court on Kings Highway in the commercial district of the Borough of Haddonfield.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:

WHEREAS, the Partnership for Haddonfield (PfH) will conduct its annual Sidewalk Sale Days on August 5 th, 6 th and 7 th, 2004 within the commercial district of the Borough of Haddonfield.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey, as follows:

  • Permission is hereby granted to the Retail Shops and Stores in the Borough’s CBD zoning district to utilize the public sidewalks and other public property in front of their businesses only, within these Commercial districts within the Borough of Haddonfield on August 5 th, 6 th and 7 th, 2004 as part of the PfH sponsored Sidewalk Sale Days, provided that the Retail Shops and Stores ensure safe pedestrian passage.

7. Auth. to Permit Insurance Coverage for Certain Organizations June 8, 2004

WHEREAS, the Borough of Haddonfield is a participating member of the Camden County Municipal Joint Insurance Fund relative to General Liability and other coverage; and

WHEREAS, the “FUND” has adopted certain criteria to distinguish between bona fide municipal activities and other quasi-public entities not sponsored by the municipality and therefore, not subject to coverage by the “FUND;” and

WHEREAS, it has been determined that in order to be covered by the “FUND” an organization or activity provide a service of the type that historically municipalities have undertaken themselves or have provided with insurance coverage and/or is one which advances a bona fide local public purpose on a non-profit basis typically met by local government, the benefits of which are available to the municipality in general; and

WHEREAS, the Borough has asked the “FUND” to extend General Liability and non-owned Automobile Liability Coverage to the following entities:

Haddonfield Business/Special Improvements District governed by the District Management Corporation know as Partnership for Haddonfield, Inc.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough Haddonfield, County of Camden, State of New Jersey, as follows:

  • It is hereby certified that the above listed organizations exist within the Borough of Haddonfield as bona fide providers of charitable, educational, or recreational activities for the Borough and are, in fact, organizations that support and/or provide services to the municipality in general and as such are sponsored or subsidized directly or indirectly by the municipality.
  • That the proper officer or officers of the Borough of Haddonfield be, and they are authorized and directed for and in the name of said Borough, to request the organizations described herein be named as additional insured for General Liability and Non-Owned Automobile Liability coverage in accordance with the applicable limits and restrictions.

10.Auth. to Oppose Assembly 2073 and Senate 1558 June 8, 2004

Whereas, A-2073/S-1558 goes far beyond its intent to address violations of rights protected under the New Jersey Constitution; and

WHEREAS, A-2073/S-1558 specifically includes a provision for award of counsel fees to a prevailing plaintiff for any claim that arises from an alleged violation of “any rights, privileges or immunities secured by the constitution or laws of this state”; and

WHEREAS, the wording in A-2073/S-1558 could allow an award of counsel fees for any case brought against a governmental entity arising under any statutory provision if the plaintiff can allege denial of due process; and

WHEREAS, almost every appeal of a municipal decision invariably involves an allegation concerning due process. Examples of matters that would become subject to fee shifting include decisions relating to zoning variances, site plan applications, building permits, Board of Health applications, licenses of all sorts and personnel matters; and

WHEREAS, that while the cost of this bill cannot be determined to any degree of certainty, the cost to New Jersey municipalities could easily be in the range of $25 to $50 million per year or more; and

WHEREAS, there is no corresponding right to obtain counsel fees if the governmental entity were to prevail, however the plaintiff need only prevail in the litigation to receive counsel fees; and

WHEREAS, The New Jersey League of Municipalities and the Municipal Excess Liability Joint Insurance Fund are negotiating amendments that will prevent an unnecessary increase in municipal costs while still protecting civil rights.

NOW, THEREFORE, BE IT FURTHER RESOLVED that the Board of Commissioners of the Borough of Haddonfield, County of Camden, Sate of New Jersey, urges support of amendments to address these serious concerns, and so that there can be protection for the civil rights of New Jersey citizens without opening the floodgates to litigation on a broad range of claims that will no longer be governed by the traditional principle that litigants pay their own costs of litigation.

BE IT FURTHER RESOLVED this resolution shall be forwarded to our State Senator and Assembly Representative, to Governor James E. McGreevey, and to the New Jersey State League of Municipalities.

To Hire Special Counsel

Whereas, there exists a need for expertise in land use and affordable housing matters including litigation; and

WHEREAS, it has been determined that the services required are both professional and extraordinary and unspecified in nature; and

WHEREAS, it has been determined that Jeffrey R. Surenian of Lomell Law Firm is well qualified to provide the required services; and

WHEREAS, funds are available in Account 01-104-00 (Current Fund – Legal OE) for this purpose; and

WHEREAS, the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., requires that a resolution authorizing the award of a Contract for Professional and/or Extraordinary and Unspecifiable Services without competitive bids must be publicly advertised.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Haddonfield, County of Camden, State of New Jersey as follows:

  • The Borough is hereby authorized to retain Jeffrey R. Surenian of Lomell Law Firm, 250 Washington Street, P.O. Box 787, Toms River, New Jersey 08754, to provide professional services for COAH issues for a maximum amount of $175.00/hour plus reimbursement for allowable out of pocket costs.
  • This contract is made without competitive bidding as a “Professional and Extraordinary and Unspecifiable Service” under the provisions of the Local Public Contracts Law because of the qualitative nature of the services being utilized.
  • A notice shall be published in the Retrospect newspaper, as required by law, within ten (10) days of the passage of this resolution.
  • This resolution shall take effect immediately.

WHEREAS, throughout our long national journey, one symbol has endured as a badge of honor for every American and a beacon of hope for the oppressed: the flag of the United States; and

WHEREAS, for more than two centuries, “Old Glory” has challenged us to make real the highest ideals of the patriots and visionaries who chose it as our national symbol in the early days of our Republic; and

WHEREAS, the flag of the United States has inspired us in battle, reassured us in times of peace, and comforted us at moments of great national grief; and

WHEREAS, in its white stripes, we recognize the sanctity of the American ideals on which our Republic was founded: liberty, justice, equality and the guarantee of individual rights; and

GENERAL COMMENTS – BOARD OF COMMISSIONERS – June 8, 2004

The Mayor called the meeting to order at 8:01 and announced the Open Public Meetings Act notice. This was then followed by the Pledge of Allegiance and a moment of silence.

Mayor Colombi, Commissioner Reisner and Commissioner Tarditi were in attendance in addition to the Solicitor, the Administrator and the Deputy Clerk.

Commissioner Tarditi made a motion to waive the reading of the minutes and approve as posted. The motion was seconded by Commissioner Reisner. Roll call vote was taken. Motion passed unanimously.

The public hearing for the Ordinance to Amend Code Chapter 69 – Animals, To Extend the Effective Date of Regulations Governing Dogs Running at Large in the Crows Woods Area was opened and members of the audience spoke about the ordinance.

  • Bob Twitchell 674 Pomona Ave – Talked about safety issues, especially for children and related national dog bite statistics. Next, off leash dogs should be in a separate area. The final decision should be expedited. Stated that the land should be preserved as a nature area for education.
  • Jan Sterling 44 Birchall Drive – Believe that there should be a measured amount of risk and listed various types of injury in comparison with dog risks. Mr. Sterling addressed various issues raised by Mr. Twitchell.
  • Ann Gaughan 320 West End – Indicated that she believes that too much time has been spent on this issue. She further stated that she felt that the current plan was working and that the ordinance is only to deal with the extension of time until the open space issue is addressed.
  • Phyllis Rosenberg 116 West Summit – Stressed that a child’s safety is much more important than a dogs need to exercise. Suggested that the issue be taken to the voters. Further stressed the concern over liability issues.

The Mayor had the Solicitor inform the public that the Borough has $7 million in insurance coverage and suits would be handled through the Joint Insurance Fund. The liability question with regards to this issue is unsettled. The Commissioner’s decision should be based on safety, not liability.

  • Greg Derham 339 Bellevue– Recognized that both sides shared a common interest and concern in the location. Stated that he believed that if both sides get together they could further the plans that were started back in the 70’s for the area.
  • Bruce Banford of 127 Wayne – This is an issue more about people than about dogs. Uses Crows Woods daily with his dog and doesn’t believe the woods will be used more by those people who go without dogs.
  • Linda Brees 135 West End Ave – Talked about a personal situation with violence and dogs. Indicated that dogs should be on leash.
  • Nancy Jerome 215 Jefferson Ave – Enjoys the use of the woods with her dog and would not like it taken away.
  • Susan Perry 331 Woodland Ave – Wanted to remind everyone that there is already a compromise in place and that those who are afraid of dogs can use the area during those times when the dogs are not allowed.
  • Jennifer Galloghy 385 Station Ave – requested an extension of family time for longer during the week and possibly one day for the weekend. Also reminded the Commissioners that he summer recreation program would be going on.

Mayor Colombi indicated that the ordinance provides for extending the on-leash hours so that those summer recreation program period would be covered.

  • Karen Berman Pine St. Audubon - Doesn’t feel safe walking in the woods without her dog.
  • Bill Tourtellote 414 Peyton – Indicated that he didn’t believe that the compromise was that fair due to the fact that the hours without off leash dogs were during the normal working day. Believed that COLA had the better part of the deal. Stated that he felt the issue would fail at a referendum.
  • Bill Olver 40 Grove Street – Explained that mountain bikes in his opinion are more destructive to the “nature area” and children than the dogs and their owners.
  • Beth Backa 1140 Gibbsboro Road – Believes that Haddonfield was better for taking a step forward in providing this facility for dogs and their owners.
  • Nancy Axelrod 312 Peyton Ave – Indicated that the Borough is not the only town with an area for dogs. Was upset over a comment made by another resident concerning keeping people out of Haddonfield.
  • Jamie Horwitz-Fram 241 Jefferson – Believed that people are welcome but that dogs should be on leash. Stated various statistics as to why dogs should be kept out of nature areas and the requirements for dog parks. Wants to know what the Commissioners are expecting to learn from the study that is going to be performed over the next 6 months.

Commissioner Reisner explained the study that was referenced by Ms. Horwitz-Fram. Commissioner Reisner stated that the use of Crows Woods is an important part of the study but not the only part. The Commissioner further went on to explain that he hoped the study would be a process which would have significant input from everyone, allowing for a solution which would be generally accepted by everyone.

Ms. Horwitz-Fram requested that higher priority be given to the Crows Woods part of the study. She further stated that she would like the ordinance to sunset in three months rather than six months.

Commissioner Reisner explained that pace of the study would be determined by the professional hired. Commissioner Tarditi indicated that this has become a quality of life issue for some families.

  • Ronald Jenson Cherry Hill – makes use of all benefits offered by various municipalities. Appreciates what Haddonfield has to offer.
  • Robin Raab 35 Centre Street – Recalls what the woods looked like prior to the dogs being allowed in the woods. The dog owners have cleaned up the woods. Indicated that the problems with dogs have disappeared from the Crows Woods Gardens outside the woods.
  • Craig Biddle 407 Fourth Ave, Haddon Heights – Does not live in Haddonfield but has his business here. Expressed the joy he has seen on peoples faces as they have enjoyed the park with their dogs. In addition to enjoying the walk with their dogs they are enjoying nature. He stated this is different than a fenced in area.
  • George Hay 304 Warwick - Explained that he and his family have enjoyed the woods and enjoyed the camaraderie of those who are using the woods with their pets. Would like a cost analysis of the issue. Believe that the benefits outweigh the problems.
  • Stephanie Malloy 316 Lakeview Ave - Stressed her support on behalf of the dogs.
  • Andrea Rizzuto 7 Lafayette Ave – Thanked those responsible for the wonderful Earth-day events. Explained that the trails are being ruined by the dogs. Does not enjoy the woods because she does not want to be confronted about her views on the subject and does not appreciate the dog feces.
  • Rick Davenport 220 Lakeview - Crows Woods should be a place of joy. Feels that the compromise works.
  • Lisa Blaber 220 Washington Ave – Believes that the compromise works. Stated a personal experience which reiterated her point.
  • Doug Frankenthaler 341 Longwood Drive - Would like the Commissioners to deal with the most encompassing use of the woods while dealing with the liability issues. Mr. Frankenthaler stated that he favored the original rules regulating the woods which required dogs on leash.
  • Sue Derham 339 Bellview Ave – Discussed the pilot program which has been run for the last nine months. Feels that the program is working.
  • Joy Pierce 113 Fowler Ave – Expressed her joy at the use of the woods with her pet.
  • Ken Werlacker Sicklerville – Enjoys the park with his pet and uses the businesses because of the use of the park.
  • Chris Barnes 716 Cedar Ave – COLA has commissioned a legal opinion with regards to the liability issue.
  • Dan Tompkins 36 Roberts Ave – Does not have a dog but believes that COLA has been good for the community and the Borough.

A motion was made to close the public hearing by Commissioner Reisner and seconded by Commissioner Tarditi. Roll call vote was taken. Motion passed unanimously.

Commissioner Tarditi thanked everyone for their comments and for listening to each others concern. He believed that the pilot program with the sharing of hours was working and that he is comfortable extending the ordinance for six months until the open space study was finished. He hoped that the study would provide for a continuation of off-leash opportunities.

Commissioner Reisner pointed out that different towns need to provide different services. Further stated that he wants to give the process time to get public input and find the best solution for the community.

Mayor Colombi explained that she believes that COLA has done a great job but that the safety concern outweighs the need for off-leash area and that her first concern is safety.

A roll call vote was taken concerning the ordinance. Mayor Colombi voted no while Commissioners Reisner and Tarditi both voted yes. The Motion passed.

RESOLUTIONS:

The Commissioners addressed the resolutions for the evening. All resolutions passed unanimously.

PROCLAMATION:

Flag Day – June 14, 2004

Mayor Colombi asked that the record note that letters were received by the Haddonfield Civic Association and resident Peter Fontaine concerning the Crows Woods Dog Ordinance.

Ms. Dana Stone, a Fourth Grade student from Elizabeth Haddon School was recognized.

Mayor Colombi stated that Friday is a National Day of Mourning for President Reagan’s funeral.

PUBLIC COMMENT

Ellen Trombetta 326 Springfield Terrace - Stated that the zoning office has not handled her comlaint with regards to a fencing issue involving her adjacent neighbor. She provided copies of documentation to the Commissioners.

Jeanne Wagner 811 Wayside – Asked why the Commissioners would not change the zoning ordinance to ensure that the front yard setbacks are 40 feet in the Hillside Farms tract.

The options under consideration are to change the setback from 30 feet to 40 feet or only to 35 feet. The Commissioners expressed their opinions with regards to the issue.
